Airbnb Tenant Refuses to Leave - What Would You Do?

Damn. You muhfuckas ain’t never heard of an eviction? In Texas give the bitch 3days move out notice. When she doesn’t move out, then file an eviction and you will be in court within 10 days. The court will give her a certain number of days to move out and when she doesn’t move out, call the constable who the court will have already provide with what’s called a writ of possession and that writ of possession orders the constable to put the property back in the possession of the true owner. He will drag that bitch out by her hair if he needs to.

But the police are not going to just come out and put her out based on a contract without some order from a court telling them they have the right to do that. Police don’t interpret contracts.

Yep...that is why I prefaced it with Texas. And my point is that it can be done....it is one of the costs of that kind of business. So all that talking back and forth is just wasting time....understand the law for your state and get to it.

Your friend got her out after 2 months.....longer than it would take in Texas, but not an unreasonable amount of time to wait to make more loot.

Oh yes yes, this is (scenario) is 100% real, whether this story is real or not. Out my way Cali, Oakland, and other parts of the Bay Area where these lop-sided rent control ordinances live and breathe, this is a very ordinary situation. I personally know of a situation that has gone on like this, after the expiration of an Airbnb contract term where the person / tenant has occupied a woman's dwelling since 2019, RENT FREE to this very moment!!! Self-Help eviction remedies / tactics ( turning off utilities in any manner is forbidden by the California Penal code and most city / municipality ordinances that employ "rent control" policies. Violations of these laws are "arrestable, take into custody immediately" violations, as opposed to a cite and release deal. On average my way, it will take a landlord 15 to 18 months to "lawfully" evict a tenant. On the day of the jury trial, which the tenant will opt for because it is their right to a trial by jury, the tenant will be a no-show. The landlord will receive a default judgment against the tenant with a court order to enter the property and regain occupancy, where they usually find the unit / residence nearly destroyed. Therefore they have missed rent payments for 15 to 18 months, $$$, plus damages to the dwelling which will now cost them materials & labor to repair, $$$$!!! There is an excellent 90's movie called "Pacific Heights", set in the San Francisco area that covers this nightmare. Any time someone asks me my opinion about delving into the landlord game in Cali, I tell them to find and watch this movie, then let's talk afterward!!!

I was on jury duty for some bullshit like this in LA and it took 18 months to get the court to hear this. We had a verdict in 2 minutes…:hmm:
 
This wasn't an Airbnb. Airbnb should sue her for libel just on principle. You can put all of your terms and conditions for your Airbnb before a customer accepts. Hell you can turn it into an Apple update contract if you want to.
