NBA fines J.R. Smith 25k for Twitpic'n Tahiry's ass

This situation should result in two discussions:

a) The NBA's ability to regulate their workers behaviour outside their work. This situation has nothing to do with his work as a New York Knick. Where does the NBA draw the line, how far should they be able to penetrate into their workers lifes? Should Kobe have been fined for cheating on his wife?


b) For argument's sake what if J.R. Smith twitted an image of a nude painting he did, would the league deem that inappropriate as well? As someone else said in most countries nudity itself is not forbidden.
 
I got a side job teaching kickboxing at a local YMCA and they specifically asked me for all my social networking sites. They told me that I represent the Y and the contract it states that I can be fired if I have and lewd or malicious things on a site like a Facebook or Twitter.

Apparently, sports is the only job where you can get fined by your boss for things that have nothing to do with your job.

Unfortunately it isn't

They want to see what type of person you are outside of work, WHO is on your friends list (or what groups you belong to), if you have wild pics or you talk about weed smoking and gangs. They WILL hold it against you.

For all of this "Land of the free, home of the brave" talk, people are surprisingly docile when it comes to giving away their civil liberties to corporate interests.

I think that is personally too far for an organization. What about if I wish to take a political stand for something that they disagree with?

Now I understand that some people need jobs(I am not referring to you specifically, I am speaking now in general terms) so they may accept this intrusion but I would be hesitant to work for an organization who asks for this information

If I was in an interview, I would be asking them lots of questions.

And before I accepted a position I would have a copy of their relevant policies reviewed by a lawyer or worker'r rights organization
 
I'm not cool with the NBA fining him. If the TEAM decides to do so, cool. But as stupid and petty as the photo is, does this mean the NBA can fine players for cursing on twitter too?

This is too far and he should appeal. Dude had no nba reference anywhere in that pic at all. Hell gronkowski let the porn star wear his NFL jersey and nothing happened to him. Since when can the league control want pics he wants to send on his personal account. If he wants to put his business out there like that it's his choice. No way he should be fined at all for this much less 25k. Hell you get fined less for drugs than showing a pic of a woman in a bikini bottom basically?

I have to disagree with this. If a fan goes so far as to follow an athlete on twitter then they are signing up for personal updates from that athlete. Whatever updates those may be are not the athletes responsibility to filter since he didn't make you go out and follow his personal account.

You represent the NBA at all times, not yourself

Just like they can fine and suspend you for getting a DUI. That's your time. Your job can't do that, well depending on your job(policeman, bus driver...).

The NBA isn't the average job. Not sure why some of you can't understand that.

I do believe there are some provisions in the new labor contract revolving around social media. The problem I see is how do you label that picture as derogatory or in direct violation of the provision.

There is no nudity ..... all it is a picture of a womens backside if he was so post a picture of a sports illustrated cover or XXL mag would he be fined too? Both of those you can pick up from any 7/11 and browse through them.

My whole thing is the USA is a bunch of prudes when its comes to sexuality and nudity. You show a nipple on TV and its like the second coming of the devil. What if he was overseas and took a picture of a nude painting or an advertising billboard.

He if was smart .... i hope he used instag.am too i would just label the picture within my rights of artistic expression. Instag.am is a photo service that highly known for taken artistic shots he could be starting a new hobby nothings wrong with that.
