BATAVIA, N.Y. - Police were called to Farrell Park in Batavia last Friday afternoon when someone caught a man and a woman having sex on a picnic table.
"The officer got on scene and actually observed the two engaged in a sexual act," said Eric Hill, Batavia Police Public Information Officer.
"Were there children present at the park that day?" 2 On Your Side's Josh Boose asked Hill.
"From what I was told there were adults and children in the park, yes," Hill replied.
Police say Justin Amend, 29, and Suzanne Corona, 41, were intoxicated at the time. They are both charged with public lewdness.
But Corona alone is charged with adultery, a law that Genesee County District Attorney Lawrence Friedman says has been on the books in New York State since at least 1965.
