b) the jokes are funny
For example, Bill Burr and Louis C.K. poke fun at black people and it’s not offensive because the jokes meet both criteria.
Dave’s gay jokes clearly met both criteria.

Generally, I think "making fun of" groups of people for immutable characteristics is wrong.
Sometimes comedians do it and it's funny. Bernie Mac's Kings of Comedy routine making fun of his sister's kids for mental disability and sexuality would be an example. It was hilarious but I'm not gonna say that shit was a good idea or honorable. I grew up on it and I can appreciate it but just because comedians like Seinfeld preach that funny outweighs everything, I don't have to take that perspective as a viewer or a grown man.
It's weird to dismiss any other aspect of the argument as bullshit but, at the core, I think making fun of gay people is weak (like I'd say of making fun of the mentally disabled).
