if the person who suing gonna get paid regardless kinda beats the purpose if they win or lose.. like I said the individuals I know who were cast to be on there or were offered to be on there told me they were gonna get paid in full regardless the outcome.. their case is for content.. it kinda beats the purpose of the show if you know the person who sues gonna get the bread.. some people do a lil extra acting/going into character for tv.. I haven’t seen an episode in probably damn near 2 decades so idk if that disclosure part you talking about was always there.. but trust most people aren’t aware of those stipulations
Well it's not suing anymore. They drop the suits, it's Arbitration. Most people don't even know that.
Second, you have to give people incentives to come on TV and makes fools of themselves or else you don't have a show.

Again, though EVERY case was an actually suit pending in small claims court and the decision is binding & final
