Florida's "Stand Your Ground" law cannot be used by a senior citizen accused of manslaughter in the 2010 killing of an unarmed Air Force veteran, a judge has ruled.

Trevor Dooley, then 69, admits shooting and killing his neighbor David James, 41, of Valrico, Fla., during an argument in a neighborhood basketball court, Tampa's WFTS-TV reports.

The dispute began when Dooley yelled at a teenager to stop skateboarding on the court. James, who was playing basketball with his 8-year-old daughter, stood up for the skateboarder -- asking Dooley to show him a sign saying skateboarding wasn't allowed.

What happened next is in dispute.

Prosecutors say Trevor Dooley, who holds a concealed weapons permit, pulled out a gun to intimidate his neighbor, WFTS reports. That allegedly led to a fight, during which Dooley shot and killed James in front of his young daughter.

Dooley claimed self-defense under Florida's "Stand Your Ground" law, which provides immunity from prosecution if a person "reasonably believes" deadly force is necessary to prevent death, serious bodily injury, or the commission of a forcible felony.

At a hearing about whether "Stand Your Ground" gave Dooley immunity, Dooley testified that at one point during the fight, James had a hand around his throat and "was killing me." That's when Dooley pulled out a gun and shot James, Dooley said.

But a judge sided with prosecutors. "There was no reasonable belief that deadly force was required," the judge wrote in a ruling released Monday, the Tampa Bay Times reports.

The ruling means Dooley's manslaughter case will proceed to trial -- where his lawyer can try to persuade jurors of Dooley's self-defense claim, according to the Times. A trial date has not yet been set.

Trevor Dooley's "Stand Your Ground" ruling shows what could happen to George Zimmerman, who has claimed self-defense in the killing of unarmed teenager Trayvon Martin.

A pre-trial hearing will likely determine whether Zimmerman is immune from prosecution under "Stand Your Ground." If the case proceeds to trial, Zimmerman's lawyer will likely try to persuade jurors of Zimmerman's self-defense claim.

It's not clear when such a "Stand Your Ground" hearing will take place in Zimmerman's case. His defense team will first review the prosecution's evidence. The evidence (including medical records) was released to Zimmerman's lawyers on Monday, Tampa's Bay News 9 reports.

Black people in Ohio have been using the CCL laws to protect ourselves from thugs. Prior to that, we had no right to legally pack on the streets and were more likely to be victims. We also have the castle doctrine which is also helping black people. SYG is the next step.

Hopefully, we will have a SYG law in Ohio. It will expand on the Castle Doctrine law and actually lead to less prosecution of black people where self-defense may apply.

JACKSONVILLE, Florida (Reuters) - Three days after a Florida jury found George Zimmerman not guilty for the shooting death of Trayvon Martin, the Rev. Jesse Jackson visited Jacksonville to call attention to another self-defense case that he called a "travesty" of justice.

Jackson spent an hour in a jailhouse visit with Marissa Alexander, 32, an African American who was sentenced to a mandatory 20 years in prison for firing a warning shot into the wall of her home in 2010 to end a violent argument with her abusive husband.

"In one case Mr. Zimmerman kills a young man and walks away, free to kill again," Jackson said. "And Marissa shot no one, hurt no one, and she's in jail for 20 years."

Jackson said the contrast in the Zimmerman and Alexander cases exposed injustices in the justice system.

"We see radical racial polarization in the judicial system," Jackson told the Florida Times-Union. "That's a cause of great concern."

After meeting with Alexander, Jackson spoke with Angela Corey, the state prosecutor who handled both the Martin and the Alexander cases. Corey told him that Alexander's case is in the appeal phase and out of her jurisdiction, but Jackson said he asked her to use her power to see that Alexander is released.

"Ours was a moral appeal," he said. "This mother has three children. They need their mother," he said, noting that Alexander had already served the three years originally offered to her by the state in a plea deal.

Michael Dowd, a New York domestic violence attorney handling Alexander's appeal, contends she should not have been charged with felonies, but rather a misdemeanor, such as unlawful discharge of a gun.

Local leaders from the National Association for the Advancement of Colored People, the Southern Christian Leadership Conference and the National Action Network are calling for Florida Governor Rick Scott to pardon Alexander.

PROSECUTOR'S RECORD

When Scott appointed Corey special prosecutor in the Zimmerman case and she brought second-degree murder charges against him, some legal experts said she had overcharged. After her office lost the case, many legal experts said prosecutors didn't have enough evidence to win a second degree murder conviction.

When Corey first ran for office in 2008, the tough-on-crime Republican prosecutor promised voters she would pursue criminals to the fullest extent of the law.

Corey also garnered national condemnation when she charged 12-year-old Cristian Fernandez with first degree murder in the death of his two-year-old stepbrother. At the time, Fernandez faced mandatory life in prison if found guilty.

In the Alexander case, Cory charged the 32-year-old woman with three counts of aggravated assault with a deadly weapon because her husband's two children were in the house during the argument.

Alexander's case received little attention when she was convicted, but that changed after the Trayvon Martin killing cast a new spotlight on Florida's "Stand Your Ground" self-defense laws.

Under the "Stand Your Ground" law, people fearing for their lives can use deadly force without having to retreat from a confrontation, even when it is possible.

Alexander, a slightly built woman, said her husband, Rico Gray, was moving toward her threateningly when she fired into a kitchen wall. He had previously been convicted on a domestic violence charge for attacking her.

Gray's two children were at home, in the living room. Prosecutors alleged that the shot endangered Gray and the children.

Alexander filed a "Stand Your Ground" claim, but a judge ruled against her because Alexander chose to go back into the house with her gun.

A jury took just 12 minutes to find her guilty of three counts of aggravated assault with a deadly weapon.

Because Alexander fired a gun in the incident, Florida's "10-20-Life" mandatory-minimum sentencing guidelines required the judge to sentence her to 20 years in prison.

At the time, Alexander had an active restraining order against her husband and she carried a concealed weapons permit.

Marissa Alexander Supporters Call for Release,
Not a New Trial​

Marissa Alexander was recently granted a new trial—but not everyone’s convinced that she will ever get a fair one. Alexander was sentenced to 20 years for firing a shot during an altercation with her husband, Rico Gray, who had twice previously been arrested for domestic abuse against Alexander.

Alexander was denied immunity under Florida’s Stand Your Ground defense, and the case drew a lot of parallels with the George Zimmerman trial. Zimmerman, who was found not guilty of the killing of Trayvon Martin, was tried by the same Florida state prosecutor, Angela Corey.

Alexander’s sentence was overturned because of flawed jury instructions, but she still hasn’t had a bail hearing. Now, a group of supporters are organizing to stop prosecutor Corey from moving forward on the case, and they are asking the state drop the charges against Alexander. I spoke with Mariame Kaba, who is the founder and director of the restorative justice organization Project NIA. Kaba is working to help free Marissa Alexander—as well as highlight the need to understand black women’s basic humanity.



That petition originated from the Free Marissa Mobilization Campaign. It basically asks the state of Florida to drop the case altogether, and not refile charges against her. She’s already spent three years behind bars, three years that most of us think she shouldn’t even have to have served. We don’t want them to move forward with a new trial. We want them to dismiss all the charges, and we want them to free her now.

Some supporters might want a new trial and think justice can be served in that way. Why isn’t that the solution for you?


I’m going to speak for myself on this one, and not for the campaign. In the first place, she had the right to protect herself; she had the right to stand her ground. We don’t think she should have been prosecuted in the first place. And when she was prosecuted, the evidence warranted the jury to come back with a not guilty verdict. But none of those things happened. We’re at the point now where I personally don’t believe that the justice system can actually deliver justice. It’s incumbent on the state to not go back to trial. Even if the jury instructions are given in a different way, the judge has already made the determination that she can’t rely on Stand Your Ground in a retrial. Self-defense is once again off the table. She’s already had so much of her life taken away for the last few years. It’s time to set her free.

October is Domestic Violence Awareness Month, and a group of people has kicked off the #31ForMarissa letter writing campaign. Can you tell me more about it?


Every single day this month, we publish one letter that’s written by a man to Marissa. These letters either discuss that man’s own experiences as having been a witness to domestic violence, or they reach out to her in empathy and solidarity. Our interest in trying to get those letters out was to dramatize how domestic violence operates in people lives, to talk about her particular case, and to make a push to free her. But also, to do something that doesn’t get done enough, which is to bring men to the table. Having men take an active, vocal role in talking about intimate partner violence, in talking about it in respect to a black woman, and to show real solidarity for what happens to her, and what is happening to so many other survivors of domestic violence. I have to admit that initially, I was skeptical that many men were going to write letters. And it’s been wonderfully heartening to see that men are taking real initiative and interest in doing so.

What do you think is the most important thing to keep in mind about the Marissa Alexander case?


Marissa is a black woman, and we need to be really clear about that in this case. We’re not seen as potentially violable, we’re not seen as people who can be victimized too often. We’re always seen by everybody—including sometimes even in our own communities—as not being able to feel pain or be abused, and not being real “victims.” What we’re trying to do here, with Marissa, is asserting very clearly and specifically her humanity. We want to make it clear that we do feel pain. Making it clear that the continuing criminalization of black women is completely unacceptable, immoral and despicable.

My own personal sense of heartbreak has been around the notion, in this case, that Marissa couldn’t be afraid, that she couldn’t feel fear, and that the jury couldn’t believe that she was afraid. That’s deep. And that’s why having another trial feels to me like a recipe for disaster—because I don’t think her humanity is taken into account. I don’t think people think that black women can feel scared, or that we have the ability to feel pain.

There are deeper cultural things, as well as structural oppression issues that we need to talk about in real ways. Those #31ForMarissa letters might not seem too profound, but the ability for people to empathize with black women is revolutionary. For [the letter writers] to affirm Marissa’s humanity, and understand her fear, and understand she is feeling pain is a huge thing. And it’s big part of this case.

An unarmed former Florida A&M University football player shot and killed by police — who were responding to calls of a man trying to break into a house — was apparently just seeking help after a car accident.

Jonathan Ferrell, 24, was shot multiple times when cops say he surprised a trio of Charlotte-Mecklenburg police officers by running toward them around 2 a.m. Saturday.

Police say Ferrell’s description matched one given by a woman who moments earlier called 911 to report a man knocking wildly on her front door and attempting to break in.

Officer Randall Kerrick, 27, quickly reacted by firing his weapon — killing the former football safety. He was later charged with manslaughter due to “excessive” force.

NBC NEWS: A young, black Detroit woman was shot in the head and killed on a front porch while seeking help after a car accident over the weekend — and her family and local activists are outraged the shooter has yet to be charged.

The case is now drawing comparisons to Trayvon Martin and Jonathan Ferrell, the former college football player who was killed in North Carolina.

Renisha McBride, 19, was fatally shot while standing on the front porch of a home in the suburb of Dearborn Heights outside Detroit on Saturday, according to police.

The Wayne County Medical Examiner said she died of a shotgun wound to the head.

The Dearborn Heights Police Department said they responded to a call of a shooting in the early morning hours at a house on Outer Drive, adding that they have “identified the person who fired the shot and killed the woman.” No one has been charged.

With her cell phone dead, McBride's family believes she was seeking help at the residence following a car accident, according to her maternal aunt, Bernita Spinks.

“She probably wanted to ask him to make a call for her or if she could use the phone,” she told The Detroit News.

Local police requested a warrant from the Wayne County Prosecutor Office on Wednesday, but the request was sent back to police later that afternoon for additional investigation.

"We have asked that further investigation be conducted by the police in this case," Maria Miller, a spokesman for the Wayne County Prosecutor, said in a statement. "We will not be able to make a charging decision until the requested work has been completed."

Under the Michigan law, an individual not engaged in a crime may use deadly force against another if said individual "honestly and reasonably" believes deadly force is necessary to prevent imminent death, bodily harm, or sexual assault.

NEW YORK DAILY NEWS: The man who shot and killed a 19-year-old woman who may have been merely seeking help following a car crash claims his shotgun went off by accident, according to a new report.

Renisha McBride, of Detroit, was shot and killed by the blast to the face in the Detroit suburb of Dearborn Heights early Saturday.

“This man’s claiming — believed the girl was breaking into the home. And he’s also saying the gun discharged accidentally,” Lt. James Serwatowski, chief detective, told the Detroit Free Press Thursday.

McBride’s family is asking prosecutors for information on the incident that left the unarmed young woman dead. Scant details have been provided. As the Detroit News reported “Dearborn Heights [Police Department has] identified the person who fired the shot and killed the woman.” However, police have claimed that the shooter believed McBride to be an intruder and shot in self-defense. <SPAN style="BACKGROUND-COLOR: #ffff00">Initial police reports</span> that described the 19-year-old’s <SPAN style="BACKGROUND-COLOR: #ffff00">body</span> as having been <SPAN style="BACKGROUND-COLOR: #ffff00">“dumped”</span> have been <SPAN style="BACKGROUND-COLOR: #ffff00">amended to state</span> that <SPAN style="BACKGROUND-COLOR: #ffff00">she was found on the shooter’s porch</span>.

Self-defense gone wrong is not a sufficient excuse for a bullet in the head, McBride’s family has stressed. “He shot her in the head … for what? For knocking on his door,” said Spinks. “If he felt scared or threatened, <SPAN style="BACKGROUND-COLOR: #ffff00">he should have called 911.”</span>

Renisha McBride, the 19-year-old teen who was shot in the face by a Detroit homeowner after she crashed her car, had marijuana and alcohol in her system according to a toxicology report released Thursday, the Associated Press reports.

The report was released a day before Prosecutor Kym Worthy plans to announce whether she will seek charges against the 54-year-old Dearborn Heights homeowner, who shot McBride the morning of Nov. 2.

Gerald Thurswell, the McBride family attorney, said that the toxicology report has no bearing on the case as far as he's concerned, AP reports.​

The report states that McBride's alcohol level was about 0.22 more than twice the legal limit for driving. Her blood also tested positive for the active ingredients in marijuana, AP reports.

Police believe that McBride was involved in a car accident several blocks north of the Dearborn home, where she would be found dead on the porch. Thurswell and the McBride family believe that she went to the home seeking help.

Thurswell said the homeowner called 911 after he shot McBride and it took police two minutes to respond.

"If he had called 911 when he heard her outside his house, they would have been there within two minutes and she would be alive today," Thurswell said. "Maybe she would have been arrested for being intoxicated, but she would not be dead."

"what does this have to do with anything?"

Guess they gotta find some way to justify it. White folks happy now, they got another arguing point......

"will she was high and drunk....she's only 19....what's she doing diving around like that? "

There was one that i know of.

His name was Aidearen Carey. I think i spelled his first name wrong, but it's similar to that and should pop up in google.

A burglar was trying to get into his home. He shot twice thru the window and hit him. Burglar stumbled off into a wooded area nearby and died. Carey panicked and ran, but turned himself in 2 days later where he was immediately arrested and charged with 2nd degree murder.

After being in jail a bit, charges were downgraded to manslaughter, he posted bail and was released. A YEAR LATER charges were finally dropped.

During that year however, anything he did was in violation of the terms and conditions of his bail. So when the family members/gang members tried to get back at him, he was sent back to jail again for defending himself when he shanked one of them.

It's a crazy story, but that's the only one i know of

Running toxicology is not too unusual; they're done in conjunction with almost every post mortem to determine the cause and conditions affecting death (especially in cases investigated as possible homicides, as here). In this case, despite how different media might spin it, its largely insignificant if the fact bare-out that she was unarmed and not threatening him to the point where he should have felt his life endangered. What it really it shows just how ridiculous SYG is.

Yeah you're right. I just know the ways of these devils and they will use anything to slander this young lady much the way they did trayvon and try to use this to help justify this coward's actions.

A man was charged with second-degree murder, manslaughter and a related gun charge in the death of 19-year-old Renisha McBride, Michigan's Wayne County Prosecutor's Office said Friday.

Prosecutor Kym Worthy announced the charges against Theodore Paul Wafer, 54, also known as Ted, who allegedly shot the young woman in the face on his porch in Dearborn Heights, Mich. in the early hours of Nov. 2.

"We obviously do not feel that the evidence in this case reveals that the defendant acted in lawful self defense,"

Worthy said.

Wafer's attorney, Cheryl Carpenter, did not immediately return a request for comment.

"Under Michigan law, there is no duty to retreat in your own home, however, someone who claims self defense must honestly and reasonably believe that he is in imminent danger

of either losing his life or suffering great bodily harm, and that the use of deadly force is necessary to prevent that harm," Worthy added in a statement. "This 'reasonable belief' is not measured subjectively, by the standards of the individual in question, but objectively, by the standards of a reasonable person."

Several hours before the shooting, McBride reportedly crashed her car several blocks away in Detroit. Detroit Police said they received a call just before 1 a.m. reporting a female driver had hit a parked car and then left the scene on foot. Worthy said she appeared disoriented and bloody.

Regarding the call as a lower priority, officers were not immediately sent to the scene of the accident. A little later, they received a call in which another individual said the driver had returned to the accident and appeared to be intoxicated or injured. By the time cops arrived at 1:40 a.m., 17 minutes after the second call, no one was there.

A Florida woman who was sentenced to 20 years in prison after firing
a "warning shot" during an argument with her abusive husband has been
released on bond, while she awaits retrial under a controversial part of
the state's self-defense law.

The case of Marissa Alexander, who was convicted of aggravated-assault
with a deadly weapon, touched off a furor when her supporters compared
it to the self-defense case of George Zimmerman, who was acquitted
earlier this year of murdering an unarmed black teenager. Although
no one was injured in Alexander's case, the court gave her a 20-year
prison sentence under the state's mandatory minimum sentencing guidelines
because she had fired a gun during the assault.

A state appeals court ruled in September that Alexander, who is black,
deserved a new trial because the judge failed to properly instruct
the Jacksonville, Florida jury about her self-defense argument. She was
convicted in May 2012.

"This news is vindication for Marissa and all the women who have become
criminalized for exercising their basic right to defend themselves
and their children," Angie Nixon of Florida New Majority, a social
justice organization, said of Alexander's release.

This should sum this up but nobody heard of this bitch until after Zimmerman/Trayvon. It seems like people pick and chose what they want to support their agenda or what they believe in. For the ones that want to repeal stand your ground fail to note that blacks benefit far more than whites with stand your ground and for those that use it in court as a defense come out on top at a higher percentage than whites.

Don't know too many black people that feel this way about SYG or any law for that matter. Benefits black people....:smh:

I don't know if cthomas is right or wrong, but it's not like what he said defies logic.

Black murder rate is about 4x the general population. If the violent crime rate is close to that as well, then black people would have more opportunities to exercise SYG than other groups. I don't know about the acquittal rates, but it doesn't seem impossible to be true.

That video isn't directed towards you because cthomas seems to be more wrong in this case. The articles don't address everything, and lets face it, it's mediamatters, salon, thinkprogress, and motherjones. It would be interesting to see the rightwing rebuttal to these articles.

The first one i posted has the right wing rebuttal. It was an assessment made by the Cuba Canadian that started this mess.

You should know they never reply to anything. They throw shit, then when you get there to challenge them and make them stop, they run off to another pile of shit and commence throwing.
