The NFL has the worst Union of all the major sports. Gene Upshaw is a weak man who is in the commissioners pocket. This would of never happened in baseball.

The problem for Vick is he didn't abide by the NFL Players contract, at least
according to the Falcons and now the arbitrator. Because he knowing lied
about his involvement in illegal activities prior to signing his $130 million
contact, he is in default of his contract. Therefore, again according to the
arbitrator, the Falcons were defrauded by Vick and are thus entitled to
the $19.9 million.

ATLANTA -- The Atlanta Falcons are entitled to recover nearly $20 million in bonus money paid to disgraced quarterback Michael Vick, an arbitrator ruled Tuesday. The players' union vowed to appeal.
Stephen B. Burbank, the University of Pennsylvania law professor and special master who led last week's arbitration hearing, sided with the team after hearing from Falcons president and general manager Rich McKay and attorneys from the NFL Players Association, which represented Vick.
The Falcons argued that Vick, who pleaded guilty to federal charges for his role in a long-running dogfighting operation, knew he was in violation of the contract when he signed a $130 million deal in December 2004.
The team said he used proceeds from the contract to fund his illicit activities and sought the repayment of $19,970,000 in bonuses he was paid out of a total of $22.5 million in 2005 and '06.
Vick was suspended indefinitely without pay by the NFL after entering into his plea agreement. He also lost millions in lucrative endorsement deals.
"We have reviewed the decision handed down by Special Master Stephen Burbank and believe it is incorrect," the NFLPA said in a statement. "We will now appeal his ruling."
The case now goes to U.S. District Court Judge David Doty in Minneapolis, who still has jurisdiction over the antitrust suit filed by players following the 1987 strike.

He wasn't a franchise player. Again you have to understand the wording of the contract. Signing bonuses are garaunteed only if you are on the team. If you get hurt they have to pay you but, if you fukk up like he did they can get their cash back.

A signing bonus should be just that, a bonus for signing the contract. Untouchable once that is done. If not, then whats the point? They cant give him back all the sweat, hard work, Pain and time he put into being the Falcons quarterback, why should he give back what he was paid? (I am not a Vick fan, just making a point that could apply to any player) All that being said, I knew they were gonna bleed him dry just for the sheer pleasure of it. This verdict was never in doubt.

"It is the first step in a process that our club has undertaken in an attempt to recoup significant salary-cap space that will allow us to continue to build our football team today and in future years."

The decision by Philadelphia-based Burbank broke from a previous ruling he made -- one that involved former Falcons wideout Ashley Lelie and the Denver Broncos -- that stated NFL teams could collect only signing-bonus money for players deemed to have breached their contract.
Burbank's ruling in the Vick-Falcons case said the Falcons are entitled to pursue the recovery of signing, option and roster bonuses because payments to Vick were not for money earned, as in the Lelie case, but for future services that can't be earned because the NFL has indefinitely suspended Vick.
Vick was punished by the league after pleading guilty to interstate dogfighting charges in August. Vick is awaiting sentencing Dec. 10 and faces up to five years in prison. He also is facing state charges in Virginia.
The Falcons are trying to recover bonus money from the 10-year, $130 million contract extension Vick signed after the 2004 season.
"We have reviewed the decision handed down by Special Master Stephen Burbank and believe it is incorrect," the NFL Players Association said in a statement. "We will now appeal his ruling to Judge [David] Doty in Minneapolis."

The ramifications of this case could be profound, which is why the players' union immediately drew up papers to file an appeal of Burbank's decision.
