NYPD Chokes a Man and Kills Him On Staten Island Street (Video)

I've already stated in my previous reply that communities must vote out elected officials that condone police brutality so I haven't ignored our responsibility. Further, so much of this isn't just a local issue but a national issue because there are African Americans all over this country that don't have the numbers, support or voices heard in their communities that are being brutalized by aggressive corrupt policing. How many elected officials does it take to fix police brutality? It will take more than a elected official to address this problem. To say this can all be fixed on just a local level ignores the the historic brutality that has been committed against people of color. I'm saying Obama should speak up instead of remaining silent. Bring national attention to this issue. Police violence against black men and women in this county has become an epidemic and he needs to acknowledge it. He can show his support in helping pass tougher bills so corrupt police who violate our civil and human rights will realize that they can't hide behind their badges.

But from the tone of your reply I suppose black people are not worth consideration because Mr.President has so much more to do than worry about us? It's like telling blacks during civil rights to wait for things to gradually improve until the white folk finally come around to seeing things a better way.

Federal monitor are sent into a lot of police departments. The federal government is not geared up to handle locals cases all across this country. That is why such issues are best addressed locally. Then after such measures are exhausted. Can be taken up federally. Some of you would have the federal government take over states and the jurisdiction with in them.

waiting for all the new York dudes to say how great their city is.

Buy a belt in Barney's....get arrested:smh:

Walking down the street...get stopped and frisked:smh:

Go to your bachelor party...get murdered by pigs:smh:

Yeah....I love New York:smh:

I'm saying a consorted effort needs to made IMMEDIATELY to make sure proper action is taken.

Perhaps you don't see the importance I'm trying to make of this issue.

NYPD cop who used chokehold on Staten Island man Eric Garner stripped of shield, gun

he eight-year NYPD veteran officer who was caught on video putting a Staten Island man in a chokehold has been stripped of his gun and his shield.

Officer Daniel Pantaleo was placed on modified duty Saturday as cops and the Staten Island district attorney investigated the case.

This comes after a shocking new video shows Eric Garner, lying handcuffed and unresponsive on a sidewalk, received zero medical help from cops who instead just emptied his pockets.

The seven-minute clip posted Saturday on YouTube shows an apparently lifeless Garner, whose head droops to the side as at least eight cops stand nearby.

“C’mon guy,” one cop says to Garner, the only thing on the video that suggests any of the officers was trying to help the man. “Breathe in, breathe out.”

But Garner, lying on his side with his eyes closed, doesn’t move at all — even when the officer slaps him on the shoulder. The side of his head remains flat against the concrete, and his eyes never open.

At one point, another officer is seen taking a cell phone and a pack of cigarettes from 43-year-old Garner’s pants.

Even after the arrival of an EMT four minutes into the video, no medical aid is provided to Garner. He’s instead just loaded onto a stretcher and wheeled off.
NYPD Officer Daniel Pantaleo was stripped of his shield and gun, and placed on modified duty Saturday. New York Daily News NYPD Officer Daniel Pantaleo was stripped of his shield and gun, and placed on modified duty Saturday.

Cops say he was pronounced dead a short time later after arriving at a Staten Island hospital.

Pantaleo is shown standing a few feet away chatting amiably with a uniformed colleague.

Near the end of the clip, he gives a satiric wave to the person shooting the second video.

Officer Justin Damico, on the force four years, was also pulled off the street — but was not forced to turn in his badge or his weapon.

Outside his home Saturday, an infuriated woman screamed at reporters.

“Get off my f------ property! F------ retards!” she howled. “One picture of me and I’ll sue you!”

While autopsy results on Garner were incomplete, sources told the Daily News that there were no signs of neck trauma on the heavyset victim.

One source said the likely cause of death will be a heart attack, although other factors — including the illegal takedown of Garner — “will probably go down as contributing.”

Either way, Police Commissioner Bill Bratton was irate after getting a look at the video from the Thursday afternoon tragedy near the Staten Island ferry terminal, another source said.

The investigation will determine in part whether the cops were justified in their decision to jump Garner — and one source indicated they were not.

“Tactically, very little was done right,” the source said. “The first two cops (Pantaleo and Damico) didn’t engage Garner . . . They appear to know him. Do something to put him at ease.”

A sergeant caught standing nearby in the video could be nailed for “failure to supervise,” the source said.

Garner’s devastated wife Esaw collapsed in the arms of her family with a piercing wail Saturday at a Harlem rally organized by the Rev. Al Sharpton.

“Oh my God!” she shouted before tumbling.

The widow, along with Garner’s mother, daughter, and sister, sobbed loudly as Sharpton demanded justice for the family and the late father of six.

“There is no justification at all on this chokehold,” Sharpton said. “And there is clearly no reason, when a man is saying ‘I can’t breathe, I can’t breathe,’ that you maintain this chokehold.”
In a new video posted by a witness, Eric Garner can be seen on the ground after Officer Daniel Pantaleo (rear, green shirt and beige shorts) applied a chokehold. Mayor de Blasio spoke on the phone with Esaw Garner and the dead man’s mother Gwen Carr.

“Mayor de Blasio called Mr. Garner’s wife and mother (Saturday) morning to offer his condolences,” said de Blasio spokeswoman Marti Adams.

“He reassured the family that the city is doing everything possible to ensure a full and thorough investigation.”

De Blasio also sent Marco Carrion, head of his community affairs unit, to the Harlem event.

A funeral for Garner was set for Wednesday at the Bethel Baptist Church in Brooklyn.

The first video, obtained by the Daily News, captured Garner complaining that he couldn’t breathe as Pantaleo applies the chokehold and other cops take him to the ground.

Cops were investigating whether Garner was illegally selling “loosies” — untaxed single cigarettes. He had three full packs of cigarettes and one opened pack of untaxed smokes when police approached him.

At a Staten Island rally attended by about 500 people Saturday afternoon, Garner’s sister said the minor transgression hardly justified the police response.

No matter how big he was, that was somebody's father, husband, son, brother.... And these fuckers flat murdered him. Had to actually throw my wife's cousin out of my house last week when he was trying to explain the stress police go through and sometimes they lose touch for a minute and he was sure dude didn't intend to kill him and he probably felt he needed to be a little more aggressive because of Dudes size. I swear if they don't do right on this one there may be some serious violence toward officers in NY and other places. People are getting tired of this bullshit!

Working in the group home the used to give us training , once every two years, if lucky, but I can count on my hand the many of times workers did it correctly.
When shit hits the fan they became either gun ho or restrained with fear.. I wonder how much training cops get, and how seriously they take it.. Because they seem to have more issues going on when they restrain, they have fear, over zealous cops, racist cops, and cops who simply dont know what they are doing.
Often people can go years restraining the wrong way, and after a while the really believe they know more than the instructor giving the training.. All it takes is the wrong execution at the wrong time, to the wrong person and your life can become shit (not to mention they can die) this is why I took that shit very seriously.

Cellphone camera is the best thing that happened in this case
It won't bring him back
Yet it at least gave him a voice he would not have had without the footage

When a bystander asked "IS HE BREATHING?" he was already DEAD..but the PIG lied and said YES..in fact he was already dead from the time they all removed their hands from him...all the patting on the back, going through his pockets was done to give the illusion that maybe he was still alive to prevent a fucking riot. EXACTLY I was just about to state this same fact about the out ruling of the choke hold YEARS ago. This fool "SHOULD" be DONE! as a cop or anything else..PRISON TIME should follow for this killer..Lets SEE if this holds True in court or otherwise.

If a mofo resisting that is the perfect time to use pepper spray.. That shit usual fold mofos up quick

These ass clowns did neither.. They are finished and when the civil suit hits them pockets gonna be cleaned out too

I was just going to ask you about pepper spray. Those dudes went wwwwwaaaayyyyyy overboard. There were numerous ways to handle that situation. The first being to leave dude alone. They knew he wasn't selling cigs at that particular moment.

When they were doing into arrest him there was a uniformed officer there with OC spray..

Big man would have been yelling " I can't see instead of I can't breathe"

:hmm: Local in every hood in the United States....shit ain't local shit's pandemic!
:lol::smh::itsawrap:
Put it this way,all the black people the NYPD has killed...if they were white, there would be congressional hearings on the matter.

You can add police forces across the country...killings,abuse and all.
This, this, this, this, this........
The only way this going to is black folks have fight back. I mean when these cops start droping shit will change!!!
We have to fight back with espionage, though...
You mean with pay.
Exactly.
Bro non violence does work

Look what dr king accomplished
Non violence, as we are experiencing right now, has it's limits...
The police industry needs to be uprooted and new regulations imposed.

How about a zero tolerance for killing citizens that are not armed? Termination, felony and mandatory 5 year state prison sentence?

Always talking about accountability ...let's establish some in law enforcement. All actions have consequences police can't be exempt
Agreed.
You're missing the point.

1- he was not selling ANY cigarettes at the time of THIS arrest.

2- he had just broken up a fight. Like a Good Samaritan.

3- These same cops had been harassing him for months. When they heard a fight had happened over the radio... They assumed he was involved when they arrived at the scene.

4- the fight was over. They had nothing else to do... So they decide to arrest someone black. But not the parties involved.

5- they pulled his old records to justify their actions. ("Blame the victim" game.)

6- then tried to say they were there to arrest HIM for selling cigs (which he was not doing) in the aftermath.

The cops were not called for someone selling 50 cent "looseys". :smh: They were called to break up a fight. So they had no 'probable cause' to detain him in the first place. :smh:

That charge is about as significant as 'jaywalking', or ripping the tags off a mattress.

Black men should not be killed for bullshit like this by the cops.

Meanwhile white men are shooting up shopping malls & schools full of women & kids with AUTOMATIC WEAPONS but are allowed to LIVE long enough to 'stand trial' and have their day in court.

Those are the folks that YOU should be lecturing about 'morals' and family values.

If a black man should be choked to death for a few cigarettes.... What exactly should happen to these white folks out here who are shooting up shopping malls?

What is your opinion on that?

What do you have to say about THEIR 'morals' and 'home training'?

Citizens may resist unlawful arrest to the point of taking an arresting officer's life if necessary.” Plummer v. State, 136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John Bad Elk v. U.S., 177 U.S. 529. The Court stated: “Where the officer is killed in the course of the disorder which naturally accompanies an attempted arrest that is resisted, the law looks with very different eyes upon the transaction, when the officer had the right to make the arrest, from what it does if the officer had no right. What may be murder in the first case might be nothing more than manslaughter in the other, or the facts might show that no offense had been committed.”

“An arrest made with a defective warrant, or one issued without affidavit, or one that fails to allege a crime is within jurisdiction, and one who is being arrested, may resist arrest and break away. lf the arresting officer is killed by one who is so resisting, the killing will be no more than an involuntary manslaughter.” Housh v. People, 75 111. 491; reaffirmed and quoted in State v. Leach, 7 Conn. 452; State v. Gleason, 32 Kan. 245; Ballard v. State, 43 Ohio 349; State v Rousseau, 241 P. 2d 447; State v. Spaulding, 34 Minn. 3621.

“When a person, being without fault, is in a place where he has a right to be, is violently assaulted, he may, without retreating, repel by force, and if, in the reasonable exercise of his right of self defense, his assailant is killed, he is justified.” Runyan v. State, 57 Ind. 80; Miller v. State, 74 Ind. 1.

“These principles apply as well to an officer attempting to make an arrest, who abuses his authority and transcends the bounds thereof by the use of unnecessary force and violence, as they do to a private individual who unlawfully uses such force and violence.” Jones v. State, 26 Tex. App. I; Beaverts v. State, 4 Tex. App. 1 75; Skidmore v. State, 43 Tex. 93, 903.
“An illegal arrest is an assault and battery. The person so attempted to be restrained of his liberty has the same right to use force in defending himself as he would in repelling any other assault and battery.” (State v. Robinson, 145 ME. 77, 72 ATL. 260).

“Each person has the right to resist an unlawful arrest. In such a case, the person attempting the arrest stands in the position of a wrongdoer and may be resisted by the use of force, as in self- defense.” (State v. Mobley, 240 N.C. 476, 83 S.E. 2d 100).
“One may come to the aid of another being unlawfully arrested, just as he may where one is being assaulted, molested, raped or kidnapped. Thus it is not an offense to liberate one from the unlawful custody of an officer, even though he may have submitted to such custody, without resistance.” (Adams v. State, 121 Ga. 16, 48 S.E. 910).

Greeeeeeeeeeaaaaaaaaat drop!
That was a jumping and the improper way of restraining someone, I know some of the video was edited, but was he even placed under arrest and if so why wasn't he tased (or at least warned, before engaging in physicality, isn't that why they have that shit in the first place?) so they could properly handcuff and arrest..
End of story!

Thats the first thing they tell you yet Ive witnessed plenty of staff members choke residents in order to restrain them..
I bet you that cop been doing that shit for years and felt like a superhero, bringing bigger guys down, people that other cops was scared of..
In the city, they once had a team of bid ass make workers who were sent from home to home to deal with some of the bad ass older resident.
Those motherfuckers were more likely to shit like choke, just to keep up with their reputation.
All is good in the system eyes just as long as nothing happens, but as in this case watch then shit hard on duke knowing all along then condone that shit for years.
