[td width="100%"]is amended by adding Section 33.031 to read as follows:[/td] [td width="100%"] Sec. 33.031. PURCHASE OF CERTAIN FOOD AND DRINK ITEMS[/td] [td width="100%"]PROHIBITED UNDER SUPPLEMENTAL NUTRITION ASSISTANCE PROGRAM. (a)[/td] [td width="100%"]In this section:[/td] [td width="100%"] (1) "Energy drink" means a beverage containing at[/td] [td width="100%"]least 65 milligrams of caffeine per 8 fluid ounces that is[/td] [td width="100%"]advertised as being specifically designed to provide metabolic[/td] [td width="100%"]stimulation or an increase to the consumer's mental or physical[/td] [td width="100%"]energy. The term does not include coffee or any substantially[/td] [td width="100%"]coffee-based beverage.[/td] [td width="100%"] (2) "Milk product" means a natural milk product[/td] [td width="100%"]regardless of animal source or butterfat content and regardless of[/td] [td width="100%"]whether reconstituted, including milk in liquid form, milk[/td] [td width="100%"]concentrate, and dehydrated milk.[/td] [td width="100%"] (3) "Sweetened beverage" means a nonalcoholic[/td] [td width="100%"]beverage to which a natural or artificial sweetener is added that is[/td] [td width="100%"]sold for human consumption, including a soft drink and other[/td] [td width="100%"]flavored beverages.[/td] [td width="100%"] (b) Except as provided by Subsection (c), a recipient of[/td] [td width="100%"]supplemental nutrition assistance program benefits may not use[/td] [td width="100%"]those benefits to purchase:[/td] [td width="100%"] (1) an energy drink;[/td] [td width="100%"] (2) a sweetened beverage;[/td] [td width="100%"] (3) a carbonated beverage;[/td] [td width="100%"] (4) candy ordinarily packaged and sold for consumption[/td] [td width="100%"]without further preparation;[/td] [td width="100%"] (5) potato or corn chips ordinarily packaged and sold[/td] [td width="100%"]for consumption without further preparation; or[/td] [td width="100%"] (6) cookies ordinarily packaged and sold for[/td] [td width="100%"]consumption without further preparation.[/td] [td width="100%"] (c) The prohibition under Subsection (b) does not apply to[/td] [td width="100%"]the purchase of:[/td] [td width="100%"] (1) a milk product or a product, other than an energy[/td] [td width="100%"]drink, containing milk or a milk protein;[/td] [td width="100%"] (2) a milk substitute, including soy milk, rice milk,[/td] [td width="100%"]or almond milk;[/td] [td width="100%"] (3) a beverage, other than an energy drink or[/td] [td width="100%"]carbonated beverage, in which the only added sweetener does not add[/td] [td width="100%"]calories to the beverage;[/td] [td width="100%"] (4) a beverage intended by the manufacturer for[/td] [td width="100%"]consumption by an infant that is commonly referred to as "infant[/td] [td width="100%"]formula";[/td] [td width="100%"] (5) a beverage, other than a carbonated beverage,[/td] [td width="100%"]intended by the manufacturer for use for weight reduction;[/td] [td width="100%"] (6) a fruit or vegetable juice, other than a[/td] [td width="100%"]carbonated beverage, to which no sugar has been added;[/td] [td width="100%"] (7) a beverage or other product, other than a[/td] [td width="100%"]carbonated beverage, intended for use as recommended by a health[/td] [td width="100%"]care professional, as defined by Section 247.067, Health and Safety[/td] [td width="100%"]Code;[/td] [td width="100%"] (8) a beverage or other product, other than a[/td] [td width="100%"]carbonated beverage, that contains plant protein sources; or[/td] [td width="100%"] (9) a product, other than an energy drink or[/td] [td width="100%"]carbonated beverage, that:[/td] [td width="100%"] (A) is fortified with a vitamin or mineral; and[/td] [td width="100%"] (B) contains a source of protein.[/td] [td width="100%"]federal agency is necessary for implementation of that provision,[/td]
