You made a lot of valid points, but I believe at a minimum, the cops would have deescalated the situation enough to where both Kyle and Chad would have woke up the next morning. Even if he didn't get his kids that day, I'm pretty certain that Kyle wouldn't have killed Chad had the cops been there.
Although this is cac on cac crime, folks need to remember that precedence is being set and outcomes of these cases can be used to affect the outcomes of those after it. If they can easily do this to each other, what do you think will happen when we're involved...
In my opinion, both parties were at fault here, the perfect storm of emotion, ego, and aggression. As a father, I can understand the frustration (especially given the circumstances - his kids mom being and staying with and having his kids around a still legally married man). Once he went inside to get the hammer and I don't have mine, I personally would remember that I'm not from Krypton.
If I read an article correctly, Kyle is a second amendment Coalition leader and was probably waiting for this opportunity. Much to be seen here, but I'll sit on the fence watching how this one plays out. My guess is no criminal charges.

The father was trying to obtain his property which was his son. Instead got killed from a man that’s dealing with a side bitch kids.
In cases involving weapon use, a jury will need to determine the need for the deadly force in that instance. In other words, was shooting the other party really necessary or warranted? Texas juries have a three-step process that they will use when looking at such cases:
BASED ON THIS, THAT WHITE BOY WITH THE GUN IS GETTING OFF especially if the son wasn't there. He could say that he was scared that the dad was gonna grab the gun and shoot them all. In my opinion.
- After reviewing the Texas legislation that discusses the use of deadly force, the jury must find that you were justified in using this level of force to stop the trespasser, thief, or attempted murderer.
- The jury must decide that you had reasonable belief to think that deadly force was immediately necessary to stop the individual from fleeing the scene with your property in hand or to protect yourself against the individual.
- The jury must agree that when you used deadly force, you believed that you had no other means to protect your property from being taken or protect yourself and that using less force would have led to risks of your own death or serious injuries.
Can’t see it even with these laws.. First one deadly force wasn’t necessary for a gray haired elderly out of shape looking man. You probably could’ve whoop his ass. But this was premeditated, that’s why you ran back in the house.
He been waiting for this moment, his life was only endanger when he grab the gun. Even after he grab the gun, he didn’t even attempt to take it from you. The father still wasn’t fearful of his life or there would’ve been a big tussle for the gun.Nor did he charge you after he step back and fired a warning shot.
Even after the kill shot you didn’t even call the police or ambulance. Didn’t show one sign of emotion or empathy for the sons father that you took away from the kid. Hard to consider trespassing when there was a court order agreement saying the Father was scheduled to pick up the minor child from this residence.
Can’t wait to hear the verdict if he gets off is because of his connections with the courts. Not because the shooting was justified. I don’t think this was there first altercation either but it damn sure is their last!
This was one of those situations where the guy was just looking for a reason to shoot someone. That was a battle that could have been had face-to-face, fist to fist man-to-man but he had to bring a gun to it.Some folks with guns look for any reason to shoot someone.....I hear them talking all the time about how they could get away with it.
That woman is unintentionally cursed for life. She got her kids' father killed just like that.

That man was blinded by rage (somewhat understandable bc his kid was involved), pride (can't let another man stand between you and ur son), and contempt for his ex wife (gonna play games with the kids just to be difficult...bitch ass shit).
