NEW YORK (WABC) -- Eyewitness News has learned that among the bikers on the Henry Hudson last weekend, were five off-duty NYPD officers.

Sources say at least two detectives witnessed the attack on Alexian Lien and did not directly intervene. And investigators are still working to determine what role, if any, was played by the other three officers.

What is clear, sources say, is that the men did not begin to come forward until late Wednesday, four full-days after the incident.

And detectives are also investigating reports that several others in the group may have been off-duty New York City correction officers.

An undercover detective has informed Internal Affairs that he was present at the time of the confrontation.

The undercover narcotics detective, himself a motorcycle rider, was off duty. Official sources say he did not get involved because he did not want to blow his cover. Internal Affairs is now investigating. The undercover detective is being advised by an attorney.

Also Friday night, 38-year-old Reginald Chance of Brooklyn turned himself in to police and is in custody. Detectives believe he used his silver helmet to smash the driver's side window of the victim's SUV. However, his role in the actual assault of the driver is unclear.

Earlier Friday, the biker who allegedly opened the SUV's door at one point during the chase, is now in custody.

35-year-old Robert Sims, grabbed the SUV's door at 5:05 seconds into the YouTube video, surrendered to police in Brooklyn earlier Friday.

Detectives are also looking at about a half dozen other bikers who may have had a role in the assault of the driver. Some have already been interviewed by investigators after being identified by video and photographs that have been coming in. Investigators are interviewing as many motorcyclists as possible to determine their roles before filing charges.

"This is a complex investigation with a lot of people involved," a source said.

Dayana Mejia cried during a press conference in New York City. Mejia says her partner and a biker left paralyzed in the confrontation, 32-year-old Edwin Mieses Jr., is an adoring father to the couple's two children.

"I love him so much it tears me up that anyone could think that Edwin in any way deserves what happened to him," she said.

Mejia says the people who participated in the motorcycle ride are "not thugs."

Gloria Allred, Mieses' attorney, says he was trying to "calm people down" when the SUV hit him on Sunday.

Video shows the SUV surrounded by dozens of helmeted riders. The driver, Alexian Lien, drove through the crowd and struck Mieses.

Investigators have searched the home of another Brooklyn motorcyclist, believed to have been the one who tried to open the driver's side door of the SUV while it was on the Henry Hudson Parkway. No arrests were made.

Also, police want to speak with two bystanders about what happened, and they have released images of the witnesses.

Everything started when the Range Rover bumped a biker on the Henry Hudson Parkway. As motorcyclists gathered around Lien's vehicle, he took off, running over Edwin Mieses and sparking the chase and vicious assault that followed.

Bikers insist that Lien was the aggressor.

"He drove erratically and bumped the bike on the side," one biker said. "When he bumped that bike on the side, that bike became aggressive because his life was in danger."

Meises' family, which is calling for charges against Lien, is expected to respond to a statement from Lien's wife.

Rosalyn Ng explained why her husband fled the scene and inadvertently drove over Mieses, saying their lives were put in grave danger.

"We were faced with a life-threatening situation, and my husband was forced under the circumstances to take the actions that he did in order to protect the lives of our entire family," Ng said.

She said her family's sympathies went out to Mieses, who broke both legs and suffered spinal injuries that may leave him paralyzed, but said there was no other option than to flee.

"Our fear for our lives was confirmed when the incident ended with the ruthless and brutal attack on my husband, me, and, most importantly, our 2-year-old child," Ng said. "We know in our hearts that we could not have done anything differently, and we believe that anyone faced with this sort of grave danger would have taken the same course of action in order to protect their family."

The biker involved in the initial accident, Christopher Cruz, is charged with reckless driving and unlawful imprisonment. Prosecutors served notice that they intend to take the case against Cruz to a grand jury, a sign that more serious charges are likely.

A second suspect, Allen Edwards, 42, of Jamaica, Queens, surrendered to police at the 33rd Precinct Tuesday night. It is believed he is the man who punched the rear window of the SUV with his fists at the end of the video.

He was held and questioned overnight Tuesday, and police initially said he would be charged with reckless endangerment, criminal mischief and menacing. But the office declined to prosecute at this time, pending further investigation of the entire incident.

New York (CNN) -- Two bikers allegedly linked to a clash between a motorcycle gang and an SUV driver have turned themselves in to police, a New York police spokesman said Saturday.

Biker Reginald Chance, who police identify as the man seen in a video pounding his shiny helmet against the SUV, turned himself in Friday. He is also suspected of being involved in the beating of its driver Alexian Lien, police said.

Robert Sims, who also turned himself in Friday, can be seen also going after the SUV, police said.

Off-duty officer

An off-duty New York police officer was riding with the bikers Sunday and saw much of the confrontation that ended with five injured. But he didn't step in, an official said.

He also didn't tell his superiors about what happened until Wednesday, the source said. The officer, who works undercover, is a member of the motorcycle club.

He may not have been legally obligated to immediately intervene, according to the same source.

It's not clear why he waited so long to report what he saw. He has hired a lawyer and is being investigated by the New York Police Department's internal affairs unit.

The clash

Lien was on his way back in his Range Rover from an outing to celebrate his wedding anniversary with his wife and their 2-year-old daughter.

Dozens of bikers swarmed past him on Manhattan's West Side Highway. A cycle quickly slowed down in front of Lien, who bumped its rear tire, slightly injuring rider Christopher Cruz.

Lien pulled to a stop, and angry bikers surrounded his vehicle, hitting it and spiking its tires, police said.

Lien stepped on the gas, plowing into three more bikers, including Edwin Mieses, who was critically injured.

One of the bikers, wearing a helmet camera caught the dust-up on video, which later in an edited version appeared on the Internet. It showed the Range Rover stopping at a later point with the biker gang still in pursuit.

A man, who police say was Sims, got off his motorcycle and opened Lien's door, police spokesman Sgt. Carlos Nieves said Friday.

Lien drove off with his door slightly open, but further down the road, traffic backed up, cutting off his path, and allowing the motorcyclists to corner him. A biker, who police identify as Chance, smashed the driver's side window with his helmet.

That's where the video ended.

Afterward, some of the bikers dragged Lien from the vehicle and beat him, police said. His wife and daughter were unharmed.

Interrogations, arrest

Police seized the helmet-cam video and questioned the motorcyclist who shot it.

They arrested Cruz, 28, the biker who abruptly slowed in front of the Range Rover. He is charged with misdemeanors including reckless driving. Cruz was later released after posting $1,500 cash bail and a $15,000 insurance bond. His license was suspended, and he was ordered to surrender his passport.

Cruz' lawyer insisted he not guilty.

"His motorcycle was struck, and he stood right there," his attorney H. Benjamin Perez said. "He never assaulted this man. He never tried to assault him in any way. And he does not know any of the other motorcyclists who were involved in this beating."

A second biker, who was in custody, was released Wednesday, when authorities determined that he may have been trying to help.

Mieses' family says he is the real victim. "All of his ribs are fractured. His lungs are so badly bruised that he's still on a ventilator," Yolanda Santiago, his mother, told CNN affiliate WCBS.

Mieses' wife, Dayana, told CNN affiliate WBZ that he got off his bike to help the SUV driver. She blamed Lien. "He got scared; he peeled off, and he paralyzed my husband on the way," she said.

'We could not have done anything differently'

Lien was treated at a hospital for slashes to his face.

"My husband was forced under the circumstances to take the actions that he did in order to protect the lives of our entire family," his wife said.

"We know in our hearts that we could not have done anything differently, and we believe that anyone faced with this sort of grave danger would have taken the same course of action in order to protect their family."

It was Lien's wife who made the last of three 911 calls the family placed during the incident.

Bikers have called for Lien to be charged.

"That wasn't fear, that was aggression -- he ran over three bikes," a man who identified himself as Jose told reporters Thursday night. "Are we saying, if you feel nervous you can kill somebody? You can paralyze somebody? I think we need to charge him immediately."

Angry netizens have turned on the bikers, casting them in a bad light.

New video emerged Thursday allegedly showing bikers riding on sidewalks before Sunday's rally.

It is not clear if this was the same group of bikers involved in Sunday's altercation.

One biker called for cool heads to prevail.

"We are not here to blame anyone, we are not here to point any fingers," Albert Elkerson said. "The true question is how could we have avoided what happened last Sunday, and what can we do to prevent that."

Why don't you watch the video a couple more times and just look at the backs of the motorcycles they were riding. Plates are missing on a lot of them. Furthermore, it has been reported that Meezee has NEVER had a valid drivers license and has had his privileges revoked until 2017, with outstanding warrants and several traffic violations.

The SUV driver did NOT take the law into his own hands. He was saving his family's life. I hope you're never put in a position where your family is terrorized by gang of thugs, and have to escape. But that is what happened to this lovely family. Also, the good samaritan who helped Mr. Lien said that the bikers were also going after the wife and child in the car. The bikers were pulling the wife out of the car, when the good samaritan jumped in and yelled, not the girl! He said the bikers would have killed this family if he hadn't intervened. More proof, these bikers are monsters!

It was a highway, not a street. He shouldn't have been standing in the middle of the highway. As for him telling others to get moving, that is a recent claim by his attorney. His history and behavior (parking his bike in front of the car in the middle of the road) contravene this claim. And let's not forget that this mob had engaged in multiple incidents of menacing behavior (weaving around cars, riding on sidewalks, stopping traffic, etc.) over the course of the day. If he were as level-headed as Allred would like us to believe, he wouldn't have been with them in the first place.

Ayr, you seem to have difficulty both reading and writing. Google "punctuation" to learn more.

We DO know that many of them didn't have license plates because the missing plates are visible in the video, and the police also said that many of them removed the plates to avoid being identified.

The SUV driver didn't just "decide" to run anyone over. When bikers started pounding on his car and trying to get in, he got scared and took off. They're not "all guilty." He acted in self-defense, and is not guilty of anything.

We know for a fact that the injured biker did not have a license, and wasn't even suppose to be on the road because of all his driving violations. He also has a long criminal record. Everyone knows these bikers are thugs, majority with criminal history. That is a fact. Get real.

How about at the end when they were smashing his windows with his helmet? How about when then dragged him out and beat him to death? The point Im trying to make is that even IF the SUV driver was wrong (which I dont think he is) its against the law to take things into your own hands. Multiple people? Then where are these multiple "injured" bikers? Show me that info. from the newspaper or TV newscast. In fact, just Mieses (and Lien) were admitted to hospitals for injuries.

Perhaps you are confusing bikes with bikers?? Yes, numerous bikes were injured which is sad. I'm sure if multiple biker goons were injured they'd be right out there front and center crying crocodile tears to the media.

My point is if Lien just stay at the very first little bump to the motorcycle, and apologize, thing won't get out of hand. You do not run over someone and expect other not to be angry, you don't run over someone. That's hit and run. I'm a biker, and you are wrong, tony. As a responsible biker, you should stay away from cars. Anyone with half a brain knows a car will win in a confrontation against a motorcycle. Instead, this guy cut in front of the SUV and deliberately grabbed his breaks, trying to slow the SUV down or stop him. It is evident because he grabbed his breaks and was looking over his shoulder very clearly trying to stop the car. Why did he do that? That alone is enough reason for the SUV driver to panick. There's a gang of bikers trying to pull him over and he has a wife and child in the car, there's no telling what they want to do. You see it as the SUV hitting the biker, I see it as the biker hitting the SUV. Why would he stop in front of an SUV? Only a moron would do that. Naturally, the SUV driver didn't want to stop after the biker got hit out of his own fault. He should have stopped to apologize? Give me a break! He should speed away from them!

This group of bikers have a scam where they target drivers of more expensive vehicles and one of them puts them self in a position where the driver cant avoid bumping them. Look at the video. Do you not see where the biker, Christopher Cruz, deliberately pulls in front of Lien and then stops short ("brake checked") forcing Lien to also stop?

I don't know what their motives were. Maybe they just wanted to intimidate the driver--or maybe they intended to rob or extort money from him. But Cruz does have a prior for theft in addition to other criminal offenses.

There were NO COPS anywhere around (aside from those OFF-DUTY undercover cops riding with them). These punks weren't worried about getting caught.

I need to clarify. There were a number of cops around. Unfortunately, they were all off-duty and riding with the pack. Five were off-duty NYPD officers, two of whom actually witnessed the attack but "did not intervene." In addition. there was one off-duty undercover narcotics cop. Investigators are looking into reports that off-duty correction officers were also there.

Sources say NONE OF THEM CAME FORWARD UNTIL LATE WEDNESDAY, almost 4 days after the incident.

Are you blind or just plain stupid?

Lien took off only because one of the thugs had opened the SUV door and perhaps tried to grab the 2 year old toddler that was sitting in the back seat. In that instance, the father's only instinct was to protect his daughter by flooring the gas pedal like any other father would have done. The biker that got hit was basically there to block the SUV from escaping. I think the biker got run over because the SUV lost some controls due to slashed deflated tire(s).

What happens when bikers get in big packs like that, is that they sort of get a heard mentality, where they stop thinking individually and just do what everyone else is doing.. I learned first hand how shit like this can happen, back in the days when my boys used to roll is big ass posses and meet up with other crews, getting bigger and bigger and more out of control...
Now that I am older I can see how dumb and dangerous that shit was, but back then I felt invincible and well protected..

NEW YORK (WABC) -- The biker seen on-camera using his helmet to smash in the driver's side window of the vehicle was formally charged Saturday night.

Police say 37-year-old Reginald Chance of Brooklyn used his helmet to smash the driver's side window of the Range Rover last Sunday. He is being charged with assault and criminal mischief.

Earlier, Eyewitness News learned that among the bikers on the Henry Hudson last weekend, were five off-duty NYPD officers.

Sources say at least two detectives witnessed the attack on Alexian Lien and did not directly intervene. And investigators are still working to determine what role, if any, was played by the other three officers.

What is clear, sources say, is that the men did not begin to come forward until late Wednesday, four full-days after the incident.

And detectives are also investigating reports that several others in the group may have been off-duty New York City correction officers.

An undercover detective has informed Internal Affairs that he was present at the time of the confrontation.

The undercover narcotics detective, himself a motorcycle rider, was off duty. Official sources say he did not get involved because he did not want to blow his cover. Internal Affairs is now investigating. The undercover detective is being advised by an attorney.

Police say 37-year-old Reginald Chance of Brooklyn used his helmet to smash the driver's side window of the Range Rover last Sunday. He is being charged with assault and criminal mischief.

On Saturday, police released photos of another suspect they want to speak to about his possible involvement in the incident.

Earlier Friday, the biker who allegedly opened the SUV's door at one point during the chase was taken into custody.

35-year-old Robert Sims, who grabbed the SUV's door at 5:05 seconds into the YouTube video, surrendered to police in Brooklyn, and was arraigned on Saturday.

Sims, a union electrician from Brooklyn, stood before a Manhattan judge, who set bond at $200,000. Sims is also being charged with assault among other things. Investigators say he tried to open the Range Rover's door as driver, Alexian Lien fled from bikers.

Sims' lawyer, Luther Williams, says his client did nothing illegal, and that prosecutors are haphazardly charging as many bikers as possible, hoping something will stick.

"It appears to be they're trying to indict everyone as doing something illegal, and I think that's unfair, said Williams.

In the meantime, the increasingly complex investigation continues. Police say an undercover narcotics detective has been stripped of his gun and badge after allegedly witnessing the assault and not reporting it. Sources say he didn't get involved because he didn't want his cover blown.

At least four other off-duty NYPD and Corrections Officers may have also been present.

The undercover detective is now on desk duty.

It is not clear when Reginald Chance will be arraigned. Police say there will be likely others arrested and charged in this case.

Detectives are also looking at about a half dozen other bikers who may have had a role in the assault of the driver. Some have already been interviewed by investigators after being identified by video and photographs that have been coming in. Investigators are interviewing as many motorcyclists as possible to determine their roles before filing charges.

"This is a complex investigation with a lot of people involved," a source said.

Dayana Mejia cried during a press conference in New York City. Mejia says her partner and a biker left paralyzed in the confrontation, 32-year-old Edwin Mieses Jr., is an adoring father to the couple's two children.

"I love him so much it tears me up that anyone could think that Edwin in any way deserves what happened to him," she said.

Mejia says the people who participated in the motorcycle ride are "not thugs."

Gloria Allred, Mieses' attorney, says he was trying to "calm people down" when the SUV hit him on Sunday.

Video shows the SUV surrounded by dozens of helmeted riders. The driver, Alexian Lien, drove through the crowd and struck Mieses.

Police want to speak with two bystanders about what happened, and they have released images of the witnesses.

Everything started when the Range Rover bumped a biker on the Henry Hudson Parkway. As motorcyclists gathered around Lien's vehicle, he took off, running over Edwin Mieses and sparking the chase and vicious assault that followed.

Bikers insist that Lien was the aggressor.

"He drove erratically and bumped the bike on the side," one biker said. "When he bumped that bike on the side, that bike became aggressive because his life was in danger."

Lien's wife, Rosalyn Ng, explained why her husband fled the scene and inadvertently drove over Mieses, saying their lives were put in grave danger.

"We were faced with a life-threatening situation, and my husband was forced under the circumstances to take the actions that he did in order to protect the lives of our entire family," Ng said.

She said her family's sympathies went out to Mieses, who broke both legs and suffered spinal injuries that may leave him paralyzed, but said there was no other option than to flee.

"Our fear for our lives was confirmed when the incident ended with the ruthless and brutal attack on my husband, me, and, most importantly, our 2-year-old child," Ng said. "We know in our hearts that we could not have done anything differently, and we believe that anyone faced with this sort of grave danger would have taken the same course of action in order to protect their family."

The biker involved in the initial accident, Christopher Cruz, is charged with reckless driving and unlawful imprisonment. Prosecutors served notice that they intend to take the case against Cruz to a grand jury, a sign that more serious charges are likely.

A second suspect, Allen Edwards, 42, of Jamaica, Queens, surrendered to police at the 33rd Precinct Tuesday night. It is believed he is the man who punched the rear window of the SUV with his fists at the end of the video.

He was held and questioned, and police initially said he would be charged with reckless endangerment, criminal mischief and menacing. But the office declined to prosecute at this time, pending further investigation of the entire incident.

Furthermore, it has been reported that Meezee has NEVER had a valid drivers license and has had his privileges revoked until 2017, with outstanding warrants and several traffic violations.

It was a highway, not a street. He shouldn't have been standing in the middle of the highway. As for him telling others to get moving, that is a recent claim by his attorney. His history and behavior (parking his bike in front of the car in the middle of the road) contravene this claim. And let's not forget that this mob had engaged in multiple incidents of menacing behavior (weaving around cars, riding on sidewalks, stopping traffic, etc.) over the course of the day. If he were as level-headed as Allred would like us to believe, he wouldn't have been with them in the first place.

But that is what happened to this lovely family. Also, the good samaritan who helped Mr. Lien said that the bikers were also going after the wife and child in the car. The bikers were pulling the wife out of the car, when the good samaritan jumped in and yelled, not the girl! He said the bikers would have killed this family if he hadn't intervened. I agree. In California, we have bikers that just love to zoom all over the place. Just ONE biker guns his bike trying to scare motorists away so that the biker can hog up the road. This happens during rush hour traffic when space is tight. This also happens when traffic is moving smoothly and they just gotta speed even faster to rush around and ahead everyone else. These bikers think they are entitled to make everyone else give way. Imagine when a gang of them get together. They act like thugs and criminals pure and simple.

The crazed biker who was caught on video using his motorcycle helmet to smash an SUV’s side window on the Henry Hudson Parkway was arrested Saturday night, authorities said.

Reggie Chance, 37, was cuffed in his alleged role in the brutal beatdown of Alexian Lien, who was pulled out of his Range Rover after a wild chase into upper Manhattan.

Chance, of Brooklyn, was charged with assault, gang assault and criminal mischief in the Sept. 29 attack. He is expected to be arraigned Sunday.


The arrest came as the head of the NYPD detectives union ripped police brass for disciplining an undercover cop who refused to expose his true identity and help Lien and his family.


The unidentified detective, who is assigned to the NYPD’s Intelligence Division, was placed on desk duty and forced to surrender his weapon and shield after opting to watch the motorcycle-mob beatdown without helping the victim, police sources said.

“It’s difficult to lead a double life,” said Detectives’ Endowment Association President Michael Palladino. “Even Clark Kent had difficulty hiding the fact that he was Superman.”

The detective feared blowing his hard-earned street cred, sources said.

After a delay of several days, the undercover acknowledged to police brass that he was riding with the two-wheeled thugs — and saw the tail end of the beating in front of Lien’s horrified wife and 2-year-old daughter, the sources said Saturday.

The detective was pulled off the street as police investigated his claim that the assault on Lien was nearly over when he reached the scene.

Cops were reviewing a viral video of the bikers’ wild chase of Lien’s Range Rover along the Henry Hudson Parkway to verify the detective’s version.

In the undercover’s story, someone was already calling police when he arrived at the attack site near W. 178th St. The detective also said the level of danger for the overmatched Lien was diminishing, sources said.

There was no disputing that the undercover delayed his admission to bosses about the incident for several days — as a second detective may also have done, the sources said.

The two may have been joined by another NYPD pair cruising with the biker group before the violent confrontation, the sources said.

The other officers’ roles in the melee, if any, were unknown. Police investigators know the officers belong to motorcycle clubs involved in the weekend ride — including the Front Line Soldiers MC, based in New Rochelle, Westchester County. The head of the New Rochelle chapter could not be reached Saturday.

Peter Douglas, president of the club’s East Orange, N.J., chapter, said several of his members were on the ride, but did not join the attack.

“We’re not thugs or gang members,” Douglas said. “We help veterans and homeless people, but no one sees that.


“To many of us, riding bikes is a form of therapy,” he said.


Robert Sims, one of two bikers who surrendered Friday in connection with the attack, was held in lieu of $100,000 bail on felony gang assault and assault charges after his arraignment in Manhattan Criminal Court on Saturday.

Sims wore a helmet with the number 78 on it and stomped on Lien’s head and body during the attack, according to court records.

Friends of Sims said the 35-year-old electrician was a friendly guy known in his Brooklyn neighborhood for walking his tiny dog — a Shih Tzu.

“Why would they charge him?” a pal asked Saturday. “He was in the wrong place at the wrong time. How do they know he did anything?”

Also being questioned by police Saturday was Kevin Bresloff, the biker who filmed the viral video on his helmet cam.

Lawyer Andrew Vecere said Bresloff was a cooperating witness — not a suspect.

“He does not know the bikers that are being charged with the crime,” Vecere said. “He did not ride with them.”

In addition, the NYPD released a pair of photos Saturday of another man they hope to question in the attack.

One biker shattered the Range Rover’s window, then five or six more dragged the driver out, pummeling his head and body with fists, boots and helmets.

A week after a rampaging motorcycle gang’s stunning caught-on-video attack on an Internet exec and his family, Manhattan prosecutors have released the first blow-by-blow account based on newly-surfaced cell phone camera footage and photos.

As many as six bikers preyed on victim dad Alexian Lien, kicking him in the head even as he tried to crawl to safety, prosecutors said as the first of the accused fist-swingers, Robert Sims, 35, of Brooklyn, was arraigned in Manhattan Criminal Court Saturday night on charges of gang assault and felony assault.

Sims was identified on video and photographs by his distinctive black leather jacket, grey backpack, his helmet, which featured the number, “78,” and his grey and white sneakers — which prosecutors say Sims used to kick the cowering dad’s head and body.

“The defendant is clearly seen stomping on [Lien’s] head,” assistant district attorney Joshua Steinglass told Manhattan Criminal Court Judge Diana Boyar, who set a whopping $100,000 cash bail.

Sims — whose rap sheet includes a 2002 bust for car theft, and gun possession, drug possession and samauri sword possession in 1998, according to sources — has admitted he’s been caught on camera, the prosecutor said.

His lawyer, Luther Williams, insisted his client is innocent and said the bikers only went after Lien to prevent him from leaving the scene after striking one of the other bikers with his Rover.

Sims is also charged with weapons possession. Prosecutors did not name the weapon, but Williams speculated that officials mean his client’s helmet.

“What weapon? Unless they are suggesting the helmets are weapons,” Williams said.

Meanwhile, a source close to the case told The Post that the off-duty NYPD undercover detective who stood by Lien was attacked — and who only came forward Wednesday — is insisting that the violence broke with blinding speed, and that he believed blowing his cover could endanger his own life.

“It all happened so fast,” said the source, who talked directly to the undercover and spoke to The Post on the condition of anonymity. “It wasn’t apparent what was happening till the very end — then it was a feeding frenzy.”

Added Detectives Endowment Association president Michael Palladino, “Leading a double life is not easy for undercovers.”

Palladino pointed to the case of Detective Gescard Isnora, the undercover cop who blew his own cover and fired the first shot in the 50-bullet fusillade that killed Sean Bell outside a Queens strip club in 2006.

“Detective Isnora was on-duty and got fired for stepping out of his undercover role,” Palladino said. “This undercover was off-duty and has every reason to expect the same if something goes wrong.”

The motorcycle-loving undercover — whose work is being described as dangerous and “deep undercover” — had joined last Sunday’s 300-rider rally, and admits watching and doing nothing as Lien was attacked in front of his wife and 2-year-old daughter near 178th Street.

The undercover has had his badge and gun yanked and remains under departmental investigation after only coming forward as a witness on Wednesday night.

A second cop was along for the ride, multiple sources have said, and is also under departmental investigation after coming forward only days after the incident.

Meanwhile, the man allegedly caught on video unleashing the motorcycle rampage — Reginald Chance, 38, of Brooklyn — was also charged with first degree gang assault and assault, along with criminal mischief for allegedly swinging his chrome helmet repeatedly into Lien’s window.

Chance spent Saturday in lineups at the 33rd Precinct in Washington Heights, where the police investigation is based.

Alexian Lien was attacked by a group of bikers who I believe were out looking for trouble and trying to instigate a fight. He ran over one of the bikers trying to flee for his life when he was chased down the Henry Hudson Parkway And harrassed further!! I am sure that this event will startle him and his family for the rest of their lives and it is not fair whatsoever that he will relive this day for many years to come! Nevermind the fact that he will be looking over his shoulder every time he gets out of his SUV just to run into the grocery store thinking one of these thugs might be looking for him**

I think that it is sick that there are people out there who are sticking up for the biker who is in a coma and paralyzed! ... Alexian(Victim) was out on his first wedding anniversary with his wife and daughter when these kids thought it would be cool to instigate a fight with them... I feel sympathy because I am sure that Alexian was not wanting to harm anyone and that this was the last thing which he was hoping he would have to do. I am hoping to gather as many people as i can who are like minded to share their opinions! I do not have ALOT of time to find things so I am hoping that everyone will share their information/pictures so we can all keep updated! .. I believe in justice but sometimes it is just not enough when you hear about these kinds of people who are purposely causing trouble with no regard for innocent everyday hard working people! Debra Lemke 3 words...Stand....your....Ground. There's NO doubt that this was a very traumatic incident. My prayers go out to y'all. It HAD to be absolutely terrifying!!!! I highly encourage you to seek counseling to deal with this TRAUMA. I CANNOT imagine! This was a true tragedy, ANY way you look at it. So, so sad....

Melanie Dennis Honestly. If you had a biker gang of this size coming at you and your baby was in the car you would've driven away too. You can see in the video that the guy purposely slows down and looks back at the car. He was acting like a fool on his bike and got hit. The guy was scared for his life and all of the pansies who are harping on him for driving away are idiots.

Now these guys are blaming the SUV driver, but had they not chosen to exact their own revenge on the driver, they would have had a much better case. Their actions justify the SUV drivers actions... dumbasses. :smh:

just think about it. this bike riding hobby is against the law (i.e. no licenses are issued by the city for this). the theory of self selection: it will only attract pieces of shit (e.g. thugs, corrections officers, drug dealers, aspiring rappers, etc).

A defiant motorcyclist caught on video smashing an SUV window with his helmet after a wild chase in upper Manhattan gave the middle finger to reporters in court Sunday.

Reginald (Reggie) Chance, 37, was in Manhattan Criminal Court facing assault and gang assault charges in the brutal beating of Alexian Lien when he flipped off reporters with both middle fingers moments before he appeared in front of a judge.

Chance is the rider wearing a black leather jacket, in the viral video of the Sept. 29 chase, who violently smashes the driver’s window with his helmet, the criminal complaint alleges.

Lien was pulled out of his Range Rover in Washington Heights and beaten by five to six bikers after he plowed over a Massachusetts motorcyclist while trying to flee from an initial confrontation with the horde on the West Side Highway.

Prosecutors said that after Edwin Mieses Jr. was run over, motorcyclists sped ahead to prevent the SUV from escaping.

Once they trapped the vehicle, the thugs even tried to grab Lien’s wife, who was inside with the couple’s 2-year-old, a witness who’s being hailed as a good Samaritan said Sunday.

“We saw one of them opening the door of the passenger’s side and trying to force the lady out of the car,” said Sergio Consuegra, 52, who jumped between the dad and the bikers.

Consuegra said he was on his way to church when he saw the riders start bashing the car at W. 178th St. and St. Nicholas Ave. and trying to pull Roselyn Ng out.

"She was kind of making some sounds," he said. "I saw a baby inside; she had the baby in her arms, I guess she was protecting the baby from all the glass that was flying inside and outside."

The mob backed off after bystanders started screaming for the woman and baby to be left alone, he said.

The father of 10 said he doesn’t consider himself a hero.

“I wish I could have done more,” Consuegra said. “I must say today, to send a message to others, that whenever they see a family in crisis, no matter what the circumstances ... be there for them. ”

Mieses, of Lawrence, Mass., suffered a broken spine and two broken legs and may never walk again, according to his family.
Lien suffered deep cuts to his face above each eye and check that required stitches, prosecutors said.

Chance, of Brooklyn, was charged with assault, gang assault and criminal mischief, and bail was set at $75,000 cash or $100,000 bond. He was driving with a suspended license, prosecutors said.

Chance's attorney, Gregory Watts, said his client didn’t assault anyone and chased Ng to identify who had struck the motorcyclist.



Police also released a photograph of a new unnamed suspect Sunday night. The biker had a flag sticker of "Guyana" on the rear of the motorcycle, cops said.

Christopher Cruz, 28, who police say sparked the chaotic confrontation by cutting off Lien’s Range Rover and stopping short, was charged last week in the assault and is out on bail. He was also driving without a license.

A third biker, Robert Sims, 35, of Brooklyn, surrendered Friday and has been arraigned on charges including gang assault.

Another video appeared on websites over the weekend showing bikers in Ridgewood, Queens, harassing drivers, violently hitting one car’s window. It was unclear if it was the same group.

I'm still waiting to find out if the SUV tires were slashed after the FIRST incident where he bumped into the asshole that brake-checked him. Because he did stop right there initially. I don't see how anyone can defend these cats.

New York (CNN) -- The lawyer for a biker captured on video smashing his shiny helmet into an SUV window in New York concedes his client "overreacted" but claims he did not take part in beating the driver.

Reginald Chance, 37, is charged with the felonies of first-degree assault and gang assault in the beating of driver Alexian Lien on September 29.

Video from a rider's helmet camera showed bikers, apparently angered when Lien's SUV bumped a biker who slowed abruptly, pursuing the vehicle until they could surround it and beat on the windows. Other photos show Lien beaten bloody and lying on the pavement.

Defense lawyer Gregory Watts said it's "a given" that Chance hit the SUV's window with his helmet. But he said Chance then walked away.

He claimed Chance was knocked off his motorcycle by Lien's SUV after bikers had surrounded the vehicle earlier.

"The law does permit someone who is a victim of an accident to at least attempt to get the identification of the motorist," Watts said. "My client obviously overreacted in that manner, but he is not this thug assaulting someone who's harmless, contrary to the public opinion that's being put out there."

Defenders of the bikers, including relatives of one biker who was critically injured, have criticized Lien for driving through the crowd of motorcycles.

Lien, with his wife and their 2-year-old daughter, was driving his Range Rover back from a wedding anniversary celebration.

The helmet video seized by police shows dozens of bikers swarming past him on Manhattan's West Side Highway. One motorcycle quickly slowed down in front of Lien, who bumped its rear tire, slightly injuring rider Christopher Cruz.

Lien pulled to a stop, and angry bikers surrounded his vehicle, hitting it and spiking its tires, police said.

Lien stepped on the gas, plowing into three more bikers, including Edwin Mieses, whose wife says he is paralyzed.

The video shows the Range Rover stopping again -- long enough for a biker to open the door -- and Lien then driving away until traffic forced him to the final stop.

Police say the subsequent beating included kicks to Lien's head and body as he lay on the highway.

Lien suffered two black eyes and cuts on his face and side, requiring stitches, a police detective's criminal complaint said.

His wife and daughter were unharmed.

Mieses' family, meanwhile, has said he was paralyzed and needs a ventilator to breathe in the hospital.

They claim Mieses was trying to help Lien.

Chance's lawyer said prosecutors should conduct a grand jury investigation of Lien for hitting Mieses and Chance with the SUV.

Criminal case

Chance was ordered held on $75,000 bond Sunday.

Assistant District Attorney Samantha Turino said Chance's license had been suspended and he should not have been driving. She said Chance's arrest record includes a marijuana charge in 2013 and attempted criminal possession of a weapon in 2006.

Christopher Cruz, 28, whom police say is the biker who slowed in front of Lien, was charged with reckless driving and other misdemeanors. He was released on bond.

His lawyer, H. Benjamin Perez, said, "He never tried to assault him in any way. And he does not know any of the other motorcyclists who were involved in this beating."

Another biker, Robert Sims, is accused of stomping on Lien. He surrendered on Friday on charges of attempted assault and gang assault.

Police on Sunday released photos of two other men they want to find and question as part of the investigation.

(CNN) -- New York prosecutors dropped charges against one of two men arrested in a chaotic motorcycle chase that ended in the beating of SUV driver Alexian Lien. It started when his Range Rover collided with a motorcycle in a phalanx riding down a Manhattan highway on Sunday. Video, taken by a camera on the helmet of one of the many bikers who chased Lien as he sped away, shows bikers catching up with Lien's SUV and bashing its windows.

This has brought bikers under intense scrutiny. But I'll say it: Motorbike enthusiasts, on the whole, get a bad rap. A minority of them cause trouble, sometimes a lot of trouble, which causes an undeserved prejudice against the majority. And that prejudice can subtly influence law enforcement, just as it can the public at large.

Bikers have a rich history of misbehavior. In the most infamous case, the Rolling Stones hired the Hell's Angels to provide security at a concert in 1969 at Altamont, California. A member of the audience was killed by a gang member, reaffirming the bikers' reputation as thugs.

Most bikers who tarnish motorcyclists' reputation commit far less dramatic and tragic acts. Riders do themselves no good when they remove the perfectly operational mufflers from their bike for maximum urban volume or pop wheelies in a downtown metropolis.

At minimum, these riders are massively annoying, and at worst, they are very dangerous. Either way, the bias against many is caused by the few.

The transgressions of a few bikers do not represent the true biker spirit, which is a celebrated part of Americana. Like the cowboys and horsemen of the frontier, riding the open road exemplifies the rugged individualist tradition of our country. But like many issues in society and law, often the actions of few negatively affect the policies applied to the rest of us.

How important is bias? The arrest, and the almost immediate dropping of charges, demonstrate how fine the line is between "criminal" and "victim" in a police investigation.

Bias works both ways. Have you noticed that every news story has mentioned "Range Rover" several times? What if the Range Rover was a Lamborghini? How about a 1980 Ford Pinto? Would that make the driver more sympathetic to you? Less sympathetic? Bias is intrinsically neither evil nor good. It just is.

How fine is the line between victim and defendant? Consider how the law might apply to these facts:

First, in the video, a motorcyclist appears to deliberately slow down in front of the SUV, which then collides with the cycle. The law in most states presumptively holds the rear ending vehicle liable. If the driver in front makes a sudden stop, that can overcome this presumption. But in the case of rear enders, even defense attorneys will often concede liability, so it's certainly possible that a jury could find Lien completely at fault for an accident.

Second, as bikers surround his vehicle, Lien speeds away. As he drives off, motorcyclist Jeremiah Mieses is run over in the chaos. Mieses remains hospitalized with two broken legs and spinal injuries and might be paralyzed for life. Those are very serious injuries under any civil standard or penal code.

If it's proven that Lien ran over Mieses, he could be considered a "fleeing felon." New York, like other states, criminalizes leaving the scene of a motor vehicle accident. In a case like this, in which someone is seriously injured, flight is a potential felony. So was Lien fleeing for his life, or was he a fleeing felon?

Third, it's true that a lot of bikers gave chase. Was this alone permissible? In New York, a citizen acting on his own may use non-deadly force to prevent the escape of a person who has committed a crime. Lien's tires were slashed and his windows bashed in. Was that appropriate force? Those acts themselves are non-deadly. If so, were the bikers apprehending a fleeing criminal within the law?

Finally, if any of the bikers charged claim they were justified in preventing the escape of a criminal, the burden is on the prosecution to disprove it and disprove it beyond a reasonable doubt.

Police officers have the unenviable task of making snap judgments under chaotic circumstances. They're human, as is their process of assigning blame. New York Police Commissioner Ray Kelly says the investigation is continuing. More arrests on more serious charges may follow.

Motorcyclist Christopher Cruz faces reckless driving charges after police say he was the one who slowed down in front of Lien's SUV and touched off the whole bloody encounter. Nobody has been charged yet in the actual beating that sent Lien to the hospital, but Cruz's attorney has told reporters that his client is not guilty.

What would you do? Whoever is charged, you have this dilemma. Party No. 1, a young male member of a noisy biker rally carving up the West Side Highway vs Party No. 2, a 33-year-old dad out for a Sunday drive with his wife and baby. Who do you think gets the benefit of the doubt in a close call? That's bias. It's not intentional, and it's not categorically evil. It just is.

But a lot of people don't realize that there's often a fine line between criminal and complaining witness in our criminal justice system. The proliferation of technology and video evidence has made investigations more objective, but it's unreasonable to think humans can cure themselves of all prejudice.

Are bikers discriminated against unfairly? Maybe. But the alternative for them is taking up a less controversial pastime, and I don't see them trading their rides for golf clubs anytime soon.

Isn't that like saying, "I kicked the door in but I didn't rob the store"? The actions he admitted to makes him guilty of anything that happened.

An undercover detective has informed Internal Affairs that he was present at the time of the confrontation.

The undercover narcotics detective, himself a motorcycle rider, was off duty. Official sources say he did not get involved because he did not want to blow his cover.
