I don't know if this counts as "threatening to sue" or "offering not to sue," but Phil Reese, public relations manager for Jenn Sterger, said on the Dan Patrick Show that he and his client would pursue no legal action against the NFL as long as Brett Favre(notes) gets suspended.

According to a friend of hers she was going around showing everybody the pics and conversing with Favre.

Even when the photos were leaked during preseason of THIS year she said she had nothing to do with it, that someone "stole" the photos out of her phone.

This bitch is straight up about $$$ and publicity.

In contract law, that is the forbearance to sue is deemed to be legal consideration in an offer, which then needs to be accepted by consideration from the other party.
