An Ocean County man convicted on an obscenity charge for watching porn videos on his iPad while sitting in his car outside a fast-food restaurant during the dinner rush has lost a legal battle to overturn his conviction.
David J. Lomanto, 53, of Little Egg Harbor Township, was arrested on April 22, 2014, by township police and held on $20,000 bail after a woman parked next to him saw him watching porn on his tablet with his windows lowered.
The woman, whose 12-year-old son had gone into the restaurant for food, said she could see Lomanto’s iPad resting against the steering wheel and saw there was “porn going on the video.” Specifically, the woman saw images of a man and woman having sex and “heard moaning on the video,” according to court documents.
The woman said she was shocked because they live in a small town and she “never experienced anything like that in her life,” according to court documents.
After leaving the area with her son – who did not see the porn – the woman told a friend, who notified a police officer.
A Little Egg Harbor Township police officer arrived at the parking lot about 8:20 p.m. – nearly two hours after the woman had been there with her son – and found Lomanto still in his car, watching porn on his tablet, court records state.
When the officer told Lomanto someone had complained, he quickly closed out of the screen on his tablet. But another screen popped up that had “girls or women” and “live interaction,” according to the officer.
Lomanto at first refused to get out of his car, then repeatedly refused to show the officer his license or other identification. He was arrested and taken to the local police station, where he was charged with obstruction, according to court records.
A police computer expert later obtained a search warrant for Lomanto’s tablet and found that Lomanto had been watching porn for about four hours that night and had been using the restaurant’s WiFi to stream the videos, court records state.
In April 2015, Lomanto was indicted a charge of fourth-degree public communication of obscenity and obstructing a criminal investigation. In May 2017, a jury convicted him on those charges and the trial judge also found Lomanto guilty of disorderly conduct.
Lomanto was sentenced to two concurrent one-year terms of probation and five days in jail, which he had already served.
In appealing his conviction, Lomanto argued that the definition of “publicly communicates” in the obscenity law is overly broad “as it ensnares innocent individuals engaged in lawful behavior.”
Lomanto also argued that watching porn in the privacy of his car is protected under the U.S. Constitution.
In denying the appeal, Superior Court Judge Garry Rothstadt rejected Lomanto’s claim that watching pornography in his car with windows lowered during dinner time at a restaurant is protected under the constitution.
“While our courts have repeatedly acknowledged an individual’s privacy interest in the contents of their automobile, we have never extended the zone of privacy to what occurs inside a car that is plain view,” Rothstadt wrote.
The three-judge panel also rejected Lomanto’s arguments that his iPad was illegally searched and that the trial judge should have suppressed other evidence in the case.

A 37-year-old Oklahoma man has been jailed on rape complaints after authorities said he sexually assaulted a four-year-old girl in a bathroom at a McDonald's play area, which the child was visiting during a day care field trip.
Midwest City police say a day care worker knocked on the locked bathroom door at 7025 SE 15th Street on Tuesday after the girl didn't return promptly.
A police affidavit says a man eventually came out and said, 'I was just washing my hands.'
The child told workers the man, identified as Joshua David Kabatra, sexually assaulted her.
Kabatra told police that he had felt sick and threw up in the bathroom sink while the girl was on the toilet, News 9 reports.

Kabatra remains jailed in Oklahoma City, and court records don't list an attorney who can speak on his behalf.
McDonald's released a statement saying that they were 'disturbed by the incident.'
'At McDonald's, nothing is more important to us than the safety and well-being of our customers,' the statement reads.
'We are deeply disturbed by the incident that occurred at one of our Oklahoma restaurants earlier this week. We are fully cooperating with the police during their investigation. At this time, our thoughts are with the victim and others impacted by this incident.'

Armed Dad Puts Six Bullets Into Man Who Broke Into 12-Year-Old Daughter’s Room Pants-less

“He ended up getting six shots, period.”

An armed dad chased off a neighbor who broke into his Louisville home and undressed in their 12-year-old daughter’s bedroom Sunday according to a WDRB report.
According to the girl’s mother, Tina Burton, Donald Oliver, 38, broke into their house around 7 AM on Sunday and began undressing himself in her 12-year-old daughter’s bedroom.
“He got undressed in my daughter’s room,” Burton said. “Like, what was your intentions? … You are sick.”
Burton said her daughter handled the situation well.
“She was really smart,” Burton said. “She hid under the cover, turned her light down, turned her volume down on her phone to text me. When she peeked under the cover to see where he was at, she got up and ran away. She went to the back room. And I think that was really brave and smart of her.”
After the girl fled, Oliver made his way into the kitchen wearing only his underwear. That’s when he was confronted by the girl’s father, Ali Bracey.

“I told him to get out, and he didn’t want to move. And he growled at me,” Bracey told WDRB after the incident.
But when Oliver didn’t leave, Bracey said he was forced to attempt to fight him off with a broom or any other object he could find. After the fight carried on for some time, Burton retrieved a gun a gave it to Bracey, who fired six shots at Oliver, forcing him to finally flee the scene.

“He ended up getting six shots, period,” Bracey said.
According to the report, police found and arrested Oliver a short time later. He was taken to the hospital and treated for non-life threatening injuries before being taken to jail.
Later, police investigating the scene found a bag of heroin they believe Oliver dropped while undressing. He has been charged with burglary, assault, and possession of a controlled substance.
Bracey said neighbors in the area have commended him for his actions.
“Everyone has actually commended me on what I did. There hasn’t been any real backlash other than the family (Oliver’s family). But everyone in the neighborhood has commended me on what I did,” Bracey said.
The incident comes as national debate over the issue of gun control continues to rage. Many argue civilian ownership of firearms should be restricted, while pro-gun advocates point to the defensive use of guns as a vital right.

Drug Enforcement Administration Special Agent Convicted of Perjury, Obstruction of Justice and Falsification of Government Records

A U.S. Drug Enforcement Administration (DEA) special agent was convicted yesterday by a federal jury in New Orleans, Louisiana of perjury, obstruction of justice and falsifying government records.
After a seven-day trial, Chad A. Scott, 51, of Covington, Louisiana, was found guilty of two counts of perjury, three counts of obstruction of justice and two counts of falsifying government records. U.S. District Judge Jane Triche Milazzo of the Eastern District of Louisiana, who presided over the trial, has scheduled sentencing for Dec. 4, 2019.
According to the evidence presented during the seven-day trial, Scott, while a DEA special agent in New Orleans, committed these crimes in and around the New Orleans, Louisiana, and Houston, Texas, areas. Specifically, the evidence showed that Scott directed a Houston-based drug trafficker to buy a Ford F-150 truck worth approximately $43,000 and forfeit the truck to Scott as part of the drug trafficker’s cooperation. Scott then falsified the seizure paperwork for the truck in various aspects, including falsely claiming that he had seized the truck in New Orleans instead of Houston, in order to facilitate the vehicle being forfeited and given to Scott as his official government vehicle.
“Chad Scott violated his sworn commitment to serve the public and uphold justice, dishonoring the special trust that we place in each of our federal law enforcement agents,” said Assistant Attorney General Brian A. Benczkowski of the Justice Department’s Criminal Division. “Today’s conviction sends a clear message to the public that malfeasance by federal law enforcement officers will not be tolerated.”
“The conviction of Chad Scott reinforces the message that no one is above law,” said FBI Acting Special Agent in Charge Anthony T. Riedlinger. “Scott’s actions were selfish and placed an unnecessary stain on an otherwise stellar agency. We commend our partners at the DEA for their unprecedented level of cooperation throughout this investigation.”
“The criminal justice system relies on law enforcement agents to act with integrity and honesty. By soliciting bribes and compromising cases, Scott undermined the values he swore to uphold as a federal agent,” said Special Agent in Charge Robert A. Bourbon of the Justice Department’s Office of the Inspector General (DOJ-OIG). “The Office of the Inspector General will continue to be vigilant that corrupt law enforcement agents are held accountable.”
“At its core, DEA is a law enforcement agency committed to faithful and effective service to our country and its citizens, as well as uncompromising personal and institutional integrity,” said DEA Chief Inspector Brian McKnight. “Throughout the course of this investigation and its ultimate trial, DEA was appreciative of the professionalism and support that we received from our law enforcement partners.”
Additionally, the evidence showed that Scott convinced the same Houston-based drug trafficker, as well as another drug trafficker in Houston, to testify falsely at a federal trial in New Orleans as to the identification of a major cocaine and heroin supplier in the Houston area. Along with obstructing justice by inducing this false testimony, Scott then himself committed perjury during a motion session as well as during the federal trial, the evidence showed. After a trial including this false testimony, the alleged supplier was found guilty. Once Scott’s actions and the false testimony came to light, the case against the alleged supplier was dismissed by the court at the request of the United States.
Scott has been indefinitely suspended as a DEA special agent.
Two other former Tangipahoa Parish, Louisiana Sheriff’s Office deputies who were serving as DEA task force officers in New Orleans have pleaded guilty in this investigation. Karl Emmett Newman, 52, of Kentwood, Louisiana, pleaded guilty to unlawfully carrying a firearm in furtherance of an August 2015 robbery, which was disguised as the execution of a search warrant, as well as misappropriating money confiscated by the DEA during another search. Johnny Domingue, 30, of Maurepas, Louisiana, pleaded guilty to possession of cocaine and misappropriating money confiscated by the DEA.
Scott is additionally charged, along with Rodney Gemar, 43, of Ponchatoula, Louisiana, a former Hammond, Louisiana police officer and DEA task force officer, with various counts, including unlawful conversion of property by a government officer or employee and removing property to prevent seizure. Trial on those charges is set for October 2019. Those charges are only allegations and the defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

This case was initially investigated by the Louisiana State Police and later investigated by the FBI’s New Orleans Field Division, DEA-OPR and DOJ-OIG. Acting Deputy Chief Charles Miracle of the Criminal Division’s Narcotic and Dangerous Drug Section and Trial Attorney Timothy Duree of the Criminal Division’s Fraud Section are prosecuting the case.
