BUFFALO, N.Y. (WIVB) — We’re learning more about the 911 call taker who was fired over her handling of calls related to the Buffalo mass shooting.

According to information obtained by News 4 through a FOIL request, Sheila Ayers was working as a police complaint writer for Erie County during the afternoon of the shooting, which happened on May 14.

At the Tops store on Jefferson Avenue, 10 people were fatally shot and three others were injured. Every person killed was Black. The accused shooter is a suspected white supremacist.

Ayers, who was subsequently placed on administrative leave, was fired less than three weeks later on June 2. A memorandum from the Erie County Department of Central Police Services details her conduct on May 14.

"Ayers received at least six calls related to the shooting. At roughly 2:30 p.m., a man called, telling her multiple shots had been fired at the store. The memorandum says Ayers talked over him and disconnected the call with minimal information.

Then, two minutes later, Ayers took a call from a woman who the memorandum described as “speaking quietly, calmly and clearly.”

“PCW Ayers told the caller that she didn’t know why the caller was whispering. The caller then spoke louder to say someone was in the store shooting when PCW Ayers spoke over her. The caller was trying to ask for assistance when PCW Ayers said ‘Nope, you’re going to answer my questions, if they can’t see you, they can’t hear you.’ There is a clear gunshot in the background of the call and PCW Ayers continued to treat the caller poorly. The caller was requesting someone to ‘please come’ when PCW Ayers hung up on her.” - MEMORANDUM FROM ERIE COUNTY DEPARTMENT OF CENTRAL POLICE SERVICES

Following this, Ayers took three more calls and told those on the other end that police were on the way, but did not attempt to gather certain pieces of information, according to the memorandum.

  • In the second, Ayers was described as having failed to ask for more information on the caller’s knowledge of the situation.
  • And in the third, the memorandum says that after Ayers told the caller police were “on the way or there, actually,” she hung up without asking if the caller had any information.
Another call was received by Ayers from someone who was off-site. That person had said they were told of the situation from someone who was there. And according to the memorandum, Ayers told the caller “We don’t need anyone calling from off-site.”

The man accused of shooting up a Buffalo grocery store because of his hatred of Black people has been indicted by a federal grand jury on hate crimes and firearms, the Justice Department says.

Payton Gendron faces 27 counts including 10 counts of hate crimes resulting in deaths, 3 counts of hate crimes involving an attempt to kill, and 13 counts of using, carrying, or discharging a firearm in relation to a hate crime.

Attorney General Merrick Garland says, "the Justice Department fully recognizes the threat that white supremacist violence poses to the safety of the American people and American democracy."

If convicted, Gendron faces up to the death penalty for these charges or life imprisonment.

Gendron is currently in custody on New York State Charges.

The Tops Friendly Market grocery store where the shooting took place opened Thursday for the first time since the tragedy.

A moment of silence and prayer will be held Thursday at Tops Friendly Market to honor the victims, employees and community impacted by the May 14 mass shooting, with a ceremonial reopening of the overhauled store before customers return Friday, the company said.

Ten Black people were killed when a then-18-year-old gunman wearing body armor and carrying a semi-automatic rifle opened fire on weekend shoppers and employees. Three people were wounded in the massacre.

Investigators say the shooter was motivated by white supremacist beliefs and researched the demographics of the predominantly Black neighborhood where the market is located with the intent of killing as many Black people as possible. He drove for more than three hours from his home in Conklin, New York, to carry out the attack, authorities said.

The decision to reopen, rather than relocate, the store has been met with mixed emotions in the East Buffalo neighborhood that, beset by high poverty, fought for years to get a grocery store. Since opening in 2003, the Tops location remains the only supermarket in the immediate area. Its closure in the wake of the shooting forced many residents to take buses to other locations or rely on stopgap measures like neighborhood giveaways to access fresh food.

“We must go on,” said Tops employee Rosalie Bishop, who has worked at the store for 12 years. She wants the store open again — and never for a moment considered not returning to work with colleagues who she considers family.

“The store is there for a reason. The store is still there for a reason,” said Bishop, 58, who was on her way to work when the shooting happened and said she’s still processing her near miss. “The people will come back. They might not come today or tomorrow, but they will come back.”

Other neighbors say reopening isn’t the best path forward.

Suggestions to local media and on social networks include turning the site into a park or recreational center that would bring the community together, or having several supermarkets that are more dispersed throughout Buffalo’s East Side.

Some simply can’t imagine entering a store where such terrible events took place.

Mayor Byron Brown said he was apprehensive while first touring the remodeled store but believes the overhaul will be helpful to customers.

"I realize that not everyone will feel comfortable returning to the store,” he said in a statement, adding that he is encouraging other retailers to serve the area.

“None of us will ever forget the cruel, racist attack,” Brown said. The reopening is a step toward healing, he said.

Bishop already has returned to the store to help prepare. Her first day went smoothly, but a security drill with flashing lights on the second day sent her home, shaken, mid-shift. Still, she said she is not afraid for her safety.

Two months after a white teenager allegedly killed 10 Black people in what authorities described as a racially motivated mass shooting, the renovated Buffalo, New York, supermarket where the rampage occurred was rededicated Thursday afternoon in an emotional ceremony.

The Jefferson Avenue store's official reopening on Friday comes after a moment of silence and prayer service on Thursday in which the names of the victims were read out loud. A firefighter rang a silver bell after the name of each victim was read.

The moment of silence was lead by Buffalo City Councilman Ulysees O. Wingo Sr. at 2:30 p.m., marking the time the mass shooting began on May 14.

The ceremony also included an emotionally stirring dance performance by a member of the African American Cultural Center in Buffalo.

Pat Patterson, an employee of the Buffalo Tops store, read a poem titled "Water" by Jillian Hansworth, the poet laureate of Buffalo, who attended Thursday's ceremony. The poem is inscribed on a water wall memorial constructed inside the store honoring the victims.
This is the day whe we declare that hate did not win, that hate was defeated, that hate has no place in east Buffalo or Buffalo, or in the great state of New York," New York State Attorney General Letitia James told the crowd of dignitaries, store workers, community members and loved ones of those killed during the ceremony.

The store has undergone extensive renovations to repair the damage left by the mass shooting, in which the suspected gunman fired more than 60 shots from a high-powered, AR-15-style rifle, killing people inside and outside the Jefferson Avenue store and leaving three wounded.

Tops president John Persons began his remarks by thanking the first responders, including police officers, who rushed to the store to treat the injured and take the alleged 18-year-old gunman into custody.

"The only way that I know to recover from such heartache really is through love and gratitude," Persons said. "People in Western New York came together in such amazing ways after that hateful attack."
