911 call of man who killed two burglars at neighbors house

I really can't say that I feel bad in the least for these two fucks. I mean if you break into someone's place you run the risk of getting your head blown off. No sympathy from me.

It's funny how people who are actively serving as an apologist for the shooter are labeling others apologists.

At any rate, I've noticed that the entire "They Deserved It" argument is based on 'what ifs.' What if the thieves had broken in when someone was there? What if they were armed rapists? What if you could turn shit into champagne? The fact of the matter is the shooter was a bloodthirsty cat who killed a couple of thieves that were armed only with his neighbor's television set. Any of you who believes that thieves deserve the death penalty are definitely living in the wrong country.

After reviewing a clearer copy of the audio tape I just realized that the 911 audio that was released to the public was highly edited. The 60 year old white man, was using the word "******R" over and over again, "I'm going to kill those ********!" and "I can't let those ******** just get away".

I knew the guy was racist (as I think most whites are but never want to admit), but the shooter was racist on a "Klu Klux Klan member level".

This now makes his whole/sole reason for shooting them based on their skin color alone.

Well here are the facts. They entered property that wasn't theirs for the purposes of robbery. They died in the process. If they never broke in, they would still be alive.

What can you take away from this? If you break into someone's home, expect that you may get killed in the process. Is that clear enough for you?

If you have audacity to rob someone you have to understand that you may lose your life in the process. What makes it worse is they pulling this stunt in one of the most pro-gun racist states in the nation. Does the punishment fit the crime, probably not. NEWSFLASH: Life isn't fair.

I agree with you here. But just because life isn't fair doesn't mean that someone should be let off the hook for gunning people down. Again, I'm not arguing that burglarizing someone's home isn't horrible and foolhardy. What I'm saying is that it shouldn't be an automatic death sentence. Actually, it seems like you might support my point of view on this.

No. They were leaving the scene of the crime. The cops were in the area (according to the operator). The old piece of shit told the 911 operator "They're leaving, i aint gonna let them get away". The operator told him "Stay in the house, dont go outside." He goes outside, gets their attention by yelling at them and the first things he says are "HEY, dont move. You're dead!".

Exactly. They were leaving. He yelled to them, they reacted (how exactly they reacted is unknown since two of the three actual witnesses are dead). Why is this so hard for you to understand? Seriously?

Also, it doesnt matter if they knew or didnt know that police were on the way. The murderer did. He was instructed not to instigate the situation but he did. This is textbook premeditated murder and i didnt even need to hear the "unedited" version to confirm as much.
 
Now that I think about this more. My problem is the fact that he killed these two men. It's the fact that he killed them and they werent breaking into his place. However I still cant find sympathy for these men that were killed.

HOUSTON — A man who told police he planned to kill two men he believed were burglarizing his neighbor's house shot them only when they came on his property and he felt threatened, his attorney said on Monday.

Tom Lambright, who represents Joe Horn of Pasadena, said his client was just going to take a look around when he went outside after hearing glass break at his neighbor's house. He had seen Miguel Antonio DeJesus, 38, and Diego Ortiz, 30, crawling into and then out of a window, Lambright said.

Horn went outside, armed with a 12-gauge shotgun, to see where the suspects were heading when he came face-to-face with them in Horn's front yard, Lambright said.

Horn is 61 and heavyset. The suspected burglars were young and strong enough to beat him to death with their bare hands, Lambright said. So when one or both of them "made lunging movements," Horn fired, Lambright said.

"He's trying to protect his own life," Lambright said. "He's scared."

Pasadena police were still compiling their report on the shooting and planned to present the case to Harris County prosecutors within the next two weeks, police spokesman Vance Mitchell said on Monday. From there it is expected to be presented to a grand jury. In the meantime, Horn remains uncharged.

Lambright's description is partly at odds with the 911 call in which a dispatcher urges Horn to stay inside his house and not risk lives.

"Don't go outside the house," the 911 operator pleaded. "You're gonna get yourself shot if you go outside that house with a gun. I don't care what you think."

"You wanna make a bet?" Horn answered. "I'm gonna kill 'em."

After the shooting, he re-dialed 911.

"I had no choice," he said, his voice shaking. "They came in the front yard with me, man. I had no choice. Get somebody over here quick."

Diamond Morgan, Diego Ortiz's wife and mother of their 8-month-old son, told TV station KTRK that she was stunned by Horn's comments on the 911 call.

"It's horrible," she said. "He was so eager, so eager to shoot."

But Horn "literally went to pieces" after the shooting, Lambright said. He issued a statement a few days later saying the events would weigh heavily on him for the rest of his life.

He's doing better, however, as he reads letters and e-mails and hears radio broadcasts of people supporting his actions, Lambright said.

"I'm not going to tell you that he still doesn't regret what had happened," Lambright said. "He just said, 'Tom, I had no choice. I had no choice.'

"He's right in that. He really did not."

Texas law allows people to use deadly force to protect themselves if it is reasonable to believe they could otherwise be killed. In limited circumstances, people also can use deadly force to protect their neighbor's property; for example, if a homeowner asks a neighbor to watch over his property while he's out of town.

The question will be whether it was reasonable for Horn to fear the men and whether his earlier threats on the 911 call showed he planned to kill them no matter what, said Fred Moss, who teaches criminal law at Southern Methodist University.

"That's what makes it so hard and that's why we have juries," Moss said.



They almost got it. They have at least acknowledged the right to protect the property of a neighbor, i.e. Deadly Force to Protect the Property of Another.

And, they have dropped that night time shit all together.

Looks like someone finally picked up a book before talking to the paper; but, they have a little more research to do.

For instance, the statute doesn't require that the neighbor ask you to look out for their property before deadly force can be used.

Also, his lawyer is still stuck on that self defense bullshit, when he needs to be focusing on Protecting the Property of Another.
