While the individual on the left-hand side was undoubtedly the instigator, the person who struck the children also contributed to the escalation of the situation. Therefore, both parties should be held responsible for the incident.

The motorist who struck the family is the one at fault. He let his emotions run wild and decided to respond to the 1st guy's taunts by pulling out his phone and filming, instead of ignoring him and just driving off.

There’s no doubt that the driver who hit the children and the mother in the crosswalk should bear the majority of the blame. However, if this was indeed a road rage incident, both parties should be charged with appropriate offenses.

The first guy broke two laws: filming while driving and harassing the other driver. If the prosecutor considers this road rage, both drivers will be charged with crimes. If both drivers are charged with road rage, I believe both insurance companies will be liable in some way. Maybe 80-20 or 90-10. The guy was an idiot for uploading that video.

#2. Insulting a driver in another car is NOT a crime. For all you know, the driver in car #2 may have initially started/instigated the whole incident to began with.

#3. The prosecutor might investigate driver #1, but they will not be able to convict him of anything because HE DID NOTHING ILLEGAL.

#4. The insurance company of driver #1 WILL NOT be held liable because driver #1 did nothing illegal.

#5. They are both idiots, but only one committed an actual crime.

You are correct. Handsfree filming itself is not a crime while operating a vehicle. However, we are unaware of the specific device used to capture the footage. Nevertheless, we did notice that the camera zoomed in and out during the recording. I suppose we’ll have to wait and see what the outcome turns out to be.
 
If he was driving a self driving TESLA he would have killed the family and the car would have exploded killing him.

Unless the other driver is doing something to endanger you, you can't justify not paying attention to the road ahead because you wanted to hurl some zingers at the other car.
