You made a lot of valid points, but I believe at a minimum, the cops would have deescalated the situation enough to where both Kyle and Chad would have woke up the next morning. Even if he didn't get his kids that day, I'm pretty certain that Kyle wouldn't have killed Chad had the cops been there.

Although this is cac on cac crime, folks need to remember that precedence is being set and outcomes of these cases can be used to affect the outcomes of those after it. If they can easily do this to each other, what do you think will happen when we're involved...

In my opinion, both parties were at fault here, the perfect storm of emotion, ego, and aggression. As a father, I can understand the frustration (especially given the circumstances - his kids mom being and staying with and having his kids around a still legally married man). Once he went inside to get the hammer and I don't have mine, I personally would remember that I'm not from Krypton.

If I read an article correctly, Kyle is a second amendment Coalition leader and was probably waiting for this opportunity. Much to be seen here, but I'll sit on the fence watching how this one plays out. My guess is no criminal charges.

I agree if the cops would’ve came out. He would still be living today.

The father was trying to obtain his property which was his son. Instead got killed from a man that’s dealing with a side bitch kids.

In cases involving weapon use, a jury will need to determine the need for the deadly force in that instance. In other words, was shooting the other party really necessary or warranted? Texas juries have a three-step process that they will use when looking at such cases:
  1. After reviewing the Texas legislation that discusses the use of deadly force, the jury must find that you were justified in using this level of force to stop the trespasser, thief, or attempted murderer.
  2. The jury must decide that you had reasonable belief to think that deadly force was immediately necessary to stop the individual from fleeing the scene with your property in hand or to protect yourself against the individual.
  3. The jury must agree that when you used deadly force, you believed that you had no other means to protect your property from being taken or protect yourself and that using less force would have led to risks of your own death or serious injuries.
BASED ON THIS, THAT WHITE BOY WITH THE GUN IS GETTING OFF especially if the son wasn't there. He could say that he was scared that the dad was gonna grab the gun and shoot them all. In my opinion.

Can’t wait to hear the verdict if he gets off is because of his connections with the courts. Not because the shooting was justified. I don’t think this was there first altercation either but it damn sure is their last!

I think a halfway decent lawyer, the shooter and his family can easily craft a story that can justify the need for deadly force. We will see. The law doesn't say that you need to tussle with someone before you decide to shoot them.

This was one of those situations where the guy was just looking for a reason to shoot someone. That was a battle that could have been had face-to-face, fist to fist man-to-man but he had to bring a gun to it.

If the other guy isn't armed then why are you armed? It's not like there was some gigantic size difference like the guy was 6'8" 360 lb

But doesn't the other guy have to pose a threat in order to use deadly force? I don't think he did and the other guy could have just notified the police to remove him from his property. If this was the case, any one soliciting or knocking on your door would be considered a threat.

Jennifer Read and her attorney Matthew Harris spoke to ABC’s Good Morning America and explained why she released the video.

“It had been three weeks — nothing had been done. And I felt like the public needed to know. And I feel like Chad deserves justice,” she said.

Jennifer also explained that she initially thought the gun Kyle grabbed was a stun gun.

“I thought it was like a stun gun or a Taser gun or something like [that],” she told GMA. “Who’s going to bring out – they’re having a discussion about a custody thing. There’s no physical altercations. Who’s gonna bring a gun out? What? Why?”

Jennifer Read filed a lawsuit against Kyle Carruth and his businesses for wrongful death. The lawsuit asked for $50 million.

The lawsuit claimed Kyle “interjected himself into the conversation” after Chad’s ex-wife, Christina Read, refused to tell Chad where his son was.

The lawsuit also said Kyle was neither standing his ground nor acting in self-defense.

“Kyle Carruth was the aggressor, who needlessly escalated an otherwise nonviolent situation, leading to the wrongful death of Chad Wayne Read,” the lawsuit said.

Later that day, State District Judge for the 237th District Court, Les Hatch, recused himself from presiding over Jennifer Read’s civil lawsuit.

Jinx Read, Chad’s mother, as well as his three children, filed a lawsuit against Kyle Carruth and his businesses. The lawsuit accused Kyle of negligence for several things, including using deadly force when not justified, discharging a firearm “merely to threaten an individual,” failing to call authorities and failing to render aid.

Court records said Chad’s mother and children have “suffered mental and emotional anguish, including mental and emotional pain, torment and suffering, ultimately resulting from the death of a loving father and son and will continue to suffer such in the future.”

The lawsuit seeks punitive damages.

Texas Attorney General Ken Paxton released a statement and said his office “has begun” a criminal investigation into the shooting death. The statement also said the AG’s Office would not comment on the case to protect its integrity. :roflmao:

“Our office has begun a criminal investigation into this shooting. During the pendency of any criminal investigation conducted by our office, we do not comment on the case to protect the integrity of the investigation,” the statement said. “Accordingly, we will not be commenting on the facts of this case.”

The shooter’s then-wife was circuit court judge……have to assume that helped him beat a murder charge.

This is old, regardless of the situation, he took that boy's biological father away from him. And he will never forgive him for it. That man just wanted to see his son. It's sad. And after that situation that boy probably won't want to live in that house with that guy. The kids at school will tell him about it and probably show him, there is no hiding. In other words that house will not ever be happy.
