US Attorney General was 'Not Aware' of Ferguson Media Restrictions

Attorney General Eric Holder says he was not aware that airspace was limited over Ferguson to prevent press access. AP report raises questions of press freedoms in the United States.
The U.S. Attorney General was “not aware” of any attempts by the government to limit media coverage of riots in Ferguson, Missouri this August, following the shooting of teenager Michael Brown, according to reports from a press conference, Monday.

Johnson tweeted the remarks by the attorney general, following an Associated Press in-depth report Sunday evidencing that the U.S. government agreed to a police request to restrict airspace surrounding Ferguson.

Allegedly for “safety” reasons, 37 square miles of airspace was restricted during the riots. The audio recordings exposed by AP prove local authorities' real motive was to prevent news helicopters from gathering footage of the riots.

One Federal Aviation Administration (FAA) manager admitted to the AP in a series of recorded telephone conversations: "They finally admitted it really was to keep the media out."

Holder also said at the conference that he does not know enough about the decision to close the airspace to say whether there will be an investigation.

“The American people need to understand what is happening in Ferguson, and anything that would artificially inhibit the ability of newsgathererers to do what they do I think is something that needs to be avoided” Johnson tweeted, directly quoting Holder.

The information gathered by the AP comes from FAA recordings obtained under the Freedom of Information Act. It raises the question of freedom of the press, as well as constitutional rights for journalists.

Mask my good brother thank you for the work you (Camille you too!) have been doing with these posts. Lots of GREAT information.

Two things...

Whether she knows the verdict or not, going to Geneva is the right thing to do. The entire world is watching the hypocrisy of the US and we all know what's gonna happen here (no bill). Bringing it there puts pressure on the US to actually DO SOMETHING on a greater scale.

Secondly, is there ANY SURPRISE that the bullet went missing? They know that bitch was fired from a duty weapon and they're not about to let that information get out. I'm really at a loss as to what actions she can take because that bullet is probably melted down or at the bottom of some lake by now :smh:

Appreciate the positive energy fam, i feel like this the least I can do.
I have some thoughts with regards to protesting and things to that nature(not for general eyes, you them folks be watching) I'm typing up for the fellow members of the St. Louis area.

If protests are supposed to last a maximum of three days, demonstrations in Ferguson, Mo., and nearby St. Louis must seem like a lifetime to those tired of the noise, the disruption, the anger, the focus on and monitoring of law enforcement agencies and political leaders.
It has been nearly three months since the body of 18-year-old Mike Brown lay in the streets of Ferguson and police responded with dogs, heavy weapons and a determination to put down a 21st century slave rebellion. But the overreaction of police departments with tear gas, percussion grenades, rubber bullets, armored vehicles and video of officers threatening to kill protestors has fueled outrage and an unwillingness to simply go away and be quiet.

Young Black people demanding the indictment of Darren Wilson, the White officer who shot the unarmed teenager to death in an encounter allegedly sparked by jaywalking, have disturbed the psyche of a nation with an addiction to ignoring and miscasting the reality of race inside “the world’s greatest democracy.”

Justice for Mike Brown has trended on Twitter, dominated news coverage at times and brought a barrage of articles, insights, videos and lectures. “I Am Mike Brown” is a cry echoed across the country and now appropriated by many who wish to question some American injustice but who were largely invisible and silent before the boldness and tenacity of Black youth forced America to pay attention.

Yet for all the attention, the country doesn’t seem to be learning many lessons.

In St. Louis County, Mo., where a secret grand jury is supposedly at work trying to determine whether officer Wilson should face charges, and in Washington, D.C., where the federal government is supposed to be looking into whether civil rights violations occurred, there have been leaks to the media about the case.

The leaks, conventional wisdom and mainstream media reports say, are supposedly attempts to seed the public with the reality that officer Wilson will not be indicted. The anonymous leaks, mainstream media and its analysts of anonymous reports insist, favor the officer’s version of what happened. The testimony leads to the conclusion that officer Wilson was afraid for his life and fired because of a reasonable fear, they say. But their arguments are weak given the distance between where the officer stood and where Mike Brown was shot. The “justifiable homicide” explanation would have us believe that young Brown, who was shot during an altercation with the officer at the cop’s vehicle, ran, stopped, turned around and charged the officer. This specter of a big Black brute or fear of a big, Black menace might play to White sensibilities, fantasies and fears but it tears at the heart of Black America and rips open 400-year-old wounds tied to the murder of Black men and women.

It says once again, there is no justice for us inside America and any explanation, no matter how convoluted, will do to protect White police officers, White lives, White privilege and systemic White oppression.

It says once again that the media is complicit in and a partner in the great White protection racket, no matter how it tries to hide behind a mask of objectivity and fairness. Indeed, if anything is fair in this equation it is the fierce determination to protect the fair-skinned and fair-haired.

Assurances are made from the county prosecutor, who refused to step aside for a special prosecutor, that the secret grand jury proceeding is intact despite the leaks. The leaks aren’t actually coming from the grand jury, insists prosecutor Robert McCulloch, who was asked to step aside by Black activists and thousands who signed petitions. He has refused to step aside and the governor and Democratic candidate for country executive stood by his side.

Meanwhile police departments in the area and others across the country are preparing for outbreaks, if no indictment comes. There is a strong suspicion and a strong belief among many that a decision has been made and its public announcement will come after Nov. 4 elections.

Delaying any non-indictment until after the elections won’t do anything for public order, though it may serve the interests of politicians, who perhaps felt such an outcome could have energized Black voters in the state and across the country. Perhaps there was a fear Blacks would respond in huge numbers to all those seen as political enemies and supporters of an unjust system.

The well-founded and accurate belief that an unjust system is at work won’t dissipate simply because the word is delayed. The problem is a continued denial of justice and a continued failure to recognize Black lives matter. If justice fails to be delivered in Ferguson, what will happen? Will we see blood flowing in the streets of Missouri? Will we see cities under siege not only in America but across the country?

The Honorable Minister Louis Farrakhan warned in a major address at Mosque Maryam in Chicago that Ferguson, Mo., is a sign of dangerous conditions that exist in American cities.

“Now all the police forces are being given weapons that are only used in military theaters of war. So when you see the police armed like they are: That’s not to ‘serve and protect,’ that is to kill. Look at the military force that came against the people in Missouri. When I looked in the faces of those police, you could see the hate in their eyes. And in one video captured by CNN, a police officer was standing there, saying: ‘Bring it, all you f-ing animals! Bring it!’ They have a desire to kill us wholesale,” the Minister warned.

The truth of repeated warnings from Min. Farrakhan is coming true before our eyes and eyes must stay trained on Ferguson. If those in power persist in their wicked ways, the denial of justice in Ferguson could ignite a racial firestorm that will engulf the country. Once that spark is lit, will there be any way to put it out?

US Attorney General was 'Not Aware' of Ferguson Media Restrictions

Attorney General Eric Holder says he was not aware that airspace was limited over Ferguson to prevent press access. AP report raises questions of press freedoms in the United States.
The U.S. Attorney General was “not aware” of any attempts by the government to limit media coverage of riots in Ferguson, Missouri this August, following the shooting of teenager Michael Brown, according to reports from a press conference, Monday.

White House Defends No-Fly Zone During Ferguson Protests

WASHINGTON (AP) — The White House said Monday a no-fly zone the U.S. government imposed over Ferguson, Missouri, for nearly two weeks in August should not have restricted helicopters for news organizations that wanted to operate in the area to cover violent protests there.

Audio recordings obtained by The Associated Press showed the Federal Aviation Administration working with local authorities to define a 37-square-mile flight restriction so that only police helicopters and commercial flights could fly through the area, following demonstrations over the shooting death of 18-year-old Michael Brown.

The Obama administration's defense of its actions centered on a provision of obscure federal regulations intended to allow press flights as long as they meet certain conditions. White House spokesman Josh Earnest sidestepped questions about conversations on the tapes showing police working with the FAA to keep media away.

"In this case, what the FAA says is that they took the prudent step of implementing the temporary flight restriction in the immediate aftermath of reports of shots fired at a police helicopter, but within 12 to 14 hours, that flight restriction was updated in a way to remove restrictions for reporters who were seeking to operate in the area," Earnest said.

In Missouri, St. Louis County Police Chief Jon Belmar defended his department's involvement Monday, telling reporters that "at no time did we request that only media be kept out of the airspace." The chief said the safety restrictions were prompted by reports of gunfire and that conversations on the tapes were "out of context." He did not elaborate.

On the tapes, an FAA manager is heard assuring a St. Louis County Police Department official that the updated restrictions would allow planes to land at nearby Lambert-St. Louis International Airport but, "It will still keep news people out. ... The only way people will get in there is if they give them permission in there anyway so ... it still keeps all of them out."

"Yeah," replied a county police captain. "I have no problem with that whatsoever."

The disclosures about the secret motivations by local police to keep press flights away emerged during a sensitive time in Ferguson, which is awaiting a decision by a grand jury whether a city police officer, Darren Wilson, will face criminal charges for fatally shooting Brown on Aug. 9. Violence flared for weeks across the city through September, and the FAA put the first temporary flight restrictions, known as TFRs, in place on Aug. 11.

The police chief said the FAA contacted police first about restricting flights. The audio recordings between the department and the FAA indicated it was the police who wanted the restrictions — and that FAA officials accommodated them.

"Were you the gentleman I spoke to that actually issued the TFR?" the FAA manager asked. "Yes," the police captain replied.

Elsewhere in the tapes, one FAA manager talks to another about renegotiating with police over the size of the restricted area and persuading authorities to accept one with a lower altitude than they initially wanted.

Attorney General Eric Holder said Monday the Justice Department was not involved in the FAA considerations and said the American public needs to understand what is happening in Ferguson.

"Anything that would artificially inhibit the ability of newsgatherers to do what they do is something I think needs to be avoided," Holder said Monday.

A spokesman for Sen. Claire McCaskill, D-Mo., said the FAA should impose flight restrictions "for one reason and one reason only: public safety." Her office will follow up with the FAA "to ensure that was the basis on which these restrictions were imposed," said the spokesman, John LaBombard.

At the White House, Earnest stressed that under FAA rules the no-fly zone as it was re-designated after Aug. 12 would have exempted press flights as long as pilots had filed flight plans and carried accredited reporters on board.

"The updated flight restriction didn't have any impact on media access."

But the administration's statement about what it believes should have happened under the no-fly rules is inconsistent with what actually happened during the period. None of the St. Louis television stations was advised that media helicopters could enter the airspace even under the lesser restrictions, even under federal rules that would have permitted flights "carrying properly accredited news representatives." The FAA's no-fly notice indicated the area was closed to all aircraft except police and planes coming to and from the airport.

"Only relief aircraft operations under direction of St. Louis County Police Department are authorized in the airspace," it said. "Aircraft landing and departing St. Louis Lambert Airport are exempt."

The Obama administration has said it was unaware of any news organization's complaining about the restrictions.

"To the best of our knowledge, during the 11-day period flight restrictions of varying levels were in place, no media outlets objected to any of the restrictions," FAA Administrator Michael P. Huerta said in a statement.

Yet news organizations have broadly protested — almost always in vain — temporary flight restrictions the FAA has imposed in recent years across the country at the request of local police, said Mike Cavender, executive director of the Radio Television Digital News Association, a trade group for broadcasters. TV stations have complained that police ask for temporary flight restrictions without justification and the FAA approves them too readily without scrutiny.

"Our concern, based on what we were hearing from stations, is that it was kind of, 'Put a TFR in place and ask questions later,'" Cavender said. "There was certainly not the justification for a flight restriction that there ought to have been."

The RTNDA, which formally complained Monday to the FAA, said broadcasters in St. Louis were complaining to it during the period, even if they were no longer registering formal complaints with the FAA.

"We certainly, during that time, certainly heard either directly or anecdotally that the television stations in general in St. Louis were hampered," Cavender said. The group's complaint to the FAA said the restrictions were intended to "repress the media coverage" and called the FAA's response to the AP's report "disingenuous."

"We are sorely disappointed that, to this day, officials including those at the FAA continue to maintain their actions were necessary and appropriate to preserve safety and security," the complaint said.

Around the same time as the violence, the National Press Photographers Association, another journalism trade group, complained to the police chief in Ferguson about the department's "complete lack of understanding and respect for the First Amendment." That followed the no-fly restrictions and the arrest and detention of journalists on the ground covering the violence there.

The AP obtained the recordings under the U.S. Freedom of Information Act after asking for the information roughly 10 weeks ago.

"They finally admitted it really was to keep the media out," one FAA manager said about the county police on the tapes. "But they were a little concerned of, obviously, anything else that could be going on."

At another point, a manager at the FAA's Kansas City center said police "did not care if you ran commercial traffic through this TFR all day long. They didn't want media in there."

The conversations contradict claims by the St. Louis county police, which said the restrictions had nothing to do with limiting the press and instead were imposed because of gunshots fired at a police helicopter. But county police officials told the AP recently there was no damage to their helicopter because of the gunshots, which an FAA manager called unconfirmed "rumors."

The restricted flight zone initially encompassed airspace in a 3.4-mile radius around Ferguson and up to 5,000 feet in altitude, but police agreed Aug. 12 to reduce it to 3,000 feet after the FAA's command center in Warrenton, Virginia, complained to managers in Kansas City that it was impeding traffic into St. Louis.

The flight restrictions remained in place until Aug. 22, FAA records show.

THE PROBLEM

Innocent people are routinely stopped, searched, harassed, bullied into compliance and humiliated every day in Missouri. It's not a crime to walk down the street, to peacefully protest, to march or to gather with a group of your peers on the sidewalk. Yet, black and brown Missourians are turned into suspects for doing just that. In Missouri, police harassment has increased exponentially since Aug. 9, when Michael Brown was fatally shot by a Ferguson police officer.
A solution

The ACLU of Missouri Mobile Justice smartphone app was created to empower individuals to hold Missouri law enforcement agencies accountable for their actions. It has four main features:

Record- allows citizens to capture exchanges between police officers and themselves or other community members in audio and video files that are automatically emailed to the ACLU of Missouri.

Witness- gives citizens the option to alert nearby Mobile Justice App users when they are stopped by police in order to witness and document the interaction.

Report- gives citizens the option to provide a more-detailed account of their interactions with police in an incident report, which will be transmitted directly to the ACLU of Missouri.

Know Your Rights- provides an overview of what rights protect Missourians when they are stopped by law enforcement officers.

*The app is only available on the Android at this time. An iPhone version will follow.
A Warning

When interacting with law enforcement, exercise caution when attempting to use the app to document your exchange. Your safety depends on your ability to clearly communicate your actions and to remain calm.

Announce that you are reaching for your phone.
Announce that you are attempting to access the app to record the exchange.
If the officer forbids or prevents you from doing so, do not argue or resist. Follow the officers instructions. If your rights have been violated, your attorney will argue your case later.
If the officer attempts to touch your screen in an effort to destroy the evidence you've captured, don't worry. The moment the recording is stopped it will automatically be sent to the ACLU of Missouri.

Feds Train Cops Around Ferguson On 'Impartial Policing'

11/06/14 04:20 PM ET

WASHINGTON -- A Department of Justice office is hosting a session for police officers in the St. Louis region on "Fair and Impartial Policing," federal authorities announced Thursday. The training session comes as police in the area prepare for possible protests in and around Ferguson, Missouri, following the grand jury's decision on whether to indict the police officer who killed 18-year-old Michael Brown back in August.

DOJ's Office of Community Oriented Policing Services is leading the sessions for the St. Louis County Police Department -- which has entered into a collaborative reform effort with DOJ -- as well as the St. Louis Metropolitan Police and the Missouri State Highway Patrol. The sessions are taking place on Thursday and Friday.

The Justice Department said in a press release that the training "is specifically designed to enhance officers' understanding of how bias -- including implicit or unconscious bias -- affects officer behavior, and the impact that biased policing has on officers and the community."

Meanwhile, DOJ's Civil Rights Division has an ongoing investigation into the practices of the Ferguson Police Department.

In Oakland, nothing has changed besides the chiefs. That's all I can speak on from experience. Officials will say one thing, but residents will tell you the truth.

All of this is before and during Holders time... Oakland paid out more in settlements than every Police department excluding NYPD, Chicago LA... and Oakland has a much smaller population and fewer than 800 cops. OPD still cracking skulls out here.

most recent info I found without really looking hard:
When compared to the 74 agencies in the study published last year (which was conducted by Joanna Schwartz, Assistant Professor of Law at the UCLA School of Law), between 2006 and 2010 the only agencies that paid more in civil rights-related settlements than Oakland are some of the largest in the country. New York City, with 36,000 officers, spent $350 million on 6,113 cases; the sheriff’s department for Cook County, Illinois, where Chicago is located, has 5,655 officers and spent $76 million on 507 cases. Oakland, with only 766 officers, spent $22 million on 55 cases.

Oakland was ranked similarly in California during that same time period:
Los Angeles County Sheriff (9,461 officers): $54 million on 248 cases
Los Angeles Police Department (9,727 officers): $48 million on 155 cases

The specialized riot gear request is reasonable. Too many people that shouldn't be cops are suited up looking to try out the toys.

Bruh ALL of their requests are reasonable.

And truthfully, this shit shouldn't have to be requested it should be a given. Non violent protesters should not be met with excessive force and intimidation.

My point is, okay, you made your request. What are you gonna do if these requests aren't granted?

Unless they have a secret weapon or their own personal army as heavily armed as these pigs, their request don't mean shit to them crackers

I’m just out here working hard every single day, just trying to be the best poster I can be....

While we're preparing this way, the police & government are preparing this way!!!
