Google’s executive chairman Eric Schmidt has gone on the offensive and bashed Apple over patent infringement claims the company had filed against high-profile Android backers such HTC and Samsung. In what could be viewed as an effort to sway the public perception, he launched a nasty attack speaking at Google’s Mobile Revolution conference in Tokyo. To Schmidt, Apple’s taking rivals to court sends a strong signal, that of the lack of innovation and jealousy:

The big news in the past year has been the explosion of Google Android handsets and this means our competitors are responding. Because they are not responding with innovation, they’re responding with lawsuits. We have not done anything wrong and these lawsuits are just inspired by our success.

Schmidt re-iterated sales of 135 million Android phones since 2008 and highlighted more than 550,000 daily activations that exclude tablets and non-smartphone devices, which is up from 400,000 a day in May. He said Google will support HTC’s legal battle against Apple’s copyright accusations, but wouldn’t elaborate.

Whether or not Apple’s legal pressure stems from jealousy is up for debate, of course. Cynics might argue Schmidt’s comment draws from nervousness on Google’s part because Android backers are increasingly discovering hidden costs as Microsoft and Apple emerge as holders of patents crucial to Google’s mobile operating system. Apple’s victory over HTC may set what RBC Capital Markets analyst Mike Abramsky painted as a high royalty precedent for Android devices that could further shrink the already slim margins on Android phones.

As if that wasn’t enough, Microsoft is already taking money from five Android vendors for patent protection, including HTC which is said to pay five bucks each time it ships an Android handset and General Dynamics Itronix. Microsoft is also understood to have targeted Samsung, seeking royalties in excess of hundreds of millions of dollars annually. The Cupertino, California-headquartered gadget giant quoted Steve Jobs in a statement announcing the HTC lawsuit March last year:

Legal wrangling between Apple and HTC took an interesting twist when the International Trade Commission (ITC) ruled last Friday in favor of Apple. ITC, an organization empowered to resolve trade disputes and ban imports of infringing products into the United States, found out HTC violated two of Apple’s patents related to iPhone technologies, US Patent Nos. 5946647 and 6343263. The agency commissioners will decide upon the ruling later this year. Meanwhile, investors sent HTC shares down nearly seven percent fearing that Apple will seek to put an import ban on Android-driven HTC phones sold in America.

They already paying Microsoft royalties and if Apple wins then all Android phone makers will suffer because all of those fees will eat into profits. This would put windows phone in a great position to capitalize.

Microsoft is already collecting royalties for patents for each android sold. Now Apple about to start collecting and they have every right to collect. Google knew what they were doing but they did not care because they only want to collect and sale data while making additional revenue from ads.

Production cost will kill any product. Prior to the Nintendo 64, they were untouchable. How do you think Sony was able to become number one with the original playstation? The production cost to make N64 games were sky high while it was next to nothing to produce games on the playstation.

Android is facing the same problems with high production cost and small profit margins for phone makers. Do you think phone makers care what OS they use for their phones? They only care about the bottom line and that is money (profits)If windows phone continues to grow developers will move over to the platform that had the higher profit margin.

You can rant and rave all you want but those Android phone developers are seeing production cost increase at a steady pace.

Trading at record levels ahead of its quarterly earnings report this afternoon, Apple is expected by Wall Street watchers to post its best June quarterly earnings ever, with nearly $25 billion in revenue on sales of 16.5 million iPhones.

Jealous of what? Record Sales.... Google announcing bullshit bogo activations & PR faggotry to steal thunder from Apple's quarterly report coming tonight. :lol:

Jealous because they're the second largest company on the market behind Exxon.

If Apple innovates and all these mofo's do is press COPY and pump out half assed clones every 6 months, how the fuck do REAL innovators compete? Which is why Google can brag about 500k activations a day worldwide. Because they are all on shit phones running different variations of the Android OS giving people various user experiences for better or worse. i agree about samsung. but the patents that are being discussed now are ridiculous. smartphones were avaialable long before apple even thought of an iphone. the patents that apple are claiming to hold are basic smartphone functionality. that is like ford patenting a wheel. wheels were around long before ford. they just put wheels on their cars.

More important, they are seeing that most people on Adroid are indeed buying lower priced or bogo Android phones and in kind not paying for Apps in the Android Market. So while free via affiliate ads is a income stream, its extremely limited. Whereas, IOS has numbers showing that not only do people use the hell out of IOS based apps, but they also BUY them at higher rates than do Android users. Developers are retreating from the platform. PROOF, or better yet, FACT.

I agree about Samsung. All them dudes ever do is copy someone elses design and try and make it better, they don't show shit for R&D :smh:

But HTC at least tries to differentiate themselves from everyone. They do the best (other than Apple) at making their own product and UI.

As I have done a recent Android to Windows Phone 7 switch over, I can agree with Turd, this platform will take off. The royalties HTC and Samsung have to pay alone are going to see to that. Also, with Nokia owning China( the world's biggest market) and most of Europe. WP7 will take off. Nobody is buying it now because there is no reason to. Think about this, no one was buying Android when it first came either, and now look. At least MS owns it's own patents.
 
The Android fanboys are emotional.. I hate MS too but trust that MS is either helping by manipulating the situation behind doors or is making current deals with the latest android woes or both.

Android is having a behind closed doors PR issue. Apple sticks up for iOS, Microsoft sticks up for WP7. Google is remaining silent and letting manufacturers deal with their own woes.

Twitter could have overtaken facebook or cut down on facebooks popularity, but they have a similar model to google.. its the how can we minimize profitability for everyone model.

Because financially speaking Apple makes more money off the iPhone and iPad alone than most Fortune 500 companies make period. Android is an OS and brings Google very little money. If he had said, Apple was jealous of Samsung or HTC, he *may* have not sounded so dumb.. as they are a much better comparison and in direct competition.

We've had this discussion before, and you still don't get it. Apple makes the Iphone, Google makes and OS which runs on an OEM's product which in essence is their product. The statement Schmidt made was Apple would rather sue than innovate. You haven't responded on how they've innovated. Also, that whole IOS5 is a rip off of Windows Phone 7 and Android. No innovation once so ever. There saving grace is the App store.

Imagine I send you an email that has a web address in it. If you have an iPhone or Android smartphone, it will make it so that you can tap on that web address to open it, just like on a Windows PC or a Mac. It's simple, right?

Nope. It's a magical, wondrous invention, that no one would have ever thought of before the gurus at Apple created at. So says the United States' government, courtesy of the International Trade Commission. Apple filed a patent on it, after all, and you know that if they hadn't no one else would have ever thought of it.

"OK," I hear you say, "So Apple patented the obvious. Tech companies do that, and they sue each other over it all the time. It's just a cost of doing business. So what?" Well, first, there are a lot of small indie app developers that are being pounded by that "cost of doing business," and by a legal system that was designed to let large companies wage war against each other. But that's not the point.

The point is, Apple is trying to kill Android. And it's winning.

Making competition illegal

The reason the ITC got involved is because Apple is suing HTC, a Taiwanese company that makes Android smartphones and tablets, for violating its special and wondrous patents. Analyst Florian Mueller goes into more detail on his blog than you probably care to read. But since the judge just issued a preliminary ruling against HTC, the specifics aren't as important as what Apple is asking the court to make HTC do:

Stop selling Android gadgets in the U.S. Period.

Microsoft already has a protection racket going, extorting $5 from HTC for each Android smartphone it sells. And Apple and Microsoft both recently outbid Google on a huge portfolio of patents formerly held by a company called Nortel. It's a land grab, where the tech industry's biggest players buy, borrow and claim every "innovation" they can think of. Then they sue the pants off each other; either for coming up with the same thing independently, or for not realizing that the obvious solution to a technical problem had a legal landmine embedded in it.

The Upshot

Apple could choose to extort HTC, the way that Microsoft does. But it may be well within its government-granted "rights" to simply destroy Android, one company at a time. Meanwhile, "patent trolls" like Lodsys are playing highwayman on the App Store and Android Market, demanding a cut of the profits for things that they never invented and never even helped with.

At one time, patents served a purpose. They got secretive tradespeople to publish their work, by giving them a temporary monopoly in exchange. Now they're just one more weapon that the strong use to prey on the weak, here in America: The land of the free.

Apple is threatened, that's why they are suing, none of these lawsuits came out when Android Launched in 2008/2009. Why now when Google is number 1. The fact is, Apple from a product standpoint can't slow Google, So they are using the law to to do it.
