Nahhh man! Trust me I don't think highly of police officers at all. In fact, a situation with VA Police was the motivation to become a lawyer and fuck with them.

What I do know is that in a court of law if a cop fucks you, they have to document the rape. I've read stop reports and sat in on police complaint hearings. Most of those pigs are banking on people not knowing the law to leverage their own basic understanding of Constitutional protections.

If a cop stops you and you're clean, you do more harm to the cop IF you exercise your rights. Yes you may be inconvenienced but the more people who exercise their rights, the less cops will jump the gun. DC Police don't get paid for coming downtown to justify a police complaint and don't like having that on their record.

But your response is based off fear and speculation. The fact remains that in most instances, refusing to consent wont lengthen detention. The routine traffic stop will take place with or without consent. Once consent is refused you will generally be allowed on your way. Generally speaking of course.

In the instances that serve as the exception to the rule, at most you are detained the full 20minutes cops are legally allowed to detain you. Most traffic stops take somewhere in that area anyway. My point is why give up your rights to benefit the cop, save at most 5minutes of your time, or put yourself in a position to be fucked over by shady law enforcement.

But even if they search and stall your timeframe won't be any longer than those nightmare scenarios when you're sitting in your car for 20+ while they jack off. So why consent? Fair enough man. Can't argue with that. But as Amajorfucup or youngmoney alluded to earlier there a limit to the "reasonable amount of time" that you can be detained without being charged. Once you're past the 30 min mark you can ask if you're under arrest. If not then you can ask if you're free to go.... it gets real tricky for law enforcement to play games at that point because you'll have a solid case for unlawful restraint at that point.

Actual lawyers feel free to correct me.

So you're saying that you've been stopped enough times to make a determination that giving consent to search results in a shorter detention than refusing consent? To make an accurate assessment i would guess you have been stopped (and asked to be searched) a lot. You must also have refused and granted consent on multiple occasions to draw your conclusion as well. How often are you stopped? And why are you constantly being searched?

Dude, I'm from rural South Carolina. All that "Fight The Power" shit will surely get a foot broken off in your ass around here. A 5%'er I know was stopped by the cops, and he knew the laws backwards and forwards. They snatched my man locs out from the roots, and beat him within an inch of his life.

Courts have said that the limit is one of a reasonable time span to conduct a routine traffic stop. That reasonable time frame has been stated as being between 20-30minutes. Im not telling you what i think or what i've googled or heard in the streets.

Law enforcement can NOT detain a citizen for an indefinite amount of time to conduct a routine traffic stop.

OK, i see your logic. I just dont equate exercising my constitutional rights with being confrontational with an assailant attempting to rob me. I see your point but i strongly disagree.

What i meant is that i have seen far more instances where a consent to search has resulted in adverse results for the citizen than a refusal has. A refusal cuts off discretion for the law enforcement officer (again, generally speaking) whereas consent opens pandoras box for all kinds of shit to subsequently follow (plants, arguments, unreasonable detention, destruction of property,etc.).

Bruh, I'm in Charlotte and I've been ticketed for everything, from no insurance to expired tags/inspection to speeding to reckless driving and I've only had one cop be even a little out of pocket and even that was with his mouth, he never even threatened to be physical. The one that wrote the reckless driving ticket was in a rural area outside Charlotte (Concord for the locals) and he was almost apologetic for having to write the ticket. So I have no idea where this is coming from.

I am talking about the essence of the 4th Amendment. What our citizens fail to understand is that very core of our Constitution is based on a mistrust of government (police).

This mistrust of the Founders was not based on whether they were personally guilty or innocent of some crime, but on their understanding of the nature of governments to abuse their power; therefore the issue was not guilt or innocence of any one person, but one's right to be free of unreasonable searches and seizures, whether guilty or innocent. Period.

And best believe that they would have NEVER considered consenting to any overreaching by the government....in those days the police wouldn't waste their time asking a citizen to voluntarily waive a right that they had fought so hard to get...that citizen would have laughed in their face.

Oh how we have fallen...to the point where citizens think that submitting to police power, (consent), when they do not have to, is in some way being a good citizen, when in fact it is exactly the opposite.

We say that the Legislative, Executive and Judicial are the three branches of government which keep each other in line through checks and balances. The assumption was that the citizens would keep the government in line.

The founders of the country would have never believed that a free man would willingly consent to waive a right that would allow an agent of the government to search his trunk, briefcase, wife's purse, children's back packs, glove box, phone, mail in the car, etc., and think that was being a patriot.

If you walked out and found your mom searching your car by going through everything in it, you most likely would say, respectfully, that those are my private things and I feel violated by your actions; but if a complete stranger does it that is ok....why?...because he has a police uniform on!!!! SMH
