copyright doesn't work the way you imagine - Chapman and her label has the right to prevent anyone from modifying or distributing any version of her compositions and or original work - thats why artists and DJs get in trouble with mixtapes free promo charity or for profit - all the same shit under copyright

there was never a lawsuit because no clearance needed in that case because those were covers, not samples. Chapman was covered by a lot of artists around the world shit even Babyface covered a few of her songs

When you cover a record just need to pay a license fee and all writer / composition publishing credits

A cover can change the arraignment of the song but not the lyrics or melody
Best example I can think of is "I Will Always Love You" by Doilly Parton - and covered by Whitney Houston

There's no profit from the song if it wasn't released. You can't just sue because the shit got played in public.

You know I was having a debate about today's Hip Hop vs the Hip Hop of the 80's and 90's with a friend of mine. The biggest difference is the cost of sampling and how that affects how its used if at all. We talking about "Public Enemy" as we heard them simply could not exist today because the Sonic collages created by the "Bomb Squad" would never be cleared due to the cost. Chuck D has said " A nation of MIllions" could not be made today due to the cost. This situation is clearly infringement but what will be the cost. It's not on the album proper. Youtube is full of people covering tunes that are "Not for sale" and they aren't being sued. (Yet) So I guess the question is what's the damages here other than the worse version of a classic tune I have heard in a long time assaulting my ears. It's a lazy effort around a sample of a remake of the original. I literally turned it off after 6-10 seconds.
 
There is no *IF* question about copyright infringement - there is a paper trail of requests and denials. And the track "leaked" as a way to promote Nicki concurrent to the new album release, so Tracy will definitely get awarded damages whether or not the infringed track was for monetary "sale".

The bigger question is to how much punitive damage may be awarded/negotiated to deter future "leaks" when a copyright holder's rights and wishes are ignored. For the BGOL youngsters, here 's a history lesson that Nicki and her "people" apparently forgot... :dunno:

I had to look into 7 inches vinyl to verify this , cause I also know it as done by foxy brown .
 
She took the lyrics and all, not just a beat sample. Essentially it's a remake of the same version.

But as the Barbz know, the Queen gets what Queen wants.
A few months prior, singer Chapman accused Minaj of using her song "Baby Can I Hold You" without her permission.
Funkmaster Flex leaked Nicki's version called "Sorry" featuring Nas and shared it on his social media, prompting the lawsuit over the uncleared sample.
Of course, the New York spitter disputed the legal action claiming the song “Baby Can I Hold You" was fair game to use.
As Tracy continues forward to get her portion, Nicki isn’t giving in without a fight.
The Blast reports Nicki is refusing to settle with Tracy and is taking the lawsuit to trial.
Nicki Minaj is ready to fight the lawsuit brought by singer Tracy Chapman and is refusing to settle.

“The mediation was unsuccessful, and no settlement was reached. Settlement is not imminent," a portion of the court document reads.
However, Nicki did do her part in asking Chapman for permission to her music before her song dropped: “Sorry” featuring Nas, but those requests were denied.
Unsurprisingly, “Sorry” was left off Queen due to the sample clearance issues.
Nicki’s argument is that Chapman doesn’t even own the copyright to the song, hence the record is up for fair use.
