Music Legal: Tracy Chapman Has Reportedly Sued Nicki Minaj for Never Clearing That Sample UPDATE! She settled for 450K

Nicki's team is dumb or greedy - Nicki should have just covered the song (bypasses any clearance) - add Nas' bars - remix the track that Steely & Clevie produced - with fresh mix and master on that bassline -this would have been the song of the summer

she is getting her publishing and sync automatic - have been since the 80s, even on these leaks - the smoking gun on this if the label registered the leaked uncleared record with a PRO

copyright doesn't work the way you imagine - Chapman and her label has the right to prevent anyone from modifying or distributing any version of her compositions and or original work - thats why artists and DJs get in trouble with mixtapes free promo charity or for profit - all the same shit under copyright
there was never a lawsuit because no clearance needed in that case because those were covers, not samples. Chapman was covered by a lot of artists around the world shit even Babyface covered a few of her songs

When you cover a record just need to pay a license fee and all writer / composition publishing credits

A cover can change the arraignment of the song but not the lyrics or melody
Best example I can think of is "I Will Always Love You" by Doilly Parton - and covered by Whitney Houston

what is this DO NOT SAMPLE list I keep hearing about?

Y'all dudes is bugging. If nicki ain't made no money from the song (it's not on the album) what is she using for? That's like ANY artist suing a rapper for sampling and putting it on a mixtape. You guys hate for Nikki sure is blinding your judgment. AND no I'm not a nikki fan at all

Not necessarily.

Look at how many artists have sued to stop 45 from using their music at his rallies.

Trump doesn't make a dime off of that use, but artists sue anyways because they don't want their name associated with his.

This is similar.

I wonder how this is going to effect the industry as a whole

could this settlement have been the WISER move like you implied?

Just so no OFFICIAL OFFICIAL decision is reached?

I doubt it will have any impact at all. Rappers have been losing cases like this for decades. This is just one more.

The precident was already set years ago. It's the reason why you don't really hear from DJ Quik or Rakim anymore

I disagree

this was about a sample used on a song that was NEVER officially released

not on a mixtape

she sent it to Flex and HE DECIDED to air it on the radio

she aint make ANY MONEY off that didn't promote it or had any label involvement.

Yeah but when you send a song to Flex......

It's gonna get played......on the air......

That was a dumb move and I'm sure the label/ lawyers let her know vehemently.

How much would she have made if she allowed her to sample it?

Not the point. Some artists have "integrity," and will never let a song be sampled. Others won't let particular genres sample.

Hell she might've thought the song was trash, but hey you're Nicki Minaj a huge artist at the time. Let me put some sauce on the fee plus percentages....if you pay it then cool.

But not we're still negotiating and now I hear the track on the radio...... Oh, well now I've been disrespected and you/your label have to pay!
