Cops pull over Warrick Dunn:Characteristics of someone "transporting drugs and guns."

Re: Cops pull over Warrick Dunn:Characteristics of someone "transporting drugs and gu

Nahhh man! Trust me I don't think highly of police officers at all. In fact, a situation with VA Police was the motivation to become a lawyer and fuck with them.

What I do know is that in a court of law if a cop fucks you, they have to document the rape. I've read stop reports and sat in on police complaint hearings. Most of those pigs are banking on people not knowing the law to leverage their own basic understanding of Constitutional protections.

If a cop stops you and you're clean, you do more harm to the cop IF you exercise your rights. Yes you may be inconvenienced but the more people who exercise their rights, the less cops will jump the gun. DC Police don't get paid for coming downtown to justify a police complaint and don't like having that on their record.

Nice bit of info

Re: Cops pull over Warrick Dunn:Characteristics of someone "transporting drugs and gu

I'd rather be out in <5....but that's just me. Not to mention whatever the hell it was I was pulled over for in the first place being thrown in my face.... :dunno:
But your response is based off fear and speculation. The fact remains that in most instances, refusing to consent wont lengthen detention. The routine traffic stop will take place with or without consent. Once consent is refused you will generally be allowed on your way. Generally speaking of course.

In the instances that serve as the exception to the rule, at most you are detained the full 20minutes cops are legally allowed to detain you. Most traffic stops take somewhere in that area anyway. My point is why give up your rights to benefit the cop, save at most 5minutes of your time, or put yourself in a position to be fucked over by shady law enforcement.

I've already stated that my experience has been to the contrary. Consistently.

I've already stated that my experience has been to the contrary. Consistently.

I guess what I don't understand is; If you consent.... they search. If you don't consent... they may or may not search. But even if they search and stall your timeframe won't be any longer than those nightmare scenarios when you're sitting in your car for 20+ while they jack off. So why consent? Especially when your refusal benefits you in court and your consent doesn't?

Re: Cops pull over Warrick Dunn:Characteristics of someone "transporting drugs and gu

Frankly, I don't want to suffer the same fate as Rodney King.

Seeing cop protect cops, and there ain't a damn thing I can do is they wild out on me like that ... I just don't see the benefit in being defiant when I know I'm not riding dirty.

Call me a coward, but I prefer an unbruised body. You don't know which cops are capable of wildin' like that until it's too damn late.

Holy shit... :smh: We've lost already if people consider it being "defiant" to exercise their rights.

I implore all of you to go to your local district court and ask to observe any criminal proceeding or hearing. Police can be dirty, police can break the law, and there is a police fraternity. However, understand even if they lie for each other, in a court that is still only half the story. It's State v. ____ and judges and attorneys are not in that frat.

Can you explain your experience? Were you stopped and refused a search and a dog patrol came around?

Were you arrested?

How is any of that going to fix my beaten ass?

People will clown me, but the reality is, there is a lot of shit that we should take to the streets about, but motherfuckers sit in there house and bitch and moan about it.

Nobody trying to catch an ass-whooping or a bullet for some shit they can just not fuss about and go home. I've seen too much fuckery from cops in my day. Real foul shit. I don't know what to expect from those pigs, man.

I feel sorry for you brother. But be advised that the resulting misunderstanding or disagreements that may potentially result from consenting to search are far more likely to give rise to a "Rodney King" situation than a basic refusal to consent.

Fair enough man. Can't argue with that. But as Amajorfucup or youngmoney alluded to earlier there a limit to the "reasonable amount of time" that you can be detained without being charged. Once you're past the 30 min mark you can ask if you're under arrest. If not then you can ask if you're free to go.... it gets real tricky for law enforcement to play games at that point because you'll have a solid case for unlawful restraint at that point.

Actual lawyers feel free to correct me.

So you're saying that you've been stopped enough times to make a determination that giving consent to search results in a shorter detention than refusing consent? To make an accurate assessment i would guess you have been stopped (and asked to be searched) a lot. You must also have refused and granted consent on multiple occasions to draw your conclusion as well. How often are you stopped? And why are you constantly being searched?

 You know what, let me start again. I'm living in the East Coast, Washington D.C. Even in the worst parts of DC, MD, Bmore, if you're stopped and respectfully and calmly tell police that you got nothing to hide but you don't consent to a search, the cops won't beat you over the head or pull a gun on you.

Maybe y'all are from the South where cops get supremely out of pocket when they stop Black folk. But generally if you just say you respect their authority but don't consent to a search, that's it.

If a cop would beat my ass for CONSENTING, do you think not consenting to a search will make him show restraint, and follow proper procedure?

Dude, I'm from rural South Carolina. All that "Fight The Power" shit will surely get a foot broken off in your ass around here. A 5%'er I know was stopped by the cops, and he knew the laws backwards and forwards. They snatched my man locs out from the roots, and beat him within an inch of his life.

Their punishment?

Yeah, right.

Maybe I'd feel differently if I was raised in a different part of the country, but the cops around my way are on some next shit.

Edit: Motherfuckers around here come up missin' for fucking White women like it's the 1920's.

I dont follow. Why would a cop beat your ass for not consenting? And if such a cop does exist why do you think consenting will prevent him from beating your ass? If a cop is that much of a horrendous human being i dont think your consent will change his character.

There is indeed a limit to the amount of time a law enforcement can detain you during a routine traffic stop before that detention becomes unlawful.

Ok, you've managed to confuse the fuck out of me, homie.

You said the misunderstandings that will arise from consenting are more likely to cause a Rodney King type of situation that a basic refusal to consent.

I'm saying that if a cop is THAT kind of cap, refusing to consent will more than likely make him want to flex his muscle for my act of insolence. This is an unstable human being who has power issues, and refusal of consent is going to do exacerbate the situation.

It's like if a dude approaches you to rob you, and he WILL shoot. Is complying more likely to get your shot or telling him you're not going to give him your valuables?

I think we both know the answer to that question.

Re: Cops pull over Warrick Dunn:Characteristics of someone "transporting drugs and gu

There is no 30 minute limit.
Courts have said that the limit is one of a reasonable time span to conduct a routine traffic stop. That reasonable time frame has been stated as being between 20-30minutes. Im not telling you what i think or what i've googled or heard in the streets.

Law enforcement can NOT detain a citizen for an indefinite amount of time to conduct a routine traffic stop.

OK, i see your logic. I just dont equate exercising my constitutional rights with being confrontational with an assailant attempting to rob me. I see your point but i strongly disagree.

What i meant is that i have seen far more instances where a consent to search has resulted in adverse results for the citizen than a refusal has. A refusal cuts off discretion for the law enforcement officer (again, generally speaking) whereas consent opens pandoras box for all kinds of shit to subsequently follow (plants, arguments, unreasonable detention, destruction of property,etc.).

damn.....Warrick has been using his money for charity too....putting homeless women in houses.....

he s a standup dude .....sad

Re: Cops pull over Warrick Dunn:Characteristics of someone "transporting drugs and gu

I'm just mystified by some of the posts since I was last in this thread.

Asserting your rights doesn't really qualify as a "dick measuring contest" bruh. This isn't about ego.

It's sad that the balance of power has shifted so much towards law enforcement that asserting your basic rights is seen as stepping out of line or being difficult somehow.
Exactly.

These niggaz know their place dont they.:smh:

Apparently and that's sad.

I really don't understand the rationale. :smh:

"Why make things harder on yourself?".... well by the same token "Why make things easier for someone that doesn't necessarily have your best interests in mind?". Moreover we've already been given examples of how your "helpfulness" can fuck you over completely. Why are we ignoring the fact that almost all lawyers will advise you against consenting? (even the lawyers in this thread!) There are a thousand good reasons not to and not one intelligent reason in support of consenting has been offered in this thread.
Crazy shit.

Because fear trumps logic.

Frankly, I don't want to suffer the same fate as Rodney King.

Bruh, I'm in Charlotte and I've been ticketed for everything, from no insurance to expired tags/inspection to speeding to reckless driving and I've only had one cop be even a little out of pocket and even that was with his mouth, he never even threatened to be physical. The one that wrote the reckless driving ticket was in a rural area outside Charlotte (Concord for the locals) and he was almost apologetic for having to write the ticket. So I have no idea where this is coming from.

Remember: his late mother was an officer, that may have been on his mind when he was backtracking...

This was my thinking as well. It's personal to him why he backtracked.

Guys, you must also consider the source.

I am very paranoid. I sleep with a baseball bat; a gun; and a knife. I mean, you just never know what the situation will call for. I sleep as soundly as a new inmate at Rikers.

The great Biggie Smalls warned us that niggas will try to stick you for your paper.

What's being discussed here is the innocent who choose to consent, not the guilty.

Because you trust the police and the government, right.

What are you talking about?

I am talking about the essence of the 4th Amendment. What our citizens fail to understand is that very core of our Constitution is based on a mistrust of government (police).

This mistrust of the Founders was not based on whether they were personally guilty or innocent of some crime, but on their understanding of the nature of governments to abuse their power; therefore the issue was not guilt or innocence of any one person, but one's right to be free of unreasonable searches and seizures, whether guilty or innocent. Period.

And best believe that they would have NEVER considered consenting to any overreaching by the government....in those days the police wouldn't waste their time asking a citizen to voluntarily waive a right that they had fought so hard to get...that citizen would have laughed in their face.

Oh how we have fallen...to the point where citizens think that submitting to police power, (consent), when they do not have to, is in some way being a good citizen, when in fact it is exactly the opposite.

We say that the Legislative, Executive and Judicial are the three branches of government which keep each other in line through checks and balances. The assumption was that the citizens would keep the government in line.

The founders of the country would have never believed that a free man would willingly consent to waive a right that would allow an agent of the government to search his trunk, briefcase, wife's purse, children's back packs, glove box, phone, mail in the car, etc., and think that was being a patriot.

If you walked out and found your mom searching your car by going through everything in it, you most likely would say, respectfully, that those are my private things and I feel violated by your actions; but if a complete stranger does it that is ok....why?...because he has a police uniform on!!!! SMH
