Substitute elementary teacher arrested on 20 counts of child molestation

I think molestation is a stretch, flashers, streakers, sex in public, these folks get charged with indecent exposure. I think it would be hard to convict her of molestation without her actually touching anyone but when kids are involved you never know, I would expect these charges to plea-bargained down to indecent exposure.

If it was a guy would you feel that way?

Yes, I still believe a charge of molestation without touching anyone is a stretch. If I'm on a city bus with my children and a guy pulls out his junk and starts playing with himself, I would be angry and offended but would I leave thinking me and my children have just been molested? No.

Wtf?

When did I say that? I said in my opinion, indecent exposure isn't molestation. Indecent exposure is a crime. You have to comprehend what you're reading before you reply.

In your opinion, if you witnessed what I described, you would feel like you were molested?

As an adults, I would agree with your mindset on some level. You are not necessarily molesting an adult by just being nude or playing with yourself. However, kids are different especially in a direct position of power like a teacher.

For me, I look at it as a form of grooming the kid, hoping that the kid will be interested enough to replicate the behavior in front of the adult or the kid will physically engage believing it was a form of play.im going to make the assumption you wouldn't be cool with your kid performing sexual acts in front of their teacher.

Would you be ok with an adult showing your child porn? To me, I'd also consider it a form of grooming the child.

I agree, which is why I said in an earlier post that while I wouldn't consider it molestation, when children are involved, you never know what a jury may think.

I think an adult one on one with a child watching porn is much more serious, than what the teacher did, because even if they didn't do anything then, it's coming.

Do you know the legal definition of the word molest?

What is the legal definition of the word "molest?"

The crime of sexual acts with minors, including touching of private parts, exposure of genitalia, taking of pornographic pictures, rape, inducement of sexual acts with the molester or with other children, and variations of these acts.

Every state may have slightly different definitions of the law, but more than a few would consider playing with yourself in front of kids as a form of sexual abuse. Molestation doesn't need to involve actually touching the kid. That is why I mentioned grooming. Assuming the story is legit, a jury should have no issue with convicting the person.

Spladow

What an odd thing to split hairs about

I do. If your ten year old son was playing with matches and started a fire in his room, you may give him a few whacks with a belt as punishment, well legally, that's child abuse but I'd bet you wouldn't think so. I understand anyone who believes that what the teacher did what sexual abuse, I happen to believe that exposing yourself without touching isn't molestation.

False

Also, totally irrelavant to the crime being discussed

What's false? I'm making a point about legal definitions.
I'm telling you your legal analogy was wrong.

Corporal punishment of minor children by parents or adult guardians, which is intended to cause physical pain, has been traditionally legal in nearly all countries unless explicitly outlawed....laws provide for a defence of "reasonable chastisement" against charges of assault and other crimes for parents using corporal punishment.
