ATLANTA (AP) -- Fulton County police say a Marietta man is dead and his brother wounded by officers outside a bar.

Family members say 26-year-old Ron Pettaway died at the scene early yesterday. Twenty-seven-year-old Roy Pettaway the Third is in stable condition at Grady Memorial Hospital in Atlanta.

Police spokesman Corporal Gary Syblis says one of the brothers was in a fight inside the bar and then the two fought with police who arrived at the Frozen Palace near College Park. Syblis says charges are pending against the surviving brother.

But the men's father -- Roy Pettaway Junior -- says his sons were unarmed when they were shot. And the Reverend Markel Hutchins -- an activist who has been the spokesman for the family of a 92-year-old woman killed in a shootout with police last year -- met with family members yesterday afternoon and called for an investigation into the shooting.

Police did NOT respond to the family's claims -- saying they are investigating the shooting.

The Georgia Bureau of Investigation is investigating the shooting at the request of Fulton County Police Chief George Coleman.

I got the opposite only twice by white cops in the Cobb area. One gave me an insurance ticket even though I had insurance and the other wanted to do the same until I showed her the prior ticket. That was a few years back and pissed me off but that's been it.

IF they fought the police then they should have suspected some form of retaliation. I hear you man,but when I go to visit moms I am not their long enough to feel the cops wrath. When I have been pulled over though and show the ho-lice my Military Id they have just given me warnings who's to say I would have gotten treated differently if I was a civilian.

ATL is changing man for the worse Clayton County which I grew up in has been in the news alot lately especially hood ass RIVERDALE. When my fam moved there almost 15 years ago it was maybe 60% white/40% black. No need for me to say what the racial make up is now,I love my people but damn damn damn those niggas

I used to hang out, from time to time, in that joint, and it was hood back then...I doubt much has changed. They had the family & Rev Hutchins on the radio this morning. I got to hear some of it, and it sounds like a story you've heard so many times, you can't believe it actually happened..AGAIN. There's an altercation at a party/ club/ bar. The law is called. After that, the details vary slightly, but the bottom line is the same. Young Black men dead. There's no way to tell when you're going to be put in a confrontation with the law, but YOU CAN'T WIN A STREETFIGHT WITH THE PO PO. THE MOST IMPORTANT THING TO DO IF ONE ARISES, IS TO DIFFUSE THE SITUATION, COOPERATE AND GET AN ATTORNEY. Like I said, I heard it second hand, so I only have one version of the story, but what could've caused cops to use deadly force for a supposed minor bar scuffle? If you shot one in the back of the head, and one in the back, how could they have been a threat to an officer? Over the last few years, there have been way too many instances of deadly force being used in questionable circumstances. Somebody's gonna have some splainin to do.
