Damn, I thought the signing bonus was guaranteed. Isn't that part of the reason why the players agreed to the franchise, restricted labels?

The problem for Vick is he didn't abide by the NFL Players contract, at least
according to the Falcons and now the arbitrator. Because he knowing lied
about his involvement in illegal activities prior to signing his $130 million
contact, he is in default of his contract. Therefore, again according to the
arbitrator, the Falcons were defrauded by Vick and are thus entitled to
the $19.9 million.

NFLPA to appeal arbitrator's ruling that Falcons can reclaim Vick bonuses

Associated Press

Updated: October 9, 2007, 6:31 PM ET

ATLANTA -- The Atlanta Falcons are entitled to recover nearly $20 million in bonus money paid to disgraced quarterback Michael Vick, an arbitrator ruled Tuesday. The players' union vowed to appeal.

Stephen B. Burbank, the University of Pennsylvania law professor and special master who led last week's arbitration hearing, sided with the team after hearing from Falcons president and general manager Rich McKay and attorneys from the NFL Players Association, which represented Vick.

The Falcons argued that Vick, who pleaded guilty to federal charges for his role in a long-running dogfighting operation, knew he was in violation of the contract when he signed a $130 million deal in December 2004.

The team said he used proceeds from the contract to fund his illicit activities and sought the repayment of $19,970,000 in bonuses he was paid out of a total of $22.5 million in 2005 and '06.

Vick was suspended indefinitely without pay by the NFL after entering into his plea agreement. He also lost millions in lucrative endorsement deals.

"We have reviewed the decision handed down by Special Master Stephen Burbank and believe it is incorrect," the NFLPA said in a statement. "We will now appeal his ruling."

The case now goes to U.S. District Court Judge David Doty in Minneapolis, who still has jurisdiction over the antitrust suit filed by players following the 1987 strike.

He wasn't a franchise player. Again you have to understand the wording of the contract. Signing bonuses are garaunteed only if you are on the team. If you get hurt they have to pay you but, if you fukk up like he did they can get their cash back.

America has been on a serious ass witch hunt for any rich and famous black person...we need to form a private party aside from any government policy and take Black America back. Educate our young men and women so that they don't continue to fall prey to America's unwritten policies against us. Until we seriously organize behind closed doors and get our shit together we won't be equipped to handle the Amerikkkan agenda. Remember it's election year and anything goes against any black man, woman or child. Don't forget Mike Tyson, Michael Jordan, Marion Jones, Barry Bonds...and the little black girl that was recently punched in her damn mouth by a white cop.

True, but that goes back to this weak ass union NFL players have. Can you see MLB taking a dime of Jason Giambi's (already earned)money? Ron Artest?
A signing bonus should be just that, a bonus for signing the contract. Untouchable once that is done. If not, then whats the point? They cant give him back all the sweat, hard work, Pain and time he put into being the Falcons quarterback, why should he give back what he was paid? (I am not a Vick fan, just making a point that could apply to any player) All that being said, I knew they were gonna bleed him dry just for the sheer pleasure of it. This verdict was never in doubt.

its not a guaranteed win either this case isnt finished
the falcons argued the roster bonus was payment for services rendered but was payment for future service :hmm: meanwhile he met all conditions to receive the bonuses in the past for the stated reasons the bonus was given
- being on the fuckin roster

the union might sabotage it to let the owners win- i could see that and probably expect it

NFL players are the dumbest faggots in all of professional sports - the shit is totally pathetic - that goes for all current players and most from the past 20 years

THIS IS NOT A UNION ISSUE!!!!!!!!!! YOU CAN NOT COLLECT A ROSTER BONUS IF YOU ARE NOT ON THE ROSTER!!!!!!!!!!!!!!!!!!!!!!!!

did Mike Vick pay union fees for nothing?

Union dues don't do anything for someone that LIES BEFORE SIGNING A CONTRACT, and then reneges on major provisions within the contract!

In other words, Union Dues won't make MIRACLES from stupid decisions.

He just needs to hide that money right now and leave for Brazil, assuming he has that much left. I am sorry, I'd have to take the low road out if I were him, they ain't getting shit back from me. Not after risking life and limb to perform and entertain and make money for all those bastards

Why do folks fail to see that Vick fucked himself up. We're all imperfect, but he is really stupid.

THIS IS NOT A UNION ISSUE!!!!!!!!!! YOU CAN NOT COLLECT A ROSTER BONUS IF YOU ARE NOT ON THE ROSTER!!!!!!!!!!!!!!!!!!!!!!!!

I'm not sure why your yelling, It's no one on this boards money. But the money in question has already been paid when he was on the roster. No one is debating his future checks.

Falcons could recoup $19.97 million from Vick
Arbitrator's ruling clears path, but lengthy process still expected

An arbitrator made a key ruling Tuesday that clears the path for the Falcons to recoup $19.97 million in bonuses from suspended quarterback Michael Vick.

"We are certainly pleased with today's ruling by NFL Special Master Stephen Burbank," the Falcons said in a release. "It is the first step in a process that our club has undertaken in an attempt to recoup significant salary-cap space that will allow us to continue to build our football team today and in future years."

The decision by Philadelphia-based Burbank broke from a previous ruling he made -- one that involved former Falcons wideout Ashley Lelie and the Denver Broncos -- that stated NFL teams could collect only signing-bonus money for players deemed to have breached their contract.

Burbank's ruling in the Vick-Falcons case said the Falcons are entitled to pursue the recovery of signing, option and roster bonuses because payments to Vick were not for money earned, as in the Lelie case, but for future services that can't be earned because the NFL has indefinitely suspended Vick.

Vick was punished by the league after pleading guilty to interstate dogfighting charges in August. Vick is awaiting sentencing Dec. 10 and faces up to five years in prison. He also is facing state charges in Virginia.

The Falcons are trying to recover bonus money from the 10-year, $130 million contract extension Vick signed after the 2004 season.

"We have reviewed the decision handed down by Special Master Stephen Burbank and believe it is incorrect," the NFL Players Association said in a statement. "We will now appeal his ruling to Judge [David] Doty in Minneapolis."

Should Doty reverse Burbank's decision, the case could be re-filed with new arguments. Falcons owner Arthur Blank, in an August news conference, said the franchise would aggressively pursue repayment.

If Doty upholds the ruling, the Falcons would then file for repayment with a non-injury grievance arbitrator. Despite Burbank's quick ruling after hearing arguments on Friday, a final outcome could take months.

Should the Falcons ultimately win the case, any money received from Vick would be credited to the team's salary cap the following year. The windfall of cap space the Falcons would receive if Vick were to reimburse full payment would provide the them with enough money to pursue several front-line free agents.

The ramifications of this case could be profound, which is why the players' union immediately drew up papers to file an appeal of Burbank's decision.

Should the Falcons ultimately win this case, teams throughout the league could make use the same argument to recoup bonus money paid to players found to have violated terms of their contract. If Doty overturns Burbank's ruling, that would uphold the precedent in the Lelie case in which the only money Denver was able to recoup was the prorated portion of Lelie's signing bonus.:smh:
