Judge Gives McNair's Widow, Children $500,000 Each

NASHVILLE, Tenn. (AP) — The widow of Steve McNair has won a request to get $2.5 million from the late NFL quarterback's estate.

Mechelle McNair had asked a Nashville judge to unfreeze a portion of the estate so that she and Steve McNair's four sons could each have $500,000 until the probate case gets sorted out.

She and Steve McNair had two sons together. The other two are from previous relationships.

The estate of the former pro, who played 11 seasons with the Tennessee Titans and two with the Baltimore Ravens, was initially valued at $19.6 million. The bulk of his assets have been frozen since his death.

Steve McNair was 36 when he was killed by his mistress in July 2009. The woman shot him four times before turning the gun on herself.

He died without a will.

I laugh at this statement... if he died without a Will then anyone can try to stake claim. Mama, Daddy, Brothers, Sisters, Cousins, Great Aunts, Side Piece #3, Me, you, The Govt., The State... His dead uncles children... Shit gets deeper.

The estate still has to go through probate and a certain amount of time needs to pass.

Either he felt like he didn't need one... OR the Will could be "lost".

I have seen cases where the Will is purposely "did away with" due to its contents.

And its beyond sad and pathetic that this guy didnt have this shit situated and taken care of.

And in cases such as these states have intestate succession laws that go into effect and determine who gets what. Assets are typically frozen until its all sorted out.

Generally, if a decedent dies intestate (without a will) the property within his gross estate is distributed according to the intestate succession laws of the estate's jurisdiction.

Intestate succession laws are usually derived off common law consanguinity tables, family blood-line trees. Generally, the surviving spouse is entitled to a 1/3 to 1/2 elective share of the taxable estate, then the children each have equal shares of the remaining. If necessary, then surviving grandparents of the decedent take, then brothers and sisters, then cousins, etc.

In Tennessee, the intestate succession share for a surviving spouse with surviving children is 1/3. Tennessee is interesting as it treats children of the surviving spouse and decedent more favorably than children of the decedent that are not those of the surviving spouse. The widow's children will take more proportionately than McNair's other children.

A $20 million dollar estate is decent, so expect plenty of people popping out the woodworks with writings purporting to be the will or promises made by McNair.

Not really. Estate administration can go on for years and years after the decedent's death.

The 706 Estate Return is due 6 months after the decedent's death. Most executors and representatives file for a 6 month estate extension. The 706 lists all the items included in the decedent's gross estate, so rounding up McNair's $20 million worth of interests should take the whole year.

I don't know how Tenn. does it, but generally a few months after the 706 is filed and completed will the Judge listen to people's claims.

Bingo...I know on all my money and stuff at work I have someone set up as my beneficiary so there aren't' any issues. I also have stated if I ever die just cremate me.

I have a beneficiary but how do you go about "ensuring" you are cremated...I want to be cremated...my folks have said that God forbid I die before them that they wouldn't do it

In GA, this kind of petition is very common and it actually is preferred over other debts. It's called Year's support. If the person died without a will, a surviving spouse with minor children can file for support in form of property to be able to maintain themselves for 12 months at least.
