For the "slept with a nigga crowd" you're all ignoring the fact that a fertility clinic isn't going to inseminate a woman who is already pregnant. Even if it was 2-3 days beforehand, they would have known that an egg had already attached when they went to plant the embryo into the Uterus.
If you have a low sperm cout, or if your sperm isn't particulary motile (they don't swim), then it's a lot easier for a lab tech to actually insert the sperm directly into an egg than it is for them to get dropped off in the vaginal canal, and swim up through the cervix and everything.
That being said, it was a breach of contract. They didn't contract for some sperm, they contracted for the husband's sperm to be inplanted. That's what the clinic agreed to do, they failed, which isa breach of contract. How do you calculate damages in this instance? Not sure....I'll bring this up in class.
