The parents of a mentally disabled football player who claimed he was assaulted by other teammates with a coat hanger left a court hearing Friday after attorneys accused them of making up their son’s assault for money.
John R.K. Howard, 19, on Friday was sentenced to three years probation and 300 hours of community service on a felony charge of injury to a child. The judge also granted a withheld judgment, which means the conviction could eventually be dismissed, MagicValley.com reported.
Howard and two other students were accused of luring their teammate into a locker room only to hold him down and shove a coat hanger into his rectum in October 2015.
Howard’s defense attorney, Brad Calbo, on Friday offered up a recorded conversation from May 19 that has the victim admitting he made up the entire assault so his parents could pursue a $10 million civil lawsuit against the Dietrich school district, located in Southern Idaho, according to the news outlet.

The conversation was recorded by Coaches Mike Torgerson and Rick Astle just six days after they were named as defendants in the civil lawsuit filed by the victims parents.
“The town of Dietrich should not have to suffer for this,” the victims said in the recording obtained by the Times-News. “It was never my intentions. It was just never my intentions. It was just all them, all my parents ... I was fed lies and I said it and I signed it because I was pressured.”

He’s also heard speaking fondly of the students he accused of the assault, all of whom played with him on Dietrich High School’s football team.

He also said he lied under oath while testifying and said his dad promised the family would move to the Bahamas after they won the civil suit, according to Magic Valley.
The victim just last week took back what he said in the recording and explained he lied because he missed his friends, according to a deposition taken on Feb. 17.
“All that stuff I just made up,” he said on the recording. “I just started telling a bunch of lies just because I wanted my friends back ... My friends were super important to me at the time ... I felt like I needed to have them, like they were going to be with me forever.”

Howard, who now lives in Texas, in December pleaded guilty to a lesser felon. He was originally charged with felony counts of forcible sexual penetration with a foreign object — and avoided jail time as well as classification as a sex offender.
The other two teammates involved have cases working their way through juvenile court.

Calbo's defense hinged on a recording of the victim recanting his accusations against the three teams and admitting his parents fed him lies for the purposes of the $10 million lawsuit. But as it turns out, two Dietrich football coaches were reportedly the ones responsible for the audio; in the background voices can be heard telling the victim they love him and urging him to come clean.
On Feb. 17, the victim said he lied on the recording because he wanted his friends back.
"Can you imagine setting a meeting with a mentally disabled child?" the victim's lawyer Lee Schlender told Times-News. "And you take him and tell him, 'We're going to lose our farm, we're all going to jail, you've got to do something for us.' And recording it? ... It's despicable ... I can't think of a much sicker situation."
As the civil suit moves forward, it's clear that there will be no shortage of outrage over Howard's sentencing, which at least a few people are likening to the Brock Turner case.
Indeed, there's something of the same flippant language that was used to dismiss Turner's crimes in Howard's case.
"Boys are boys and sometimes they get carried away," Hubert Shaw, a relative of Howard's aunt told the Washington Post in May. "Have you ever been popped on the butt with a towel when you was in sports?"

A judge is facing calls to be disbarred for allowing a high school football player to walk free from court despite assaulting a mentally disabled boy with a coat hanger.
Judge Randy Stoker spared 19-year-old John RK Howard from jail on Friday because he said he did not deserve to be punished as a sex offender.
Howard was 18 when he and two other teens lured the unnamed, black victim, who they had nicknamed 'fried chicken', into the locker room at Dietrich High School in Idaho and assaulted him by kicking the coat hanger up his backside, causing him to bleed.
The victim has several mental disabilities including schizophrenia and behavioral problems. He has been institutionalized since the October 2015 attack after trying to kill himself seven times.
Howard was initially charged with a felony sex crime but struck a plea deal with prosecutors last year to have the charges lowered to felony injury to a child - a non sexual crime.
He submitted an Alford plea which means that while he maintains his innocence, he believes prosecutors would have won at trial.

On Friday, Judge Stoker sentenced him to three years of probation and 300 hours of community service, angrily telling a courtroom that the teenager did not deserve jail because the attack was neither sexual or racially motivated as had been suggested.
Stoker lampooned the national and international media for its coverage of the case - which he had restricted by banning lawyers on either side from talking to journalists - and said they misconstrued what it was fundamentally about.
'This is not a rape case. This is not a sex case. This started out as penetration with a foreign object ... Whatever happened in that locker room was not sexual. If I thought that you had committed this offense for racial purposes, you would go straight to the Idaho penitentiary.'
In statements to police, the victim said he had been thrown to the ground and 'humped' by another player before Howard kicked the hanger.

'I was in the equipment room to get my padding for football and (Player B) came and threw me to the ground and started humping me, throwing his penis into my butt.
'I was in the locker room and said "come give me a hug. I gave him a hug not knowing what was coming. They went through with the idea of shoving a coat hanger into my rectum...
'And then they jerk it out and my rectum began to bleed.'
While Stoker conceded the attack 'wasn't appropriate, The Guardian reports he told the court there was 'nothing in this record that supports anything close to the sexual allegation against this young man.'
Despite the victim's earlier statements that coaches and teammates referred to him as 'fried chicken' and 'grape soda', terms he says he interpreted as racial slurs because he is black, Stoker said there was no underpinning prejudice behind the locker room incident.
'In my view, this is not a case about racial bias.'
Howard and his family have relocated from Idaho to Texas since the accusations were made public. He will be able to carry out his community service there.
Almost 150,000 people have signed a petition calling for Stoker to be disbarred because of his decision.

According to the boy's parents, the white players subjected him to racist taunts which included KKK songs and nicknames like 'fried chicken', 'grape soda' and 'Kool-aid' for months beforehand.
They said the boy suffers behavioral problems and cannot pick up on social queues. It means he can't deal if he's being made fun of or welcomed by groups, they said.
The boys' lawyers said the names were not racially charged and that they simply thought the boy liked those foods and drinks.

After the accusations first came to light, the disabled boy was interviewed by school staff in a recorded meeting. During it, he recanted the claims made in the lawsuit and told them he'd only agreed to it because his parents wanted $10million.
He said they'd promised him the family would move to the Bahamas if the civil suit went in their favor.
This year he went back on the retraction and claimed it had been coerced. He said he merely wanted his friends back when he made the statements and that the incident did take place.
The lawsuit includes a copy of a transcript of a meeting at one of the coach's houses during which they offered to put him up if he dropped the suit.
The boy lives in a 200 sq ft home with nine other siblings and his adoptive parents. The coaches also said they could'lose everything' if they were sued.
'Can you imagine setting a meeting with a mentally disabled child and you take him and tell him, "We’re going to lose our farm, we’re all going to jail, you’ve got to do something for us." And recording it? … It’s despicable … I can’t think of a much sicker situation,' his lawyer E. Lee Schlender told Twin Falls Times.
At a hearing for another of the boys involved in April, the victim described having the coat hanger inserted in his backside and then kicked up it. 'Pain that I have never felt took over my body. I screamed, but afterwards, I kept it to myself,' he said.
He claimed he was lured in to the locker room by the boys who said they'd give him 'hugs'.
The two other boys involved had their cases heard in juvenile court because they were underage at the time.
One of the boys pleaded to a felony count of forcible sexual penetration with a foreign object. His sentence is not known because his court records are sealed, as are those of the third boy.
Howard has maintained from the start of proceedings that he did not intentionally kick the coat hanger. He said the boy came towards him with the corner of hanger hanging from his buttocks and that he kicked him but not to further it up his backside.
The civil lawsuit has not been ruled upon yet.

The lawsuit includes a copy of a transcript of a meeting at one of the coach's houses during which they offered to put him up if he dropped the suit.
The boy lives in a 200 sq ft home with nine other siblings and his adoptive parents. The coaches also said they could'lose everything' if they were sued.
'Can you imagine setting a meeting with a mentally disabled child and you take him and tell him, "We’re going to lose our farm, we’re all going to jail, you’ve got to do something for us." And recording it? … It’s despicable … I can’t think of a much sicker situation,' his lawyer E. Lee Schlender told Twin Falls Times.
At a hearing for another of the boys involved in April, the victim described having the coat hanger inserted in his backside and then kicked up it. 'Pain that I have never felt took over my body. I screamed, but afterwards, I kept it to myself,' he said.
He claimed he was lured in to the locker room by the boys who said they'd give him 'hugs'.
The two other boys involved had their cases heard in juvenile court because they were underage at the time.
One of the boys pleaded to a felony count of forcible sexual penetration with a foreign object. His sentence is not known because his court records are sealed, as are those of the third boy.
Howard has maintained from the start of proceedings that he did not intentionally kick the coat hanger. He said the boy came towards him with the corner of hanger hanging from his buttocks and that he kicked him but not to further it up his backside.
The civil lawsuit has not been ruled upon yet.
