The death of a scooter-riding drug suspect — who crashed after an undercover NYPD sergeant threw a cooler at him in the Bronx — has been ruled a homicide, officials said Friday.
Eric Duprey, 30, died from “blunt force injuries of the head,” which he sustained Wednesday while fleeing a drug bust on Aqueduct Avenue near West 190th Street in Kingsbridge Heights, a spokesperson for the city medical examiner confirmed.
Duprey took off during a buy-and-bust operation conducted by the sergeant, Erik Duran, and was driving his scooter erratically on the street and sidewalk, sources have said.
During the escape attempt, Duran — who has since been suspended without pay — chucked a cooler at Duprey, striking him in the head from close range, according to surveillance footage of the incident.
After being hit, Duprey lost control and crashed into a parked car.
He suffered trauma to his body and was pronounced dead by EMS workers at the site of the crash.
The medical examiner ruled his death a homicide. Sources told The Post Duprey’s fatal injuries were caused by the crash.
Police said Duprey was running from cops after he sold drugs to the undercover officer.
Duprey’s mother, however, said the allegations were “all lies.”

“He wasn’t fleeing. He wasn’t fleeing. He was just on the motorcycle talking to me on the video chat. And he passed by that place when all of a sudden the call cut out,” Gretchen Soto told The Associated Press in Spanish.
Soto maintained her son’s innocence.
Duprey, a father of three young children under the age of 10, worked with the city’s Parks Department before taking a job as an Uber Eats driver.
“They left three fatherless babies,” Soto said. “I’m going to get justice.”

The Bronx Narcotics Unit member has been recognized by the department dozens of times for what it deems excellent and meritorious police service, according to a police personnel database.
He does, however, have a substantiated complaint on record from last year for abusing his authority during a stop, according to the city’s Civilian Complaint Review Board.
The NYPD sent out an internal memo to the department warning officers that Duprey’s death could spark a strong public reaction and “unrest.”
The notice advised officers to remind colleagues to keep their helmets and batons in their police cruisers and to set up barricades, especially at historic locations.

So Eric throws a 2-liter and the cop pays him back by throwing the whole cooler!

Suspended undercover cop Erik Duran will be cleared of any wrongdoing “once a full and complete investigation is conducted,” his lawyer declared.
Scooter-riding suspect Eric Duprey, 30, died when the undercover NYPD sergeant hurled a cooler at him, authorities said.
A grand jury is expected to weigh charges against Duran, according to a source.
But Duran’s attorney, Andrew Quinn, said the case is anything but open and shut.
“There is much more to this situation than the brief, 10 second video clip shows,” Quinn told The Post.
“What is indisputably clear is that the deceased, who was intent on evading arrest for selling drugs to an undercover officer, was speeding on a motorbike in an incredibly dangerous manner down a crowded sidewalk, jeopardizing the life and safety of everyone there.”
“Once a full and complete investigation is conducted, we are fully confident that Sgt. Duran will be exonerated of any misconduct or wrongdoing.”

I don't doubt for a hot second that cop will be exonerated. Eric Garner, was choked to death by Daniel Pantaleo, using and illegal hold. The same choke hold Officer Francis Livoti, used to killed Anthony Baez. However, Daniel Pantaleo, went on to make six figures a year for five years before being fired. Those pigs who murdered Ahmadou Dialo, went on to have long careers with NYPD. Where as this cop Duran, didn't shoot someone for fleeing. He threw a cooler at them. I doubt Duran, thought for a hot second that Duprey, would die as a result. It's fucked up that Duprey, died none the less. Still it's not the same as walking down a stairwell while being Black and being shot by some shook bitch ass Asian cop. Or the same as some pig running into your family's home to shoot you in the bathroom over a bag of weed.

You meant the maximum suspension without pay is 30 days for nypd. Not all suspension is without pay for 30 days. Sometimes it’s a loss of vacation days. Depending on disciplinary penalty.

They were setting up a sting to catch potential drug dealers. They never specified which drugs they were looking for. Please don’t point out how some areas have people carrying book bags of weed and people aren’t getting arrested. Washington heights been openly selling weed for decades when weed was illegal and many weren’t getting arrested then. You would’ve thought weed was legal than how them dudes were so out in the open selling 8ths, ounce, pounds but it wasn’t. Some areas just didn’t get pressed like others at time. An NYPD sergeant was charged Tuesday with second-degree manslaughter in the August death of a scooter-riding drug suspect who crashed after the cop threw a cooler at him.
Sgt. Erik Duran, 36, pleaded not guilty to that charge — which carries a potential maximum sentence of 25 years in prison — as well as assault in the first and second degrees and criminally negligent homicide for the death of Eric Duprey, 30, on Aug. 23, 2023, in The Bronx.
Duran was conducting a buy-and-bust operation on Aqueduct Avenue near West 190th Street around 5 p.m. in Kingsbridge Heights when Duprey took off on a motorized scooter, said New York Attorney General Letitia James’ office, which is handling the prosecution.
As Duprey made his escape, Duran grabbed someone’s cooler off a nearby table and threw it at the fleeing suspect, hitting him in the head and throwing him off balance, James’ office said in a statement.
Duprey sideswiped a tree before he was hurled from the scooter and banged his head on the curb, ultimately landing under a parked vehicle, the attorney general said.

Duran was suspended from the NYPD and later placed on modified duty following the incident, according to the AG.
He was released on a $150,000 bond — posted for him by prominent Big Apple bail bondsman Ira Judelson — following his arraignment in Bronx Criminal Court, where more than 100 cops turned out in support.
“This indictment sends a clear message to society and every law enforcement officer in the state,” John D’Alessandro, one of Duran’s lawyers, said in a statement after the hearing. “In today’s New York, the streets belong to the criminals.”
Duprey put “countless citizens and police officers in grave danger” when he hopped on the motorcycle as cops tried to arrest him, the attorney claimed.

Walter “Hawk” Newsome, co-founder of the New York chapter of Black Lives Matter, gave a press conference after court, telling reporters that Duran “was no hero” and that “You do not hit people with coolers.”
“I was afraid because it took too long, but I’m happy to see that justice delayed is not justice deferred,” he said.
Asked about the charges against Duran during his weekly press briefing Tuesday, Mayor Eric Adams, a former NYPD captain, said that, “The AG is leading that investigation and she’s going to make the final determination on how to move forward.”
“That’s not a policy that we use of throwing a cooler,” he added.
The Sergeants’ Benevolent Association union blasted James for bringing the charges against Duran.

“For a system that is a revolving door for those tearing apart the fabric of society to aggressively seek $150,000 bail for an NYPD sergeant with an exemplary reputation is both appalling and reprehensible,” Vallelong said in a statement.
“Make no mistake,” he added. “The SBA will aggressively defend Sgt. Duran throughout this egregious judicial ordeal.”
Vallelong claimed Duprey dangerously drove 40 mph down the sidewalk, endangering pedestrians and children, and would have crashed into cops standing there had Duran not stopped him.
“Sgt. Duran made a split-second decision to prevent serious injury or death to those citizens and officers,” the union chief said.
Without Duran’s efforts, Duprey would have “caused serious injuries or death to numerous people,” according to the SBA.

One law enforcement source told The Post that the NYPD Patrol Guide is “intentionally vague, but there’s no direct, ‘don’t throw stuff'”‘ directive.
“The public has increased its resistance to law enforcement, fueled by anti-cop sentiment from the City council and [the] governor,” another source said. “Lawlessness puts officers and the public at increased risk of physical injury and mental stress.”
Duran is due back before a judge on April 18.

I totally understand the sentiment. Albeit, I know that neighborhood all too well and hung out around there for years from the late 80's to mid 90's. I still know a couple people around there. In fact one of them died of a heart attack last week.

 
Don't do crime. Dude lost his life fleeing after selling narcotics. Had he crashed into someones family member and crippled or killed them the cops would be at blame from letting him escape riding a scooter on the sidewalk down a one way street the wrong way.

I don't get it either. I wonder if it would have been a problem had the cop hit the perp with a bullet. Meanwhile, Eric Garner, was murdered on camera with an illegal choke hold by Daniel Panteleo. Yet that devil Daniel Panteleo, worked another five years before he was fired by DeBlasio's, commissioner. So I really want to see where this trial goes.
