Comedian Dave Chappelle has succeeded in getting his old sketch comedy program
Chappelle’s Show removed from Netflix, after requesting the streaming service do so because the original rights holder, ViacomCBS, began licensing it without his permission.
The news means Netflix subscribers will no longer have access to the show’s three seasons that originally aired on Comedy Central. Netflix first made the show available on November 1st, and it’s no longer discoverable on the platform as of Tuesday afternoon. Netflix declined to comment.
“THEY AGREED THAT THEY WOULD TAKE IT OFF THEIR PLATFORM JUST SO I COULD FEEL BETTER.”
Chappelle’s Show aired on ViacomCBS-owned Comedy Central from 2003 to 2006 and the program has aired in the years since on other cable networks through syndication deals. It has also been available through Comedy Central’s own website and app, but more recently on streaming services including CBS All Access (also a ViacomCBS property), HBO Max, and Netflix. Chappelle has a controversial relationship to the program, having quit it abruptly during production of its third season, and he does not own the rights to it despite it carrying his name.
Netflix, however, also has a
lucrative contract with Chappelle for comedy specials and other programming that started back in 2016 and is worth tens of millions of dollars.
The Wrap reports that Chappelle’s ongoing relationship with Netflix is why the streaming service decided to honor his request and pull his old show from the platform. The show is still available on CBS All Access and HBO Max as of Tuesday.
Chappelle initially mentioned his frustration with recent licensing deals around
Chappelle’s Show in his
Saturday Night Live monologue earlier this month. The comedian then posted an
18-minute clip of unreleased standup, titled “Unforgiven,” to his Instagram account earlier today.
In the clip, Chappelle references his request to Netflix, saying, “I called them and I told them that this makes me feel bad. And you want to know what they did? They agreed that they would take it off their platform just so I could feel better.” He also called the decision to stream
Chappelle’s Show “fencing stolen goods.”
Here’s the segment of the Instagram video starting at roughly the 11-minute mark that pertains to the Netflix request:
There is a lot to unpack in this statement and I call bullshit on DC. He signed a contract as DC statement himself and it was perfectly legal for them to re-sell, re-pkg, re-etc the show WITHOUT PAYING HIM AGAIN. DC signed a legit contract back them that did not include future royalties rights from streaming. That's on DC and his management, not NETFLIX. It's not a right or wrong thing, it's a contract that he agreed with and signed before any content was created. He is crying like the Lox, Prince and too many artist AFTER THE FACT. It could have easily went the other way. Nobody did DC wrong. He is complaining after the fact. He wants to re-write history on a bad contract after the fact. If DC was about this business he would have signed better contracts going forward after the fact, instead of trolling after NETFLIX to do what they are in their rights to do which was to purchase content, pay the legit copyright holder of the content and to reap the benefits of the contract they signed.
When DC wants NETFLIX TO stop streaming the show, what he is asking is for them to interfere with whomever else is receiving residuals to stop getting paid. How does that sound? DC is the biggest name but if there are others who receive royalties/residuals from the DC show, it's fucked up that DC is asking for their $$$ to stop also. Fuck that!! I bet you are comfortable with another person who eats from the same plate to stop that $$$ from coming to you, because they signed their own fucked up contract and want to stop your money when you did nothing to warrant it.
What DC did and is doing is selfish. Because as a more mature man, he's signed a better contract with Netflix and using his leverage to get them to stop making money on another one of his projects because DC ain't getting a piece of the money. Netflix is agreeing because they feel its better to keep DC happy while they are in business, until that period comes to an end. If you listen to what DC is asking, i'ts a bitch move on his part and totally selfish. Similar but not same shit Monique was being accused of , which is being selfish. Because DC got clout today, he want s to retroactively go back and benefit from something he did not have the foresight to anticipate and don't care if others are negatively impacted also. I like DC and his comedy but this is pure selfish bullshit on his part.
