My landlord threatened to make me disappear

-As far as wanting to live for free, My roommates and I have always paid our rent in full, on time and well above the going rate. Eventually we found out that the house was owned by a dead woman's estate. It's been in foreclosure since November and going up for auction in about a week. We started asking ourselves "who the fuck does our landlord pay HIS money to?" That made us question whether or not he was even legally entitled to collect rent in the first place.

-Although I'm not really scared of the landlord's threats, I posted the conversation on the internet to take care of the what ifs. Now if I did disappear somehow everyone is going to know who's responsible.

-My landlord is normally a very calm mild mannered individual. The way he talked on that conversation is very out of character for him. He started the conversation by yelling and cursing at me so I replied by yelling at him. It was at this point my roommate decided, on his own accord, to record shit. All of the threats, escalations, etc. were his doing not mine.

-Yes, my wife and baby did die. As a result I had to move out of my home and rent a room in the first place. When I moved in there were no rats and it was July so heat wasn't an issue. Garbage was always a problem but I turned a blind eye because I liked my roommates. I also didn't want to leave because I could have easily ended up in some place worse.

That being said, as entertaining as that conversation was, California also has very strong laws against illegally recording private conversations/communications. If you didn't tell blood that you were recording, if you recorded without his knowledge, you're about to have 2 problems.

I ain't never in my life heard no shit like this, funny as fuck. But yeah...in GA we can record without consent. I tell them bill collectors that shit and they hang that phone up fast as hell.

If the house or apt or whatever is in foreclosure or probate then you will probably eventually have to leave anyway. If you signed a lease then whoever the lessor is or their representatives are who you will have to pay anyway because that was in the original agreement.

The repairs and all that we already went over.

Whoever buys the property at auction will be the new owners. Either the buyer or the lender or lien holder will own it and can decide what to do with the existing tenants. Unless you have written proof that someone else owns the house nothing has changed and the regular rent is still due. If dude pockets the rent that's between him and the owner. He is the designated property manager until you receive written notice from the owner stating otherwise.

Unfortunately this changes nothing. You are still the tenant. Would you agree that it would probably be a wise move to start looking for another place to live?

Not too sure about that, if you have been living there you are required to pay, no who you're supposed to be paying exactly you're using as a way around. You could go down to the courts and find that out, you haven't done so it seems for reasons all convenient to yourself. You have to live with yourself dude, if THIS is how you're choosing to live I hope it's due to some addiction of some kind.

If this guy is defrauding you and is not the legal caretaker or manager of the property then you need to sue the guy defrauding you. If the owner is dead and the landlord is not the legal caretaker then the lease you signed if you signed one is invalid. If the landlord cannot prove he is the landlord then he can't enforce any laws.

If the lease contract is invalid then you are squatting on someone else's property. You will still have to deal with the new owner. This will get the landlord off of your back but brings us right back to the same predicament. You are still on someone else's property. Right back to square one again.

My point exactly, a lot of energy for almost zero return. Real owner might want you ALL out and/or jack rent. You might have woken up a dragin being slick. And to claim you had proof all along but went along and paid anyway only puts you at cahoots as well.
 
Another possibility is that the landlord could have a sub leasing arrangement with the owner. If he did that legally then he has control over that property without owning it. After the property is foreclosed or sold at auction then his leasing arrangement is done unless he renews the arrangement or one like it with the new owners.

Once again you are back to square one. Repair it yourself and pay back rent or vacate the premises.

You might be able to extend your time in the tenant courts or small claims courts but you need to have a solid case or a good lawyer to drag the case out for awhile to buy yourself a little more time.

If you want to buy yourself some time try suing dude in one of the TV courts. Seems laughable but if your situation is tight or a little desperate it truly might buy you a little bit of time.
 
Last night my landlord texted me and said he was sending someone by to fix my roommates door. This someone was a former tenant who was kicked out for using meth back in September. Anyway, dude kicked in the back door to get in and didn't even make the repair add promised. Now i find out my landlord moved him back in on a three month lease. He doesn't have s room but he's sleeping on the couch. This guy told us the landlord is cutting off the water and power tomorrow.
