I really don't know the particular's of the case which is why I said I'm being lazy and need cliff notes. It just seems to me that 2 years for carrying a unloaded gun in your car is a bit much. But it is NY. And why the hell didn't he have a license?
Lil Wayne was probably charged with Penal law 265.02 (like Ja Rule). Criminal possession of a weapon in the third degree (this is a class D felony). However, when you plead to an attempt (110/265.02), The D felony is lowered to an E felony. In accordance with Penal law 70.02 (Sentence of imprisonment for a violent felony offense) the term of a determinate sentence for a violent felony offense must be fixed by the court as follows:
(c) For a class E felony, the term must be at least one year and one-half years and must not exceed four years.
The Department of Corrections gives you credit for "Good time"(staying out of trouble while locked up) that will reduce the actual amount of time the defendant will spend in prison.
