K.I.D.S. was a mixtape sold for free, it wasn't retail so why would he legally need to clear a sample? If Mac did not blow then Finesse wouldn't even bat an eye. I don't see the lawsuit? :confused:

Isn't this an issue of who owns the master to Lord Finesse's song? If he own's them, it doesn't matter that he sampled in the composition. He may have a case. If MM had just remade the song using the original sample and his own drums there wouldn't be an issue.

But, the minute you "sample" directly from someone's master recording you are liable. (Ironic aint it?)

If you sample "I get money" from The Audio Two's Top Billin', you have to deal with them. But if you sample that exact phrase from 50 Cent's I Get Money, you have to deal with 50.

You cannot put someone's commercial master on yours.

so you don't see the difference in sampling and just hopping on instrumentals?

I DO AGREE IF FINESSE COMES OUT A WINNER, THIS MIGHT EFFECT MIXTAPES AS A WHOLE.. BUT I REALLY DONT CARE, BECAUSE RAPPERS DROP A LOT OF TRASH ANYWAY.
 
It's not about YOUNG or OLD artists... It's about clearance... and if you don't get clearance... THEN DON'T DO IT... :smh:
If Mac didn't get clearance to use it... Then... OH WELL... He might be in trouble...
Regardless of what Lord Finesse got cleared when he made his song...
This isn't an issue Mac using the SAME SAMPLE... He used Finesse's SONG... so we'll see how this plays out... :popcorn::popcorn::popcorn:

theres a lot of gray area there, that was set by the original argument FOR sampling.

If taking a piece of an original composition, in many cases, 4 to 8 bars, adding drums and lyrics makes it a new song,

then rapping new lyrics, over the instrumental is indeed a new song.

If he didn't compose the first composition, then HE aint who should be suing.

In the case of Frank Ocean and the Eagles, I was all for the Eagles speaking on it, cuz it really was their composition.

but anyway...

stop wait i just listened to it and I'm sure this isn't the first time this track was used by someone else to gain notoriety and popularity. In essence, to benefit from it without a clearance. Now maybe the difference is the presentation of this as a full song with video but if they can find any other person or people who have done so then questions will have to be answered about why is mac miller being the one sued. interesting though, someone's lawyer said the wrong shit probably.

It's the main reason I don't listen to these new guys. It's not that they are unoriginal, it's the fact is they believe they are exceptional.

Mac Miller Dead of an Apparent Overdose

Mac Miller has died of an apparent overdose, per a report by TMZ. The 26-year-old rapper reportedly had trouble with substance abuse in the wake of his breakup from Ariana Grande, and was found on Friday.



Miller recently wrecked his G-Wagon and was subsequently arrested for a DUI after he fled the scene, eventually blowing two times the legal limit when police found him at his home.

After being arrested, Miller posted a $15,000 bail and was released early in the morning of May 17. His family has not yet commented on his death, nor have police confirmed that an overdose was the cause of his death
