All crimes in California are deemed crimes against the people of the state / of California. Therefore it is the local District Attorney that desides whether to press charges or not, not necessarily the victim!!!

They said the girl he fucked didn't press charges so how can the roommate press charges for some that didn't even happen to her? I remember a similar case a couple of years ago where the video showed the guy and girl making out in the bar and going to the girls apartment, the video from that showed they were only inside a few minutes and then came out together and she later screamed rape, I think he was still charged, let me see if I can find it

Well, he / she got the original information from the primary responding police officers' police report(s). Now, depending on how in-depth they conducted their preliminary investigation, they either took a statement from the victim or friend or could have relied on any spontaneous statements made in their presence by any persons providing information regarding the crime at the time of reporting. Having enough, and the location of the possible suspect, they moved on that information. As far as the club video evidence, I would guess that the primary responding officers did not go and secure that video from the club or other locations, due to other calls for service coming in their beat / assigned area of patrol. The video(s) were probably sought / secured by the accused / suspect after arrest, booking, and charging. Trial / Court procedures regarding "Discovery" gets the video evidence to the DA which he / she must disclose to the Judge, and we get what we get in the end. Now, this is all supposition but it's good supposition as it represents the normal logical flow of street-level crime from arrest to the initial adjudication, IMHO.
Ole Boy needs to take this into Civil Court, that's where things like this are discussed. Unfortunately, he has to first consider is it worth it, having one's day in court is not free, there are costs that can grow significantly regarding court involvement. Additionally, does the chick come from some deep-pockets, there's no need in bringing a lawsuit seeking money that doesn't exist??? Even with a default judgment, the plaintiff must still seek out and prove the party has the ability to pay said judgment!!!
