Cops catch bikers on pre-Halloween terror run
biker-two-shot.jpg

One of the 50 motorcycles and one of the bikers involved in the rampage lies “grounded” in Deer Park.

A gang of 50 bikers in Halloween costumes terrorized drivers across at least four Suffolk County towns Sunday, in the latest case of motorcycle madness.

The cyclists cut off other motorists, swarmed on sidewalks and even smashed into a police car in Brentwood.

There were three arrests, but, luckily, no one was hurt.

“It’s crazy that they did this after what happened in the city,” said Suffolk Police Sgt. Rocco Baudo.

“You think they would have been smarter.”

The Long Island bikers, many sporting skeleton masks and hoodies, sped through residential areas in Brentwood, Islip, Bay Shore an Deer Park at around 3:30 p.m.

They also disrupted traffic on busy Sunrise Highway.

The biker accused of hitting the police car was identified as Matthew Valentine, of East Quogue. He and two of his pals were busted for reckless driving.

At least 30 others got tickets.

Michelle Able, 31, of Islip, said the pack of bikers came flying down her block “buzzing like bees.”

“It could have been a very dangerous situation,’’ she said. “I’m glad the cops stopped them.’’

Jason Tunbull, who also lives in Islip, said the bikers “were acting pretty foolish, doing wheelies and getting in the way.”

“It’s just not safe the way they drive around.’’

One of the bikers, who asked not to be identified, whined, “We’ve been doing this for years.

“We were just having fun. We weren’t hurting anyone. Bikers get profiled now after what happened in New York. It’s not fair.”

Baudo said that several frightened motorists reported the gang.

“Everybody’s on edge after what happened in the city and on the LIE,’’ he said.

He was referring to a ride on the Long Island Expressway Oct. 14, when a gang of bikers sped along the highway, weaving around terrified motorists while committing almost every traffic violation in the book.

Seven bikers were busted in that case.

In the notorious Manhattan incident, a pack of “Hollywood Stuntz” motorcyclists dragged a driver out of his Range Rover and beat him in front of his wife and toddler daughter just off the West Side Highway on Sept. 29.

It was later learned that at least three off-duty cops, including an undercover officer, had been part of the gang. Nine people have been busted.

Those bikers attacked Alexian Lien — after he had desperately pulled off at an exit — because he had accidentally struck one of them with his SUV while attempting to flee in fear for his family.

The biker he hit, Edwin Mieses, suffered injuries that might leave him paralyzed.

Observer 4 minutes ago

First of all, three arrests and a few tickets, while far better than the stunningly lousy job done by the NYPD with the "Hollywood Stuntz" thugs, does not go far enough. There should be confiscation of the motorcycles and license suspensions for starters, to keep these mongrels off the roads. The days of these sociopaths going berserk on public roads, at great risk to the public, are long over.

This article also refers to that scu#bag who ran over a biker and caused serious, life-threatening injuries while trying to get away after an accident where he hit another biker BECAUSE " HE WAS IN FEAR FOR HIS LIFE AND HIS FAMILY'S LIFE " and had to commit a felony -BUT HE DIDN'T MEAN IT. What bulls#hit. There was plenty of fault on both sides. WHERE WERE THE POLICE WHEN THAT INCIDENT OCCURRED ?????

This last episode with the halloween costumes is stupid and the insurance companies insuring these bikers should revoke their insurance policies and the State DMV should pull their license plates. That would stop all this b.s.

@george scott did you watch the video? Bikers clearly caused the "accident" on purpose. A tactic done frequently to get the driver to stop and extort money from the people in the car. Thugs surround vehicle and threaten to do damage unless they get money. Word to the wise: I will ACCELERATE my vehicle through any biker who brakes like he thug in the video. Maintaining speed is my only defense.. Just "dinging a dirtbag at a speed over 30 mph makes him road kill. I can't wait for paralyzed guy to wake up to finally realize how he is now screwed for life. Where were cops? A good question..

I am a biker and I use the term biker becaue it is what I am. I ride a Harley, I do Toy Run's, Breast Cancer Runs, Wounded Warrior Runs, Bikes for Babies, ride for the MDA, St.Jude's and whatever other event that raises money for charity, I ride with many other like minded bikers who get out and enjoy the road and the good that we can do for adults and children, When the media decides to put all in the same category and call these idiots bikers, it is pretty demeaning to us. How about actually funding an event where bikers gather to do good and try reporting on that. I wil bet you my next three paychecks that you will see the difference between a biker and a hoodlum. Try it, you may have your eyes opened.

@Carl Mac agreed. Bikers seem to feel the roads are their private playground. Let's also not forget that paralyzed guy had NO license, NO insurance, NO right to be driving a bike; his license was revoked for several more years. Playing with fire gets people burned... I have no pity for the bikers. I do feel badly for the guy in the SUV who was beaten by a group of gutless cowards playing cowboy.

The guy and his pals have no concern for safety of others and apparently have no idea the roads are not their private playgrounds. "Not fair"? I agree. It isn't fair that people minding their own business have to deal with these hooligans. Screw them. Let's keep arresting these thugs. Put them in jail. Confiscate their motorcycles. Publish their pictures, names, addresses, and places of employment. The mentality expressed in the words of the gutless biker afraid to identify himself reflect the attitude of these bozos.

7 motorcyclists arrested on reckless driving charges, dozens cited, say Suffolk cops
image.JPG

Suffolk police said Sunday they put the brakes on a pack of motorcyclists speeding and weaving through traffic in at least three South Shore communities, arresting seven bikers and ticketing dozens more.

The incident comes amid a law enforcement crackdown on Long Island that began about a week ago after two notable motorcycle cases: the Oct. 14 arrest of seven bikers police said were speeding and driving recklessly on the Long Island Expressway and the Sept. 29 road rage incident in which, police said, a pack of motorcyclists chased down and beat an SUV driver on the Henry Hudson Parkway in Manhattan.

on Sunday, seven motorcyclists were charged with driving recklessly, and 36 others who police suspect were part of a large pack of bikers speeded and harassed drivers through Islip, Bay Shore and Deer Park.

Police received a call at 3:22 p.m. reporting a "disturbance involving motorcycles" on Deer Park Avenue, they said.

Several riders -- some on motorcycles and others on four-wheel motorcycles known as quads -- were speeding and weaving in and out of traffic on several busy roads, including Pine Aire Drive, Udall Road and Sunrise Highway, Third Precinct Sgt. Rocco Baudo said.

The seven motorcyclists arrested on reckless driving charges included Samuel Morales, 19, and Tikret Cekic, 23, both of Brooklyn, and Matthew Valentino, 25, of East Quogue. Joel Hernandez, 19, of Brentwood, was arrested after police said he backed into a police vehicle. The officers were not injured.

Jason Coleman, 29, of Yonkers was charged with leaving the scene of accident after he made an illegal U-turn that resulted in a car crash, police said, and Thomas Palacios, 35, of Bay Shore, who was driving an all-terrain vehicle, was charged with driving under the influence.

One passenger, whom police did not identify, was charged with obstructing governmental administration after a police officer ordered her to stop and she attempted to flee.

"You would think after what happened in the city, they'd be smarter about it," said Baudo, who explained that motorists reported the motorcyclists driving recklessly. "Everybody's on edge after what happened in the city and on the LIE."

Four motorcycles and an ATV were impounded, police said.

Police found the larger group riding motorcycles behind a Suffolk County Department of Social Services building on South Second Street in Bay Shore, he said. Those 36 people were issued field appearance tickets citing them with trespassing, he said. Parking

NYPD hunting 4 more bikers in SUV attack

biker12.jpg

The NYPD is pulling out all the stops to hunt down four more bikers in the now infamous attack on the father who was out for a Sunday drive with his family in upper Manhattan, law enforcement sources told The Post.

Detectives have spent countless hours poring over video to single out the unidentified thugs and have called in experts to pinpoint the exact makes and models of the motorcycles they were seen riding in the Sept. 29 beat down of an Internet executive in Washington Heights, sources said.

Investigators then cross referenced the bikes with the same types of motorcycles owned by a multitude of people throughout the New York area, sources said.

Three of the bikes are so common that there are approximately three hundred registered owners for each motorcycle, the sources said.

Cops are in the early stages of following up on the long list of potential suspects.

“They are in the beginning stages of going to every address to see what they can learn,” said one law enforcement source.

The 33-year-old exec, Alexian Lien, was first surrounded by the biker mob as he was driving his wife and young girl in their black Ranger Rover near 125th Street in Harlem on the afternoon of Sept. 29.

During an ensuing confrontation, the bikers smashed the SUV with their helmets, denting the frame. They also slashed his tires with a knife.

Lien peeled away, running over several bikers, one of whom was critically injured.

A swarm of angry motorcyclists chased Lien for more than 50 blocks northbound on the West Side Highway.

Due to his badly damaged tires, Lien was forced to exit at 178th Street, where the assailants stopped his SUV, ripped him out of the driver’s seat and savagely beat him in front of his terrified family.

In total, nine bikers have been arrested on various charges, including ringleader and career criminal Reginald Chance, 37.

Several cops were among the dozens of bikers who took part in the rally that kicked off in Brooklyn.

But only one – undercover detective Wojciech Braszczok, 32 — was charged in connection with the assault.

A veteran undercover cop busted in a motorcycle mob attack has been indicted for gang assault and other serious felonies by a Manhattan grand jury, the Daily News has learned.

NYPD Detective Wojciech Braszczok, who faces up to 25 years behind bars if convicted on the top counts, is one of 11 bikers formally charged in a 14-count indictment over the Sept. 29 attack on Range Rover driver Alexian Lien that went viral when footage of the beatdown taken from a helmet-mounted camera was posted online.

Braszczok, 32, who was deep undercover during the height of the Occupy Wall Street movement, is free on a $150,000 bail bond.

The detective’s attorney, John Arlia, declined to comment on the development when reached by phone Friday.

The embattled cop will be presented with the indictment at a Nov. 20 arraignment in Manhattan Supreme Court. He also faces assault, coercion, riot and criminal mischief.

All bikers but one — Christopher Cruz — face gang assault charges and the possibility of decades in prison.

Cruz — who was seen on the video getting rear-ended by Lien and is accused of stopping short in traffic on purpose — faces felony level criminal mischief and up to four years in prison.

Also included in the indictment is Allen Edwards, who told cops he was trying to stop the attack. He has been cooperating since shortly after the incident, said his attorney John Carney.

He “was the voice of reason and was the most reasonable, courageous person there, to stand up to these people who he’s not friends with. He doesn’t know these bikers.”

Lien was chased up the West Side Highway and was pulled out of his car on W. 178th St. as his wife watched in horror with their young child in the back seat.

Critics say Lien needlessly mowed down one of the bikers, nearly killing him, and should be charged.

The Manhattan district attorney’s office declined to comment.

Gone are the stitches Lien sported on his right cheek and the multicolored bruises that riddled his face — both graphic reminders of the beating he took at the hands of an out-of-control motorcycle mob out to make him pay.

Lien became the target of the brutal bikers when he struck one who cut him off on the Henry Hudson Parkway, triggering a wild 4-mile chase, cops said.

Biker mob targeted wife of beatdown victim during attack: prosecutors

Prosecutors revealed Wednesday that a pair of bikers threated horrified wife Rosalyn Lien and tried to pull her out of the family's Range Rover during the brutal beatdown of her husband, Alexian Lien. The revelations come as five members of a motorcycle swarm were arraigned on charges of chasing Alexian Lien on the West Side Highway and then beating him bloody.

Prosecutors revealed Wednesday that the biker mob that attacked Alexian Lien (right), also threatened his wife, Rosalyn (left), and attempted to also pull her from the family's SUV.

"You're going to get it too."

That was the spine-chilling warning a pair of bikers gave a Manhattan woman as her husband was being pummeled by a vicious motorcycle mob after a chase on the West Side Highway, prosecutors revealed Wednesday.

Prosecutor Joshua Steinglass made his comments as five members of a motorcycle swarm were arraigned on charges they chased an SUV for four miles before dragging Alexian Lien out of the car and beating him bloody. Steinglass said Robert Sims and Jason Brown then tried to pull horrified wife Rosalyn Lien out of the family's Range Rover as well, as their two-year-old daughter was in the back seat.

The gang caught up to them four miles later, again surrounded the SUV, and using their helmets to bust the windows and snatch the dad out of the car.

Biker gang that beat dad in Washington Heights likely facing lesser charges

The 11 members of the biker gang that chased down Alexian Lien on the Westside Highway in September will likely face downgraded charges when they next appear in court because the victim's facial injuries are not as severe as initially feared, prosecutors said Friday.

court-wojciech-braszczok-bikers.jpg

Wojciech Braszczok, flanked by his lawyers, was offered a plea deal of three years in jail for his role in the beatdown.

Charges against members of the biker crew — including an undercover detective — that allegedly chased down and attacked a driver will likely be reduced because the victim’s facial injuries are not as serious as initially feared, prosecutors said Friday.

"It's likely that on the next [court date]we're going to move to reduce the top charges" from first-degree assault and gang assault to attempted assault and attempted gang assault, Assistant District Attorney Joshua Steinglass said Friday in Manhattan Supreme Court .

"The reason for that is the victim's facial wounds look to be healing in a way that, fortunately, would not constitute permanent disfigurement under the law," Steinglass added.

The move would mean all but one of the 11 indicted bikers would now face up to 15 years in prison, instead of 25.

Alexian Lien’s facial injuries are healing and don’t appear to be permanent, prosecutors said Friday.

Prosecutors also offered plea deals to the 11 indicted motorcyclists, including NYPD Det. Wojciech Braszczok — who allegedly took part in the beatdown and waited days before reporting his involvement to his bosses.

Braszczok was offered three years in prison plus three years of post-release monitoring. He covered up his face and declined to comment as he left court.

Prosecutors suggested six months jail and six months probation in exchange for a plea from Christopher Cruz, the rider who allegedly sparked the incident by slowing down to get struck by Alexian Lien's Range Rover on the West Side Highway on Sept. 29.

That led the mob to chase Lien after he struck biker Edwin Mieses while fleeing from a group of riders surrounding his car.

Cruz was the only biker not hit with the top indictment counts because he was not at the scene of the attack.

The bikers followed Lien — who was with his wife and 2-year-old daughter — to W. 178th St. in Washington Heights, where he was pulled from his vehicle and beaten.

Bikers also allegedly threatened Lien’s wife, Rosalyn, and told her, “You're going to get it too.”

None of the offers were immediately accepted.

"I believe the answer is unequivocally no - we're not accepting the officer," said Raymond Colon, the attorney for Clint Caldwell. They maintain he was at the scene of the beatdown but did not participate in any fashion.

John Carney, who represents Allen Edwards, said his client is "seriously considering" an offer of 60 days jail plus five years of supervision after he's sprung.

Their cases were adjourned to late February.

Alexian Lien said nothing Saturday as he left his Manhattan home with his young daughter, who witnessed him being brutally beaten in the violent Sept. 29 attack.

Prosecutors said Friday they would lessen charges against 10 bikers involved in the senseless assault — because Lien is healing so well.

Bundled in a black winter coat and hat, Lien walked a short distance carrying two bags, one with a princess doll sticking out, as he and his daughter left the family’s Financial District building.

He ignored questions about the legal development before heading back into his home.

Lien was hauled out of his Range Rover and pummeled in front of his family on West 178th Street in the terrifying videotaped incident, which unfolded after Lien’s SUV bumped one of the bikers. The group swarmed the family car on the West Side Highway. Lien ran over one of the motorcyclists as he fled, causing serious injuries and prompting the bikers to chase him for 50 blocks.

Originally facing first-degree gang assault charges that could have landed them sentences of 25 years behind bars, the suspects could get only 15 years if convicted.

VIDEO: Gang of rowdy bikers stops traffic in Washington Heights AGAIN — and it's near same spot as dad's violent beatdown

A newly emerged video shows a group of motorcyclists and ATV riders stopping traffic in front of the R.G. Ortiz Funeral Home near W. 190th St. as they ride in circles and pop wheelies. The incident took place about a dozen blocks from where Alexian Lien was pulled from his SUV in September during a biker gang attack.

New video shows a group of bikers in Washington Heights holding up traffic as they ride in circles and pop wheelies in front of R.G. Ortiz Funeral Home near W. 190th St.

Mayor de Blasio pledged there would be “serious consequences” for those who engage in motorcycle mayhem after video emerged of a large group of bikers and ATV riders invading a city street on Sunday.

The rowdy riders, about 15 in all, created a traffic nightmare as they spun dangerously and popped wheelies outside of the R.G. Ortiz Funeral Home on Broadway near W. 190th St. in Washington Heights. Motorists, fearful and angry over the stunt, honked their horns, according to video uploaded to YouTube.

Jon-Marc McDonald, 37, a freelance publicist who lives on Broadway between 189th St. and 190th St., said he watched about 20 to 25 bikers causing a ruckus for around 10 or 15 minutes.

“They’re stopping traffic,” said McDonald. “They know no one is going to do anything because everyone is afraid of them.”

'They know no one is going to do anything because everyone is afraid of them,' said Jon-Marc McDonald, a Washington Heights resident who recorded the scene.

He said the bikers regularly swarmed in the same spot all summer, but stopped after the Lien beating. Then, they returned one day in December and then again Sunday.

"I'm angry,” he said. “We're all victims when they play their little games on the road."

"I hope the video shows how terrorizing it is,” he said. “I hope people take notice."

A worker at the funeral home said the bikers where there to honor a friend who was being laid to rest.

The traffic snarl took place about a dozen blocks away from where Alexian Lien was pulled from his SUV and beaten by bikers in September. Here, a recording from September's incident.

One witness said the bikers dispersed after a cop car approached but that there was no pursuit.

The scene was about a dozen blocks from where, in September, members of a horde of bikers pulled Alexian Lien, 33, of Manhattan, from his SUV following a miles-long chase and assaulted him in front of his family in September.

Multiple arrests were made.

De Blasio said his administration will crack down on rampaging bikers. “I think we’re going to be able to do a lot with the police,” he said.

“As I said a few months ago for the first time, we are going to be aggressive in reaching out to the organizations and making very clear that illegal activity will not be tolerated and there will be very serious consequences.”

The NYPD said no formal complaints were filed regarding Sunday’s incident.

“We are aware of the video, but not sure of its origin," the NYPD said in a statement. "There have been no formal complaints with the police. However, the precinct commander will monitor the situation."

Lien was out for a Sunday drive with his wife and 2-year-old when they were suddenly surrounded by bikers on the Henry Hudson Parkway.

A video that surfaced on YouTube days after the attack shows the trouble started when biker Christopher Cruz, 28, of Passaic, N.J., pulled in front of Lien’s luxury SUV and was struck.

Lien immediately stopped but then hit the gas in fear as the angry mob approached his car. Lien ran over and severely injured motorcyclist Edwin Mieses Jr., 32, triggering a 4-mile chase that was capped by his beating.

Injuries to dad beaten by biker gang not healing as well as previously hoped, prosecutors maintain gang assault charges against defendants

Alexian Lien's facial injuries are not healing as well as prosecutors thought in December, when they announced they would likely downgrade charges against 11 suspects accused of yanking him from his SUV and beating him in front of his wife and 2-year-old daughter.

Not so fast, detective.

In a reversal, prosecutors said Thursday that charges against the undercover NYPD detective accused of taking part in the biker beatdown of a Manhattan dad are not going to be downgraded.

Manhattan Assistant District Attorney Joshua Steinglass had said in December that the first-degree assault and gang charges against Wojciech Braszczok and his fellow bikers were likely to be reduced because Alexian Lien's facial wounds were not as serious as initially feared.

Alexian Lien’s injuries are not healing as well as previously hoped, leading prosecutors to maintain gang assault charges against the defendants.

But Steinglass said recent medical tests suggested otherwise.

"Unfortunately, it appears the victim's injuries have not healed as well as we initially believed they would so we're not [GOING]to reduce the charges at this time," Steinglass told Manhattan Supreme Court Justice Maxwell Wiley.

All but one of the 11 defendants still face 25 years in prison, rather than 15 that would have come with downgraded charges.

Video of the vicious assault in September led to 11 suspects from the biker gang getting arrested.

Steinglass also asked for an order of protection for the 33-year-old Lien, which Wiley granted.

Braszczok's lawyer declined to comment after the brief hearing.

Prosecutors say an off-duty Braszczok, 32, was among a horde of bikers that chased Lien's Range Rover along the West Side Highway last September. After pulling Lien from the car, a group of bikers viciously beat him.

The brutal attack was caught on video. Lien's wife, Roslyn Ng, and their 2-year-old daughter, were also in the SUV when the bikers pounced.

The Liens are planning to sue the city.

NYPD's biker bust leads to multiple arrests, confiscated dirt bikes and ATVs

Nearly six months after Alexian Lien and his family were chased and he was beaten by a group of bikers, the NYPD was on patrol in upper Manhattan, with officers instructed not to engage in chases with those riding illegal dirt bikes and ATVs on the road or the sidewalk. A handful of arrests were made and ‘an awful lot of bikes’ were confiscated by police

They’re baaaaack. But this time the roughshod riders who swarm the streets of northern Manhattan on warm days are drawing some heat of their own.

Three men were arrested, and eight dirt bikes and all-terrain vehicles were confiscated in a biker crackdown on the ubiquitous reckless riders Saturday, cops said.

Officers, who were instructed not to engage in chases, observed both large and small packs of the off-road machines being driven on the street illegally, cops said.

At 5:20 p.m., cops on foot patrol tried to stop a cyclist riding along Second Ave. in East Harlem, but he dropped his dirt bike and fled on foot.

NEW YORK (WABC) --
Eyewitness News has exclusively obtained dramatic video and pictures never before seen of that vicious motorcycle gang attack on the West Side Highway.

There are also new pictures of the victims in their SUV, a father and his family.

The assailants were in court Friday. The pictures are disturbing.

This is the battered torso of Alexian Lien. There are two long gashes and about a half dozen stitches.

Those are the injuries he received within seconds of being pulled out of his SUV in September 2013, seen in exclusive video obtained by Eyewitness News.

We're now getting a closer look at exactly what happened to him in these photos, also exclusively obtained by Eyewitness News.

He has two black eyes, stiches in his right cheek, and severe bruising. There's even a picture of the tiny little hand of his then two-year-old daughter, being examined for injuries.

In this never before seen video, you see some of the motorcyclists racing up the west side highway just minutes before the assault.

If you look closely, the unidentified bikers run through one, two, three red lights, and speeding past stopped cars.

And who could forget this video of frustrated Alexian Lien tapping the bumper of Christopher Cruz, later speeding off, and running over another biker.

It led to the gang assault, with Lien lying face down unconscious.

The exclusives pictures show more of the aftermath, including the shattered glass on the floor of his Range Rover, next to a child's life vest.

Most of the bikers were in court on Friday, and they have until January 28th to accept any plea deal they have been offered. The case may finally go to trial in the spring.

The biker whose collision with a Range Rover-driving Tribeca dad sparked a Manhattan highway chase and a beating caught on video pleaded guilty to a pair of felonies Wednesday.

Christopher Cruz, who played a minor role in the incident and was never accused of actually beating motorist Alexian Lien, pleaded guilty to assault and riot charges in exchange for four months behind bars and five years of probation.

Prosecutors said Cruz, 29, deliberately slowed his motorcycle to cause Lien to rear-end him during a massive Sept. 29, 2013, ride north on the West Side Highway.

Shortly after Cruz was struck, Lien ran over Edwin Mieses Jr., one of the bikers, but was never arrested after claiming he charged through the crowd because the riders were ganging up on him.

Lien was chased uptown to W. 178th St. and St. Nicholas Ave., where he was pulled out of the car and pummeled.

Alexian Lien (r.) was chased through Manhattan with is wife, Rosalyn (l.), and young daughter in the vehicle by a biker gang after he hit and ran over some of the group.
Charges are still pending against suspended undercover NYPD Det. Wojciech Braszczok, who was one of 11 riders charged. All but Cruz were charged with gang assault, which carries up to 25 years behind bars. Cruz faced up to seven years on felony assault.

Co-defendants Allen Edwards and Edwin Rodriguez pleaded guilty to second-degree assault earlier this month but got five years’ probation without jail time.

NEW YORK (WABC) --
An undercover detective who police say took part in a gang attack on an SUV driver in Manhattan went on trial before a judge Monday.

Detective Wojciech Braszczok faces top-level assault charges in the September 2013 attack on an SUV driver.

He is one of 11 men charged in the assault.

The suspects are accused of beating the driver of an SUV after an altercation on the West Side Highway.

The NYPD officer was off-duty at the time, and has been suspended. He is going to trial with another suspect, Robert Sims.

Assistant District Attorney Josh Steinglass said Monday that Braszczok and a co-defendant took part in the violence because the victim wouldn't yield to "hordes of bikers."

Defense attorney John Arlia says his client was acting as a policeman who had just seen an SUV crush a biker. He says his client did not go on the attack.

A judge, not a jury, will determine whether he is guilty or innocent.

The driver was beaten and received stitches. He wasn't charged.

At least three of the men have pleaded guilty, and others are headed for trial.

NEW YORK (PIX11) — With his head covered, undercover NYPD Detective Wojciech Braszczok said nothing to reporters outside of a New York Supreme Court. The trial against him and another biker, Robert Sims, began Monday morning as both face assault charges relating to a now infamous viral video.

The video shows dozens and dozens of bikers swarming the West Side of Manhattan as they take over the roads and eventually allegedly antagonize Alexian Lien and his family.

For the first time Lien spoke out publicly in a courtroom. He admitted his wife threw a half eaten plum and bottle of water at the bikers out of frustration, but said she never made contact.

Lien was pensive, as he described feeling scared and threatened for his family. His small daughter was in the back seat.

When video showing Lien drive over one biker, Lien choked up as he tearfully described being surrounded by bikers and feeling them kick his SUV. At one point he said a biker came right next to his drivers side window, which is when he repeatedly he asked his wife what to do. She responded, according to Lien, to just go and when he did he said he knew he hit someone.

This case will not be heard by a jury, but instead by Judge Maxwell Wiley.

Attorney Luther Williams representing Sims told our cameras it was a decision he was not entirely comfortable with.

“I’ve only done two non juries in my 37 years, so I’m a little bit uncomfortable with it myself however I do have a young man who will take the lead in that,” said Williams.

Each altercation described as scene 1, scene 2 and scene 3 was shown one at a time. Scene 3 ended with Lien describing how his driver’s side window was smashed open, he was pulled out and beaten.

The judge was shown images showing the brutality of the attack, including Lien’s bloodied face and bruised body and also minor injuries suffered by his wife and toddler daughter.

Lien’s testimony was cross examined by both defense attorneys, during which both questioned whether Lien was instead the antagonizer.

Lien also admitted he is still considering lawsuit against the city.

Court will reconvene Tuesday morning at 10 a.m.

Clearly the bikers are in the wrong and should be punished. However, the situation probably could have been avoided if that bitch of a wife didn't think she could get away with throwing food and garbage at the bikers. In what world is that the right move in a situation where you're surrounded by dozens of "scary" bikers and you're clearly not able to go toe to toe with even one of them if necessary? Dude's wife did the typical loud mouth woman thing and painted a target on her husband's back. I feel a little less sorry for dude getting beat on after learning such an important detail, which the media did a superb job of keeping out of the story.

Eight people died at the scene at the Twin Peaks restaurant and one at the hospital, in killings Waco Police Sgt. Patrick Swanton characterized as capital murder "because of the number of victims that were killed in one episode here."
Eighteen people were taken from the scene to hospitals, mostly for gunshot and stab wounds, Swanton said at a news conference. Everyone involved was a gang member, police said.
