The bitter wife of an NYPD cop who beat a rape rap sneered yesterday that her husband's accuser is a money-grubbing liar who should be jailed herself.
"She can go to hell," ranted Julia Moreno, wife of veteran cop Kenneth Moreno, 43, who was acquitted last week along with partner Franklin Mata, 29, after a sensational two-month trial.
"She should go to jail for this," the wife barked in a bitter attack sure to outrage the accuser's legions of supporters. "She had two days to make up this story with her lawyer friends before she went to the hospital."

In a shocking verdict that followed graphic, gripping testimony from the accuser, Moreno and Mata beat rape and burglary raps Thursday but were convicted of official misconduct. They were immediately fired and stripped of their pensions by the NYPD.
The accuser and the cops crossed paths on Dec. 7, 2008, after she spent a night partying with friends in Park Slope, Brooklyn, and her friends called a cab to take her back to her Manhattan apartment on East 13th Street. Concerned that the drunken woman, who had vomited in the car, couldn't get into her five-story walk-up safely on her own, the cabby called 911, and Moreno and Mata responded.
Video evidence showed Moreno, a 17-year veteran, and Mata, who had three years on the force, helped the woman upstairs, spent seven minutes inside, and then returned three more times during the night to check on her. The pair, who used the woman's own key to get back inside, admitted in court to faking a 911 call in the accuser's neighborhood to cover up one of the return trips.
Moreno, a father of two, had claimed he was a recovering alcoholic himself, and sympathetic to the woman's plight. He admitted only to cuddling with the woman in her bed while she was clad in just a pink bra.
His wife said she is standing by him.
"I know him. He's the guy on the force that they call to take home partners' girlfriends when they're too drunk. He's trusted by everyone. He's been on the force 18 years without ever having any incident with women," she said.
Moreno and Mata face a June 28 sentencing, in which each could still face up to two years behind bars on the official-misconduct convictions.

The former East Village woman who accused two city cops of rape spoke out Tuesday, saying "my heart broke" when a jury acquitted them of a sexual assault rap.
"I have waited two and half years for closure that will now never come," the now 29-year-old accuser said in a statement.
"Hearing that verdict brought me to my knees; it brought me back to my bedroom on that awful night when my world was turned upside down by the actions of two police officers who were sent there to protect, but instead took advantage of their authority and broke the law."

The fashion executive, who now lives in San Francisco, was referring to Kenneth Moreno and Franklin Mata, who were fired immediately after the jury last week acquitted them of rape but found them guitly of official misconduct.
"Everything they say about the difficulties of a rape trial is sadly true," she wrote.
"One's word is not enough in these days of CSI and DNA. Even if people believe you, you are tested beyond what any crime victim should have to endure."
The accuser said she was "utterly" disheartened at being forced to answer "personal questions about your body, your intimate life and your social life simply because you dare to come forward."
The woman praised Mayor Bloomberg and Police Commissioner for quickly canning the cops and yanking their pensions. She noted that "not a single officer in uniform sat behind the defendants when I testified."
"That speaks volumes," she wrote.
She also heaped praise on the prosecutors from the Manhattan District Attorney's Office, singling out Coleen Balbert, Edward Tacchi, Randolph Clarke and Dianne Spence.
"I cry as I write this because I know they are hurting just like me," she wrote. "They gave me a voice after a night when I had none."
The accuser thanked the many people in New York and around the country who spoke up "in my honor."
"I am overwhelmed by your support," she wrote. "I want you to know that if I could I would shake your hand, I would hug you, and I hear you. For me, public opinion will be the ultimate verdict."
Mata and Moreno could still face up to two years in jail when they are sentenced on June 28.
Juror interviewed after the verdict was announced said the accuser was "really believable" but there was no DNA to back up her claim of rape.
They said her testimony was tainted by her admission that she was bombed and blacking out when she encountered the cops in December 2008.
The jury verdict came after a six week trial during which prosecutors insisted Moreno brutally raped the woman while Mata stood lookout.
Moreno later called the woman a liar and stuck to his story that he and Mata visited her apartment three times after the initial encounter to help her through a bender.

Two cops whose acquittal for raping a drunken woman in her East Village apartment stunned the city have now cooked up an “absurd” argument to overturn their convictions on lesser charges.
Disgraced ex-officers Franklin Mata and Kenneth Moreno were only convicted of official misconduct after the Dec. 7, 2008, alleged sex attack.
The cops initially helped the fashion executive into her E. 13th St. apartment — but then returned three times during the early morning.
The cops admit they were singing Bon Jovi songs, spooning the woman, counseling her on alcoholism and dozing off on the couch during the nocturnal visits— but argue in their appeal that the goofing off can’t be considered official misconduct because there was nothing official about it.
And, they argue, the charges should be dropped because they didn’t materially benefit from the shenanigans. “If a DA smokes a cigarette outside the courthouse while he’s on the clock, is he guilty of official misconduct?” asked Mata’s attorney, Edward Mandery.
“If it’s not related to your official duties, it’s not misconduct. Going to check up on a woman that is drunk is not part of their job, but it shouldn’t constitute a crime.”
But Manhattan Assistant District Attorney Hilary Hassler slammed Mandery's argument as "absurd" in court papers.
She said their twisted appeal ignores “the ample proof — including their own testimony — that defendants returned to the building so that Moreno could pursue his sexual interest in” the woman.
The woman claimed Moreno raped her while she was passed out, with Mata keeping watch in the living room.
Both officers were cleared of rape during a May 2011 trial, but they were convicted on two counts each of official misconduct.

They're both fuckin' idiots. They've both been cops long enough to know that you don't put yourself in a position where anyone can say anything bad about what you do. They lost their jobs and pensions because of a drunk piece of ass. They didn't get hit with rape and burglary, but the official misconduct charge is dead on. They go back and forth to her apartment to "check on her"? They got her home and if they were concerned about her well-being, they should have taken her to the hospital or called a family member and/or friend to care for her. It's that simple. I don't think she was raped, but those morons are lying about what happened.

Kenneth Moreno, 46, acquitted of the on-duty rape of a fashion executive in her East Village apartment in December 2008, says she is “nothing more than an opportunist.”
He said she falsely accused him of rape, causing him to be railroaded by Manhattan prosecutors who overlooked her credibility issues and the lack of forensic evidence to back up her claim of rape or even sexual intercourse.
Moreno’s false arrest suit further accuses the woman and civil attorney Yasmin Saeed of maliciously filing a $57 million lawsuit “to extort monies” from him and the city.
I don’t want to be known as the ‘rape cop.' It’s horrible.
The 32-year-old accuser, now living in San Francisco, could not be reached for comment.
Her suit was tossed last year by a federal judge who ruled there was no evidence to back up her allegations that the city was negligent in the hiring and supervision of Moreno. She appealed the ruling and her suit was shot down a second time.
Saeed declined to comment. A spokeswoman for the city Law Department said the allegations will be reviewed when city lawyers receive the papers.

After a nearly two-month trial in 2011, Moreno and his partner, Franklin Mata, were convicted only of official misconduct for being in the woman’s apartment when they were supposed to be on patrol.
Moreno was sentenced to one year in prison and served about nine months behind bars with a rogues’ gallery of killers, including accused serial killer Salvatore (Son of Sal) Perrone.
“I tried to get through (jail) a day at a time but there was always the presence of danger and animosity,” Moreno said Wednesday in an exclusive interview with The News.

These days, Moreno tries to find work as a general contractor, showing up at construction sites with his tools, he said.
“There were some carpenters one day and one of them asked me if I was the ‘rape cop,’ ” he said. “They asked me to leave so I lost a job that day.
“I don’t want to be known as the ‘rape cop,’ ” he continued. “It’s horrible.”

Moreno and Mata had encountered the drunken woman Dec. 7, 2008, to help her out of a cab in front of her E. 13th St. building. Moreno admitted at the trial that they flirted and cuddled in her bed while Mata slept on the couch, but insisted he rebuffed the woman when she tried to kiss him and “grab me below the waist.”
“I held her for maybe five seconds,” he said. “My boots, my pants, my gun belt, my shirt, my vest, never came off. She wasn’t raped and we didn’t have sex.”
Moreno’s lawyer Eric Sanders said the suit, filed in Bronx Supreme Court, is intended to recover monetary damages and restore the ex-cop’s reputation.
“The prosecutors wanted to make a name for themselves and left him with a scarlet letter,” Sanders said.
Linda Fairstein, former chief of the Manhattan district attorney’s office sex crimes unit, defended her colleagues and the victim. “There was enough basis in fact for her case and I think she was extraordinarily courageous,” Fairstein said.

Her suit was tossed last year by a federal judge who ruled there was no evidence to back up her allegations that the city was negligent in the hiring and supervision of Moreno. She appealed the ruling and her suit was shot down a second time.
Saeed declined to comment. A spokeswoman for the city Law Department said the allegations will be reviewed when city lawyers receive the papers.

Ex-cop Kenneth Moreno at his home in Sunset Park, Brooklyn, wants his accuser to help him get his life back.
After a nearly two-month trial in 2011, Moreno and his partner, Franklin Mata, were convicted only of official misconduct for being in the woman’s apartment when they were supposed to be on patrol.
Moreno was sentenced to one year in prison and served about nine months behind bars with a rogues’ gallery of killers, including accused serial killer Salvatore (Son of Sal) Perrone.
“I tried to get through (jail) a day at a time but there was always the presence of danger and animosity,” Moreno said Wednesday in an exclusive interview with The News.

These days, Moreno tries to find work as a general contractor, showing up at construction sites with his tools, he said.
“There were some carpenters one day and one of them asked me if I was the ‘rape cop,’ ” he said. “They asked me to leave so I lost a job that day.
“I don’t want to be known as the ‘rape cop,’ ” he continued. “It’s horrible.”

Moreno and Mata had encountered the drunken woman Dec. 7, 2008, to help her out of a cab in front of her E. 13th St. building. Moreno admitted at the trial that they flirted and cuddled in her bed while Mata slept on the couch, but insisted he rebuffed the woman when she tried to kiss him and “grab me below the waist.”
“I held her for maybe five seconds,” he said. “My boots, my pants, my gun belt, my shirt, my vest, never came off. She wasn’t raped and we didn’t have sex.”
Moreno’s lawyer Eric Sanders said the suit, filed in Bronx Supreme Court, is intended to recover monetary damages and restore the ex-cop’s reputation.
“The prosecutors wanted to make a name for themselves and left him with a scarlet letter,” Sanders said.
Linda Fairstein, former chief of the Manhattan district attorney’s office sex crimes unit, defended her colleagues and the victim. “There was enough basis in fact for her case and I think she was extraordinarily courageous,” Fairstein said.
