When $1.2 Million is not enough...

OK...

That equates to about $48k per year to sit in prison and contemplate the fact that you are an innocent man in prison for rape. And all that convicted you was the fact that this white lady pointed you out in a line-up. And your life is in constant danger and you are always afraid that the wrong guy will step on your shoes in the yard.

All this... for $48k a year.

Wrongly imprisoned man could get $1.2 million from stateAssociated Press
Published on: 03/19/07
A man wrongly imprisoned nearly 25 years for a rape he did not commit is set to get a $1.2 million payback from the state.

The Georgia House will consider paying Robert Clark that much in restitution for his time in prison for a 1981 attack. DNA evidence cleared his name two years ago.

The resolution, by Rep. Larry O'Neal (R-Warner Robins) says the Atlanta man's imprisonment happened through no fault or negligence on the part of Clark.

O'Neal says it is only fitting and proper that Clark be compensated for his loss.

The state Claims Advisory Board, the first panel to hear requests for restitution from the state, heard Clark's case last month and recommended that the Legislature pay him.

Secretary of State Karen Handel, the board's chairwoman, says she was moved by Clark's demeanor when he made his case.

The board left the amount of restitution up to the Legislature.

The $1.2 million is based on the income Clark lost while imprisoned, personal injury, injury to his reputation and other damages.

The 46-year-old had no prior felony convictions.

The Innocence Project, a New York-based group that works to overturn wrongful convictions, says he was the 197th person nationally and the sixth in Georgia to be cleared by DNA evidence of a criminal conviction.

Considering that they were many of us who 25 years ago were just looking at just making $20000 that not a bad payoff. Plus this is without tax, not in debt. He can find a job and work for ten years which is enough to qualify for social security. With a good financial plan he can take 4% 50,000 and make it grow substanial. Many people don't even make a million in their lifetime. It all depends on the people that he keeps, because some of them will try and smooch some of his money.

He should never have to pay taxes EVER AGAIN. PERIOD. He paid his dues and then some. No matter how much money he makes, no matter if he wins the lottery. He should never have to pay taxes again. Does anybody agree?

It's not enough.

Nothing can replace time lost. Time you could have spent with family or creating a family. Time you could have had doing the world good.

Not to mention the mental weight you carry knowing you are innocent and harboring resentment for a failed judicial system.

Hell, 1.2 mill is pennies in comparison.

It was certainly possible for him to make that on his own over that same period. So they are only doing for him what he may have been able to do for himself had they not fucked him over. In fact, he had to do work while incarcerated. Thus, since he should never have been there, it is only proper that he be given a salary for that period. That takes care of the $1.2 million.

In addition, we do not know what may have happened to him in that prison, especially since her entered as young "fresh meat". There is no price you can put on what was taken away. They took away his dignity as a man, a father, a husband, and as a human being. His mother was deprived of having a normal, nurturing relationship with her son. Shit, she should have been compensated as well! Both he and his family were disgraced for two decades! Simply put, he was dehumanized for some twenty years.

In my opinion, he should get $1.2 million for each year he was in prison. At least $500,000 for each year would be a more palatable amount than what they are offering now. I also agree that he should be exempt from taxes forever or the state should pay them for him. Or let that bitch who fingered him pay his taxes from now on!

and to this cracker bitch, WTF do we care about you being moved by robert clark's demeanor? robert clark's demeanor shouldn't even enter into any of your considerations... you mean to tell me if he was angry and outraged instead of gracious and humble you'd weigh in differently on the issue of his restitution?

So you can just handicap that a 20 year-old's earning potential just like that. I can't.

Plus, even in the 80s, I would not have gone to jail an innocent man for $48,000 a year.

Lets do some math, though:

25 years x 365= 9,125 days in prison as an innocent man. Now, unlike working a 9 to 5 job, being in prison is a 24 hour sentence, so that's like 219,000 hours that needs to be compensated.

So, uh... $1,200,000 divided by 219,000 is about $5.50 an hour.

So, he's actually being paid a little more than minimum wage ($5.15) for his time and suffering.

That's fair????

1.2 million aint shit for all those yrs

IF he gets a good lawyer, he could take them for at least a million a year

here's another story I posted a while back about a man in Connecticut who just was released last year for wrongful conviction of rape, spent 18 yrs in prision, the governor there offered $500k as compensation, but he's seeking 5 mil, when he could get 18, 1 mil a year for every yr he was in lockup
