It's a good point, but I would argue two things-
Many of these privacy-intrusive policies like cameras being in places they haven't traditionally been come to us by way of the patriot act-and though much of the initial post-911 paranoia (imo) was bipartisan, there was and still is a very clear "If you aren't doing anything, you don't have anything to worry about" coming from one side of the political isle- and it's NOT the side that typically advocates for privacy.
THEY (congress) made these rules (you know, for the security of the country.... for FREEDOM!!) for the most part, are they themselves not subject to them?
the behavior itself and the lies/video evidence after are giving "Rules for thee, not for me"
Second, it's in public. Dark or not there should be no reasonable expectation of privacy in public.
