Judge Rules Against Apple in Kodak Suit
The International Trade Commission (ITC) put to bed at least one of the many patent infringement cases coming out of the wireless industry recently, namely a counter-suit levied by Apple against camera maker Kodak.
An administrative law judge (ALJ) upheld an initial decision that none of the claims Apple put forward alleging infringement of the company's camera technologies were valid. Apple had claimed that Kodak infringed on patents covering image processing in cameras.
The initial ruling, handed down on May 12, found one of Apple's patents was invalid and that Kodak did not violate the other two cited in the complaint.
The ongoing dispute is far from over. The ITC already has ruled against Kodak in the suit Kodak filed against Apple in January, claiming that camera technologies used in nearly all of Apple's devices had infringed upon Kodak's camera patents.
However, the judge assigned to the case said he had changed some of the definitions and language in Kodak's suit and wanted an ALJ to make a final judgment in light of the changes.
The stakes are high for Kodak. This current round of claims has also been levied at BlackBerry maker Research In Motion. Kodak has said that a ruling in its favor on the matter could lead to $1 billion in royalties.

A ruling that Eastman Kodak Co. (EK)’s digital-camera technology doesn’t violate Apple Inc. (AAPL)’s patent rights will stand, the U.S. International Trade Commission said.
Kodak rose as much as 15 percent in late trading after notice of the decision was posted on the Washington-based trade agency’s website. ITC Judge Robert Rogers found on May 12 that the two Apple patents in the case weren’t infringed, and one of the patents was invalid.
Apple went after Kodak in April 2010, about three months after the Rochester, New York-based camera maker accused Apple and Research In Motion Ltd. (RIMM) of infringing a patent related to ways of previewing images. The commission in the Kodak complaint is reviewing a judge’s finding in January that Apple’s iPhone and RIM’s BlackBerry don’t violate the patent.
Kodak Chief Executive Officer Antonio Perez has been seeking to force Cupertino, California-based Apple and Waterloo, Ontario-based RIM to pay patent royalties. Perez has said a licensing deal with the two companies may generate as much as $1 billion in new revenue. A victory for Apple today could have made it harder for Kodak to demand that much in negotiations.
“We are pleased that the commission has confirmed the ALJ’s finding that there is no violation by Kodak,” David Lanzillo, a Kodak spokesman, said in an e-mail.
Kodak rose to $2.89 at 5:01 p.m., after falling 22 cents to $2.52 at the 4 p.m. close of regular New York Stock Exchange composite trading.

One of the Apple patents covers a way a camera can process several images at the same time and the other invention is for a way to handle multiple processes at once, such as adjustments in balance, color, sharpness and resolution. The complaint targeted the Kodak Z series, M series, C series, and Slice cameras, as well as video cameras including the Playsport.

1. Ms made a deal with htc because htc is a wp7 partner. Htc is having record earnings and they r looking out for their bottom line. They made a deal rather than have a protracted court dealing ala what's going on with apple.

Apple's legal win over HTC pushes some Chinese vendors toward Windows Phone 7

The U.S. International Trade Commission's preliminary ruling in favor of Apple over rival HTC has caused concern for some Chinese handset makers who build Android-powered devices, prompting them to consider embracing Microsoft's next version of Windows Phone 7, dubbed "Mango."
China's 21st Century Business Herald revealed the fears that reportedly exist among Chinese smartphone vendors, along with white-box vendors, or those without a brand name. The report, summarized Tuesday by DigiTimes, notes that most of those companies create devices based on Google's free and open-sourced Android operating system.
The report indicated that smartphone vendors Huawei Device and ZTE, two of China's fastest growing Android-device makers, have planned to adopt Mango. In fact, a single Mango-powered device from ZTE was already shown off earlier this month.
Other options for overseas smartphone vendors are said to include self-development of their own new operating systems, or to embrace what the report called "promotion of smartphone customization by mobile telecom carriers for protection through binding common interest (especially carriers with Apple and Microsoft)."
But, according to the report, some China-based vendors see themselves as too small of a target for Apple or Microsoft. HTC's legal woes could pose an opportunity for white-box vendors, who could potentially cannibalize their rival's sales while maintaining a low profile.

'They are important as a business move, of course, and Google has to play that game. But then it becomes whose best at accumulating patents and trolling for lawsuits, and who has the most money to fight in court, not who makes the best hardware and software. Many times companies roll over because they can't afford or don't want to pay to fight. If you read some of the things that are patented it's laughable and even valid claims can be twisted to hurt companies. That's why Apple told that company that is trying to sue iOS developers to fuck off or face a fight with Apple. Before that all those little app developers would have paid up. I wonder who'd be cheerleading for that.

Cook said that while the company hadn’t “learned to play perfectly” in the market he didn’t think anyone would have believed that the world’s most populous country would comprise such a large percentage of total revenue a year ago. Apple stores in China are the fastest growing and have the highest numbers on average in terms of both traffic and revenue.
