Yeah....The shooter is going to spend some time in prison. That is attempted murderThe young lady lucky she ain't dead. If I were the judge I would allow it, but the shooter, by the law, is guilty as fuck.
If the chic that attacked the female with the baby really called the police she is going to jail too. You can't assault someone while they are holding a baby. Shit the chic that shot may not even be change.

She might get lucky and get aggravated assault. But, attempted murder is a stretch. She didn't shot her in center mass, so, she won't get that charge.Yeah....The shooter is going to spend some time in prison. That is attempted murder![]()
Nigga, what?!!She might get lucky and get aggravated assault. But, attempted murder is a stretch. She didn't shot her in center mass, so, she won't get that charge.
Niggah, you can't read? How will you get an attempted murder charge that will stick by shooting someone in the leg? There is no intent. Any reasonable lawyer would argue that she was incapable to physically defend herself because you can tell she recently had the child. Thus, the use of a gun. It would make her action proportional to the situation. For example, if someone was kicking you off in your ass like that girl was doing to her and you were sick, then using a gun would be the equalizer. You motherfuckers alway running your mouths and shit but you don't know what a motherfucker knows. If she does get charge with attempted murder, then she will either get off or get the lesser charge of aggravated assault.Nigga, what?!!

Endangering the welfare of a child.. self defense from the individual who put a kid in danger and innocent mother… could flip it on the gun victim and get some kinda mental health pass cause of the traumatic experience.. find a jury who have kids.. well them jurors have a higher percentage of finding the shooter not guilty cause they to would shoot a motherfucker that would put their kids in harms wayYeah....The shooter is going to spend some time in prison. The law is trying to make you pay. They don't want you to get off. The prosecutor realizes that most people are not going to convict her after she got her ass whipped and in retaliation she shoots the other woman in the knee. No one, and I mean no one, will convict that woman of attempted murder if you bring her to trial for that. Aggravated assault, yeah, but attempted murder, nawh. So, more than likely the prosecuting attorney will either not prosecute or go for the aggravated assault charge. Since this shit is a money game, then she gone get charged but after seeing that other woman beat the brakes off of her and knocking that baby out of her hand, she might get off. If I was the judge in this case I would throw this shit out. This is a waste of tax payers money. You fucking reap what you sow. More then likely, there will be a plea offer of probation and it might be for the amount that she would've went to jail for if convicted. If I was in her shoes, I would most definitely take that shit to trial. Whose gonna fade her. She will get off. Finally, I didn't say that the charge was off the books, I am saying who will charge her for that due to the situation and circumstances. Its not going to happen, and if it does, then it won't stick.Ok, so I just did some searching.
In the past, it was believed shooting someone below the waist would result in lesser charges
(Assault with a deadly weapon, manslaughter....etc)
And that any shots above the waist / near center mass would be automatic attempted murder.
However, that is not the case.
Especially, if you are black. More often than not, any weapons discharge, regardless of wound location will result in attempted murder.
See this
And this
"A person can be charged with attempted murder by shooting even if he/she does not hit the intended victim or anyone else. The focus is on the act attempted. A lesser-included offense may be assault in the first degree. There may be certain defenses that apply."
That would have to be jury nullification.Endangering the welfare of a child.. self defense from the individual who put a kid in danger and innocent mother… could flip it on the gun victim and get some kinda mental health pass cause of the traumatic experience.. find a jury who have kids.. well them jurors have a higher percentage of finding the shooter not guilty cause they to would shoot a motherfucker that would put their kids in harms way
As a juror would you be comfortable in giving a female who was attacked by a person while she was carrying her child 7-10 yrs for shooting them in the leg? Would you be comfortable knowing that the kid might be put in an unfamiliar home( adoption/foster care) cause you put their parent behind bars for defending both of them?… these are the things you would have to live with as a juror if you voted guiltyThat would have to be jury nullification.
Any competent jury would find her guilty regardless of the circumstances. You cannot use deadly force unless your life is in immediate danger. The chick she was fighting was 50 feet away from her. She pursued shooting her. Plus, she shot her with several people standing around! That was just reckless IMO.
Had she been able to get to the gun DURING that initial attack, then she could claim self defense, but there was no immediate threat.
No way the shooter avoids prison.
