A 27-year-old man was shot and killed by Atlanta police Friday evening during a struggle in a Wendy’s drive-thru line, the GBI said.
The incident began about 10:30 p.m. outside the fast food chain on University Avenue, GBI spokeswoman Nelly Miles said.

Officers were called to the restaurant after receiving a complaint about a man asleep in his vehicle, which forced other customers to go around his car to get their food at the window. The man, Atlanta resident Rayshard Brooks, was given a field sobriety test, which he reportedly failed, according to the GBI.

“After failing the test, the officers attempted to place the male subject into custody,” Miles said. “During the arrest, the male subject resisted and a struggle ensued. The officer deployed a Taser.”

According to police, Brooks managed to take the Taser away from the officer before being shot.
He was taken to the hospital and later died, Miles said.
Cellphone video apparently captured by a Wendy's customer appears to show two officers struggling with Brooks in the parking lot. He appeared to be running away from the police when he was fatally shot.

Additional details surrounding the shooting are unclear. The GBI said an Atlanta officer involved in the incident suffered minor injuries. The officer was treated at the hospital and released.

The incident marks the 48th officer-involved shooting the GBI has been asked to investigate this year. The Atlanta Journal-Constitution also tracks officer-involved shootings that don't involve the GBI, and those numbers sometimes differ from the GBI's tally.

2 officers weren’t able to subdue a drunk guy? How you get your taser taken away?
Always something with these damn cops
Yeah that's the part I don't get, how you get your taser taking away. To me it sounds like they just wanted to kill him and hoped that nobody filmed it.

"8Ball" said it best - " Cowards with a badge"... Never overstood how a person can be trained to be strong, athletic, and in such good shape, can't take down an average citizen with excessive force or needing help from his other coward ass, Buster Brown ass co-workers putting in work on a innocent... I really feel they are up against their match with this "New Generation"... They really have NO pause... Their thought process is of a different breed...

Instead of arresting him, they should have issued a citation, called for the vehicle to be impounded and have friend or family come pick him up. If there are none who will pick him up then take him home yourselves ... you were going to take him to jail, minus whale take him home, the city/PD could even charge him for the ride as part of the fine.

I can fuck with this sir. They so quick to want to arrest someone and granted you don't want him driving in his condition to affect others but a peaceful solution to a problem. When they had him outside the vehicle: take his keys, other customers were going around anyway, let him know he can either sit in his or the back of the squad car, ask him to phone someone or they can call family to come and get him and issue the citation from there.

People get arrested when they fail the DUI tests, what you said would be nice though.

cops dont give a fuck. they are under a microscope and still behaving in this manner.
Not going to give a person whose DUI then resisting arrest a pass but any Cop who uses deadly force when their life isn’t in danger needs to be charged with murder

‘Yep, you KNOW the country is in a uproar over police brutality and police killing black men. When you arrive on the scene that should be on your mind. You struggle with the man and he runs and the first thing pops into your mind is to pull your gun and shoot him in the back, come on man..smh

Like I said in the other post with this subject mayor bottoms needs to put her foot down with the police department they been doing some stupid shit lately I hate to put all of this on the chief but she going to have to get rid of the chief. Even back in the good old days of Atlanta we did not have these issues with the police department I really like the mayor I support her so she really has to do what she need to do at this point.

Dude is running away and they shoot him in the back because he had a tazer!?!? Yeah yeah we know cacs are already saying if he hadn’t resisted he’d be alive and all that blame the victim shit . When the fuck are cops allowed to just shoot anybody unarmed who runs?!?!? ATLANTA YOU BETTER RISE UP!!! I know that coon Tatum waiting to praise this death.

It don't look like he was shot in the back. He was shot when he turned and pointed the taser. He didn't deserve to die but the brother should have been smarter in regards to his actions.

I just had a heated 'debate' with 2 mandated black firefighters on my job. They think the cops were right. We had to agree to disagree and move on

The discussion shouldn’t have been “Heated”.

You should’ve simply asked them, “Were the officers lives in danger when he was running away with the taser”?

If the answer was yes, then they were justified.

If the answer was no, then the shooting wasn’t justified.

They say yes, because he stole the taser after the fight on the ground and he could've used it against them, or someone else. You're right, I probably shouldn't have gotten that worked up. Hard to reason with people who have gone through the police academy and have certain things drilled in thier heads.
