New Music: Lizzo - Tempo feat. Missy Elliott

The Beatles haven't sued because they aren't even aware of that group.

Bullshit!

Paul McCartney and Ringo Starr are still alive and recording music. You don't think that one of them would have noticed that a song called "Black Beatles" was on the charts? you don't think that they had a line of lawyers outside their front door saying "maybe we should go over this just in case?"

I dont think they know about it. Nope.

You think they listening to Hot 97?

Hahaha.

If robin thicke can raked over the coals for doing a song that FEELS like a marvin gaye song then this case is stong for cece...

SETTLEMENT!

In other words, the only reason that Cece even has a case is because of a frivolous lawsuit where the defendant was successfully sued for being an asshole more than any actual infringement.

Unfortunately, that case set the precedent for Sam Smith to get sued by Tom Petty and Katy Perry to be sued by a generic Christian rapper over equally ridiculous claims.

Then you have artists like Mark Ronson who handed over songwriting credits to the Gap Band for Uptown Funk. they had absolutely nothing to do with the song, but got broke off just in case they get greedy in the future.

At the end of the day there's only 12 notes in the scale and a finite number of ways that they can be arranged. Most of this so-called infringement is really just a case of two separate artists coming up with the same idea.

Hahaha.

Paul McCartney had a song on hot 97 with Kanye West that charted right before "Black Beatles" came out.

Meanwhile Ringo Starr was responsible for one of the most sampled break beats and hip hop history.

So yeah, I think they both listen to hot 97.

even if they don't, I'm sure they have friends, and more importantly, lawyers that do.

Lizzo is singing over a different melody but the vocal run is the
same cadence same melody as Finally

no bearing on veracity,
the placment is a signifigant financial incentive for the owners of Finally's publishing
Cadence is probably toughest argument to make for this one

The actual WORDS don't match

That second part is a strike against in my opinion

Good for you.

The Beatles sued over someone saying "yeah yeah yeah", the same way they sang it in "She Loves You".

3 words and they got a song writing credit and royalties.

So y'all dumb mother fuckers in here who listen to music but don't know shit about music....

They aren't in the "same country".

Pharrell was done wrong. You can't sue for a "feeling". Anyone that knows about Pharrell and his music knows that is his MO. He makes songs that are homages to other songs. I dont have the time to list it out but it would blow peoples minds how many Pharrell songs are his homage to other artists.

Lizzo straight ripped Cece and needs to pay up.

Fuck anyone who thinks other wise.

I don't think these two examples are even in the same county

if anyone remembers...i told yall that Robin Thicke and that water head Neptune dude was gonna lose the case the family of Marvin Gaye brought against them...but musically it was a bit of a reach.

this one???

its a LOOOOOOONG reach

I feel like I'm taking crazy pills

This was a "go away" check

I think the Pharrell case was much stronger

This is totally.... reaching........ and nonsense claim.
Let this young lady live on making her music and be happy she used something (if so she actually did) from a great song but isnt relevant to the current genre or style of music to current.
Rather join or collab with her to make a few other songs and expand her legacy (CeCe Peniston) while building one with the "New Culture" on the block.

cliff notes: Stop the Bullshit. Join or collab with the young lady and other performers and make more checks.

Y'all so called music heads are embarrassing.

I would post of proof and evidence of why Cece is correct but y'all aint gonna listen.

Anyways. Good thread OP. It has great potential.

CeCe Peniston received compensation from Lizzo

https://www.cheatsheet.com/entertainment/lizzo-teases-new-album-in-recent-interview.html/

She acknowledged that her song’s been sampled in the past and artists have sometimes reached out.
Peniston also noted that she’s grateful when her music is exposed to a new audience.

Was she paid for the “Finally” sample used in Lizzo’s song? Peniston told Vlad, :
“I got a piece of a piece which means that whatever was due to me got handled.”
She added that she’s happy that things worked out.

You have shown absolutely no proof that CeCe was correct. All you showed was that Lizzo paid to make the case go away.

That does not necessarily mean that she infringed.

If Lizzo had fought back the case could have dragged on for years. Meanwhile no publisher alive is going to touch "Juice" for any kind of placement deal until the matter is finally settled. that means no more commercials, no movies, no TV shows, no video games etc.

It may have made sense for Lizzo to pay a little now to make a lot later regardless of the merits of the case. Especially when she's not the only one eating off that song.

that said, this is still one of the most frivolous bullshit copyright cases I've ever seen.

How many copyright cases have you seen?
Stop acting like you are some kind of music theory professional who is the authority on sampling and copy right. Just stop.
If you can't listen and hear that Lizzo took Cece's melody then have a good day.

Are you an entertainment attorney? Or involved in the industry at all? Serious question.

Have a good day.

I am commenting on people dissing my opinion acting like they are professionals.

Professionals have already spoken.

This is so much more than "no" and yet still only says "no" lol

Dude I signed artists and sold sync licenses for a publishing company. Part of my job involved negotiating artist contracts with lawyers so that we wouldn't get sued if they plagiarized somebody and didn't tell us. I'm very well aware of what copyright infringement is and isn't.

if you believe that this is copyright infringement then that is nothing more than your opinion. The context is debatable and since this case was never ruled on neither of us will ever know how it would have turned out.

That said, if you're really about recommending artists lawyers for frivolous copyright lawsuits you may want to call up aerosmith's people. The verse section of Calvin Harris's "We'll be coming back" uses the first half of the chorus of aerosmiths "Don't want to miss a thing." By my count it's 20 straight identical notes and rhythms. the lyrics practically rhyme with each other.

You can hear it at 0:19

"Your Honor, this is a frivolous case and the plaintiff is clearly trying to extend the courts jurisdiction into extortion.

The plaintiff clearly says; "Yea-yea, yea-yea, yea-yea, owww. Yea-yea, yea-yea, yea-yea, oww."
And my client, clearly says; "Yah-yah-ee, yah-yah, yah-yah."

"Yah-yah" is NOT "Yea-yea!"
And furthermore my client starts her lyric with "yah-yah-ee".... the plaintiff ENDS hers with an "oww." There is no "oww" except for the pain and anguish my client has faced since the plaintiff has made her very public allegations!"

Haha.... she bit that shit tho

Yo THANK YOU

that was my FIRST THOUGHT ON THIS.

i would keep you on retainer

Completely ignoring Calvin Harris vs Aerosmith. Not interested in this at the moment.

Lizzo vs CeCe is the argument. Point blank Lizzo lifted from CeCe. She goes her a song writing credit.

Similarly A Boogie with the Hoodie used elements from Michael Jackson's "Remember the Time".

Even if A Boogie did not use the melody of the lyrics the "Dap dap da da dap" thing MJ does would be enough to get song writing credit.

Lizzo is using those sounds the same way CeCe did. They are unique sounds.

CeCe needs to get her proper credit.

In contrast, Pharrell got sued for a "feeling". No sounds or lyrics were the same in those 2 songs and a jury and "music professionals" sided with the Gaye family. Which is criminal.

The "uniqueness" of the language of CeCe's adlib is questionable, subjective, and purely your opinion.

You keep saying it's fact as if you, a nigga not involved in music or the industry of music, are the arbiter of such things.

A nigga out the sreet saying something authoriatively only works on niggas dumber than that nigga.

Man listen. For some reason you easily offended cause you think you the music man.

Meanwhile Lizzo gave up that money.

Isn't the 1st time either. She is known for copying and not giving credit.

You can't copy someone shit and not give credit.

Or should I say "You should not be allowed to copy someone's shit and not give them credit".

Lizzo also took elements from "Black Beatles" on her song "Truth Hurts". I don't know why there is no lawsuit about that.

I understand you don't like me big fella, but I am right.

Deal with it jack!!!!

But in the previous breath you gave Pharell a pass, calling it "paying homage" when he's done it. Hmm.

Yes. I know. Surface level you would think I am contradicting myself right?

However, the Pharrell song doesn't use any sound or melody used in the Marvin Gaye song.

Go listen to it if you do not believe me. There is a big difference.

However, are you quoting me just to fuck around with me or are you really interested in learning?

That is why I am not wasting my time with these BGOL jokers.

See below.

I don't know you doggie, relax.

All that extra stuff is cool, don't got shit to do with nothing I said.

If bringing up shit that don't have nothing to do w whats being talked about works for you elsewhere then I get why you doing it lol but lizzo could be milli fucking vanilli for all I care, I'm saying I think CeCe is reaching and that she was paid to go away, not on the merit of her claim.
