Apple Sues Motorola Over Multitouch


Earlier this month, Motorola sued Apple for pretty much everything phone-related: MobileMe, the App Store, location based services, antenna design, and so forth. One thing Moto didn't mention however, was multitouch. So guess what happened? Apple decided to sue Motorola right back, filing two patent infringement lawsuits that cover six patents regarding, you guessed it, multitouch.

In the filing, Apple states the infringing products as: the Motorola DROID, DROID 2, DROID X, CLIQ, CLIQ XT, BackFlip, Devour, Devour i5, and Charm 1. Which to say is pretty much every Motorola phone I can think of this side of RAZR.

The six patents in question, according to Patently Apple">:

One: Apple, Inc patent titled: Ellipse Fitting for Multi-Touch Surfaces: Patent Abstract: Apparatus and methods are disclosed for simultaneously tracking multiple finger and palm contacts as hands approach, touch, and slide across a proximity-sensing, multi-touch surface. Identification and classification of intuitive hand configurations and motions enables unprecedented integration of typing, resting, pointing, scrolling, 3D manipulation, and handwriting into a versatile, ergonomic computer input device.

Two: Apple, Inc patent titled: Multipoint Touchscreen: Patent Abstract: A touch panel having a transparent capacitive sensing medium configured to detect multiple touches or near touches that occur at the same time and at distinct locations in the plane of the touch panel and to produce distinct signals representative of the location of the touches on the plane of the touch panel for each of the multiple touches is disclosed.

Three: Taligent, Inc patent titled: Object-Oriented System Locator System: Patent Abstract: A method and system for adding system components (documents, tools, fonts, libraries, etc.) to a computer system without running an installation program. A location framework is employed to locate system components whose properties match those specified in search criteria. The framework receives notification from the system when system components whose properties match the search criteria are added to or removed from the system.

Four: Apple, Inc, patent titled: Touch Screen Device, Method, and Graphical User Interface for Determining Commands by Applying Heuristics: Apple's invention generally relates to electronic devices with touch screen displays, and more particularly, to electronic devices that apply heuristics to detected user gestures on a touch screen display to determine commands.

Five: Apple Computer, Inc. patent titled: Method and Apparatus for Displaying and Accessing Control and Status Information in a Computer System: Apple's invention generally relates to the field of computer systems; particularly, the present invention relates to displaying a status and control function bar or window to enable access of user selected indicia to a computer system user.

Six: Apple Computer, Inc. patent titled: Support for Custom User-Interaction Elements in a Graphical, Event-Driven Computer System: Apple's invention relates to graphical, event-driven computer systems, more particularly to custom interactive user-interaction elements in a computer system having a window-based graphical user interface.

Won't hold up in court. Multitouch was out before Apple claimed it was theirs. In fact has Apple won any of these suits?

nope, they always lose in court in big cases... but if u search the patent records htc and motorola are use muli-touch based on a different method but of course apple with their broad non-specific patents is tryin to claim ALL multi-touch for example htc's is based on human heat and electricity so unless apple claims they invented that(which with their arrogance they will like they claim to invent everything) they'll lose that htc lawsuit and moto created the 1st iphone aka the itunes phone so they've had the patents longer than most except for palm, nokia and htc(who made touch screen phones b4 the iphone was even a thought) and have in depth knowledge of how to make an iphone

....apple is tryin to do what they always do and is gonna end up getting banned for sale in the usa b/c once they lose the other company won't license them just to fuck apple and jobs over like they r tryin to do to everyone else.

look at what htc, nokia want: for apple to be stopped for shipping and selling iphones with that tech, look at the elan lawsuit, it hasn't been tossed out b/c they may in fact own multi-touch and won't settle like apple wants.

apple keeps suing ppl on some we own the world tip, gonna backfire on them big time. Hell ubuntu might sue apple b/c apple is using "launchpad" and "mission-control" which are ip's of ubuntu's parent company for the longest time, not to mention the osx app store which is a rip of the ubuntu store.

gonna be interesting how these lawsuits play out especially if apple loses and the rival companies refuse to license them patents.

None have gone to trial. Since the majority of companies have something that the other wants it's more than likely is going to end as a settlement. This happens all the time when something new gets popular.

nokia and htc requested if they win their cases for apple products using their ip be banned. if both companies win no law says they have to license anything to apple. they could just ask for apple to be banned.

IBM's patent's would probably end the touchscreen smartphone industry. if they ever were put on the market the bidding would hit a few billion....companies are lucky IBM doesn't make phones....kodak is a beast though....

Cash is king but after all the shots jobs takes at every rival company along with tryin to sue them out of business, cash might not matter anymore hell htc had its biggest quarter ever recently, i think samsung as well and nokia rules the world. nokia and htc don't seem to be in the need for money.
only company that looks to need money is rim but apple hasn't sued them yet.
rival companies don't like apple b/c of jobs it might be nice to take apple's money but its really nasty between apple and nokia like they hate each other, htc might license but nokia may not just so they can stick it to jobs.

it'll be interesting how these cases end up.

apple is products are made in another country, if they were a good american company they'd have a factory here in the usa but they don't so how american are they?... apple only has like 200 employees who could get jobs at other companies but the point is moot b/c it would only affect the mobile division... osx would still be around, not many jobs would be lost if iOS was shut down.

the gov't wouldn't change laws to save apple. iOS is not an essential tool it doesn't bring huge money to the economy not like the car industry, apple devices are not essential to living a full life they are luxury items and again macbook's, imacs, apple tv and osx won't go anywhere.

To change the laws the gov't would have to change the entire patent system and alienate other countries. we live in a politically correct world, the gov't would let apple die rather than piss off other nations.

The lawsuit is dealing with the camera part of the phones, mostly picture enhancement. Kodak also owned a decent amount of patents in Oled and SED screens, in fact the main reason Canon dropped SED based sets was because Kodak wanted too much money for the technology. Kodak sold most of it's oled technology to LG a year or so ago.

my judgment is fine, your nuts if you think the gov't would step in to prevent ONE company that outsources from being in trouble and change a shitload of laws to save ONE company. If it was an entire industry yeah they'd step in but apple is ONE company who brought the lawsuits. never before has the gov't stepped in to save ONE company. They've saved industries but not ONE company. would never happen.
 
Stop worry about some product getting banned if one company wins over another. it's a tactic to get the other party to settle. Again, this is nothing new.

And for what it's worth, the lawsuit Apple lost was on CoverFlow, and a few days after the verdict they received a patent on the design of it, number D624,932. There's also proof that prior art was used in HyperCard. The verdict is being appealed so it's not over yet.
