


A Montgomery County man broke into an apartment Monday and raped a 6-year-old girl in her top bunk bed while her older brother slept below, police said.
Oscar Rivera Herrera, 28, of Hatfield, has been charged with rape of a child, burglary, and other crimes.
Herrera broke into the Hatfield Village Apartments early Monday morning through a living room window and climbed into bed with a 6-year-old girl, District Attorney Risa Vetri Ferman said in a news release.
The girl's 11-year-old brother, sleeping in the bottom bunk bed below his sister, told police he awoke to his sister asking, "Why are you doing this," and crying, according to an arrest affidavit filed in the case. He assumed his sister was having a nightmare, he told police, until he awoke a second time to the bed shaking, and a man's voice.
The boy went to his parents' bedroom and then called 911 at 4 a.m., telling dispatchers that someone did "something" to his sister.
The children's stepfather held Herrera at knifepoint until police arrived, officials said. The family told police they did not know Herrera.
The 6-year-old girl was taken to the hospital for a medical assessment and forensic evidence collection. She told police that "bad things happened," according to the affidavit. She drew a picture to describe to detectives that he raped her. The girl told police Herrera removed her pajamas, hit her in the head and face, and grabbed her sides during the sexual assault.
Herrera was arraigned Monday night and was being held on $1 million bail. He is to next appear in court for a preliminary hearing Nov. 19.
