Do you realize how bright that light is? Once he pulled up to the OP, he could have turned the spotlight off and turned his flashlight on if he still needed additional light. From what the OP said, he was in a neighborhood on a street with at least 3 lanes of traffic. And he was walking to a mailbox. That is likely a very well developed area, so its unlikely that it was very dark. I'm sure there plenty of street lights in the area.

When a cop pulls you over at night, you'll notice that he's got a spotlight beaming through your back window. If you make any movement at all, he can see it. Whatever is visible to the light is visible to him. So when the cop slowly follows behind the OP shining the light, by the time the cop pulled up beside him, he likely had a good idea of what whether or not he needed to be worried bout the guy.

Cops know how bright that light is. It's adequately bright enough to blind a person for several seconds after looking at it for several seconds. So now consider the fact the cop shined this bright ass light on this guy for an EXTENDED period of time. He was being a dick. Period.

People need to understand that what the officer was doing is called pro-active policing. If the police just waited until people called 911, most criminals wouldn't get caught. While patrolling the cop looks for things that are out of the ordinary. Someone walking down the street, in a small town, residential neighborhood, at 3am is not ordinary. At 3am its dark, so I would put my spotlight on that person. I don't know him from Adam, for all I know, he could be a homicidal maniac. Then he used the rules of the Common right of Inquiry which states that an officer has the right to ask; name, address, date of birth, where you came from and where you are going. Anything more than that, he needs a level of proof called Reasonable Suspicion. That means that the cop has to have a reason to believe that you possibly committed, are committing or plan to commit a crime. Now, you didn't do anything so he just asked those basic questions. If you answer just those basic questions, you walk away 30 seconds later and the cop did his job.

I could see your claim of racism if the cop took things to another level. But when the cop approached you, you responded as if you were spoiling for a confrontation. He didn't restrict your movements, you weren't in custody in any way and you were free not to talk to him if that's your desire. If one of your friends just happened to be driving by and said to you "what you doin' out here 3 o'clock in the mornin'?", you'd answer, "couldn't sleep, so I'm taking a walk." Why would he ask that? Because its not an ordinary thing to do where and when you did it. Was it illegal? No, and that's why you didn't get arrested. Was the cop wrong? No, he was doing what a good cop should do; check out suspicious behavior in the neighborhood. Now if some cat came thru, breaking into cars in the middle of the night and you found out that the police saw him and didn't do anything, you'd be mad about that as well. Now if he subjected you to a felony car stop (had you spread-eagle, against the car, frisking and searching you), you would have a valid complaint. The problem with this thread is that all the cop haters want to start ranting about all of the injustices perpetrated by crooked cops, instead of talking about what happened to you.

True, but it is also a defensive strategy, because you don't know who you are approaching, if they're armed, if they just committed a crime, etc. They shine the light in you face so that you can't see them as a target. In this case, he was being a dick. Because OP gave him the "minding my business" answer.

Probably a racist element? How? I've seen drunk white dudes stopped and questioned when they've been wandering around. Again this is 3am, not 3pm. I don't have people walking up the street at 3am in my neighborhood

this goes on for a few consecutive weeks ... the employee comes into my office beggin' and pleadin' for me to give him his check early because he spent up last week's check already .... and i oblige him as it's not adversely affectin' my business ...

finally one week he comes in .. and asks for an advance ...and i buck...and say you know technically payday is friday...and i shouldn't keep doin' this ...to which he replies ..jokingly... "oh, come on.. it's not like you can't afford to..i work in accounting so i've seen the books, we made a million dollars last quarter" ...so reluctantly i agree ...

then comes next week... now i'm gettin' sick and tired of this .. i tell him i'm tired of sendin' down his check request to payroll on one day...and sendin' everyone else's down on another day.. it's creatin' double the work for me... now he loc's up ...stands over me in a threatenin' manner .. and demands i cut him a check today ... feelin' my personal safety may be in jeopardy and jus wantin' to avoid any confrontation... i decide to cut him his check early again...

weeks go by...and now...he's no longer beggin'/askin' for his check early..he's demandin' it...and now it's not jus one day early..now it's two or three days early...and now he wants his christmas bonus in june ...

other employees get wind of this..and they start demandin' their checks early too...and when i buck with them ..or try to explain that it was jus supposed to be a one time exception for the first employee ....they threaten to sue me for discrimination and showin' preferential treatment to the first employee... and maybe it's a frivolous suit...but now i have to spend time and money defendin' myself in court ....

and maybe next ... employees are not only dictatin' when they are paid..but how much .... and so on....

now maybe you prefer not to look at the police as your employees...but they are definitely not your parents or your husband ...at the very least they are your equal .... and if someone on your same level wants to know what you're doin'..when you're lawfully walkin' ...on a public sidewalk at 3am ...you should be able to refuse to answer the question and keep walkin' ...

and it's not even about what the constitution/bill of rights says ... this is an inalienable right bestowed onto you by your creator ... the constitution jus enumerates them ..so everybody is clear as to what they are ...

The guy might be a night owl but he is asking for trouble. To walk 4 blocks at 3am to mail a letter is asking for attention good or bad.

Trying to exercise your rights at 3 am can end of being the subject of a missing person report.

this is orange county, california ... a mostly white, mostly upper middle to upper class conservative county ...

in the northern part of the county ... you have some hispanic and asian neighborhoods ...

people like kobe bryant and dennis rodman and so on live in the southern part ...

if you drive through the southern part of the county it's routine to see a couple of aston martins, a few bentleys, sometimes a lamborghini ...

and i kinda live on the line where the hispanic neighborhoods meet the white neighborhoods...so it's a mix of people...

You niggas need to calm the fuck down sometimes. I guarantee that if you'd have simply said "hey officer I live around here. I'm a nightowl and I was just walking THESE HERE LETTERS to the mailbox." His ass would have kept it moving.

To a very small degree your point has merit the cop was correct in his "initial contact" but after the citizen declined to speak to him and wanted to be on his way barring any reason to believe that citizen is about to commit or has committed a crime the officer should have ceased the conversation and all that chatter afterwards is tantamount to harassment, you must also understand that if this gentleman had been white and dressed in a jogging suit the officer would not have given him a second thought and that citizen would have been free to continue what he was doing.....breaking into 20 cars. If you are a cop might I suggest you "think outside the triangle"? #1 you have made contact #2 in your mind time/date stamp the location you have seen this subject #3 you have his physical and clothing description and #4 you have "his" reason for being where he is so use that info as you have other officers check the area for recent and obvious signs of vandalism, destruction to property, car larcenies and if they got nothing guess what? you simply don't have anything. Decent people don't have a problem with good cops doing good cop work and we all understand that there are just plain old bad/stupid cops mixed in with them but it's when they well go beyond their authority and violate the laws and rights they swore to uphold that everyone has a rightful reason to be pissed at them.

Even if OP was wearing a jogging suit, the cop wouldn't have looked at him funny, because it would look as if he were jogging. From a cop's perspective, if I'm working midnight to 8am shift, I don't see very many people. So, I'd make it my business to know what's going on in my neighborhood. If I see a guy walking thru at 3am and that's not normal for this neighborhood, I'm going to investigate. Because that's what I'm supposed to do. Protect and serve. I ask you who you are and where do you live. You tell me, we have a small convo that you are a nite owl and sometimes you're out and about late like that. Now in my mind, you're a cool dude that just likes to be out late like that and I KNOW YOU NOW! As a cop who is patrolling your neighborhood, shouldn't I know the people I'm serving and protecting? These things help me know what's normal activity in the area so I can do my job better.
 
The analogy is being brought up to demonstrate how the remark was possibly dismissive and NOT to justify the cop's response...so there's nothing wrong w/ the analogy

its night time so that is a normal stance they will shine the light to protect themselves from a possible threat.

If they pull you over at night they will have the side spots on and aimed at your side view mirrors and they will have the take down lights aimed at your rear view so you cannot see them as they approach your car.

The OP also stated his hands were in his pockets and he was not going to remove them unless ordered to do so.

Idk if there's any other way to handle it but personally I would not have liked a high beam in my face @ 3 in the morning if I'm just tryna get a quiet walk...sets a negative tone off the bat...@ that point I wouldn't have answered dude until he took off the light or got out the car and spoke to me face to face like a man

And in all that story and all that I know my rights bullshit, while he is pleading the fifth he never once asked the cop to not shine the light in his face.Not once did he say is that light necessary .

the car didn't approach from the front. and was on the side of him while he was walking.

Again I am not to sure this actually happened , as I don't see a racist cop letting a black stand with his hands in his pockets .I also am not sure that an arrogant cop would allow.I also don't see a cop that thinks a black man is uncooperative just following along at 2mph like he begging his GF to get in the car. For your analogy to make any sense whatsoever there has to be a relationship that precedes the questioning. If your parent(s), significant other or friend(s) ask you where you're going or what you're doing it's completely reasonable to give info. The explanation is pursuant to this reasonable expectation. No such reasonable expectation exists when dealing with complete strangers. Imagine a New Yorker's response to "Hey buddy how's it going? Where are you headed at this hour?" that shit would be a lot less neutral than "Minding my business"
