Crystal Mason, 43, says she didn't know a felony conviction made her ineligible to cast a ballot in 2016.

Crystal Mason, 43, testified in court that she did not know that she was ineligible to vote due to her 2011 fraud conviction before casting a provisional ballot in the presidential election. In Texas, knowingly voting illegally is a second-degree felony, punishable by up to 20 years in prison.
"A second degree felony for voting illegally? That's outrageous," J. Warren St. John, her defense attorney, told NBC News on Friday. "The punishment does not fit this crime."

Texas' ballot asks voters to certify that they have completed their sentences — including supervision — if they have previously been convicted of a felony. Mason testified in court that she did not read the fine print because an election worker was helping her with the provisional ballot.

"She voted in good faith," St. John said, noting that she accurately filled out her own information and wasn't trying to obscure her identity. "She didn’t intentionally vote illegally and that’s the whole issue."
Mason had pleaded guilty in 2011 to inflating tax returns while working as a tax preparer and was sentenced to 60 months in federal prison, according to her attorney. She had served roughly three years before being released in 2016.

St. John said that Mason was never told in court, prison, or her halfway house that she couldn't vote until the entirety of her sentence was complete. Her probation officer also testified in court that he had not told her she couldn't vote.
Mason is appealing the judge's ruling, and out on bond pending that appeal. Because the crime is also a violation of her supervised release, she could still be arrested by federal authorities and sentenced to additional federal jail time for violating the terms of her release. St. John said federal court had not yet issued a warrant over the violation, however.

Mason is not the first to receive a severe sentence for voting illegally. A Texas resident and Mexican citizen with a green card, Rosa Maria Ortega, was sentenced to eight years in prison for casting an illegal ballot. Ortega had even served as a poll worker, and she, too, reportedly said she did not know she couldn’t vote.

Still, not everyone gets hard time. A North Carolina prosecutor declined to bring charges against a woman who said she cast an illegal vote for Donald Trump in order to fulfill her mother's dying wish. "She made a mistake out of sheer ignorance without any intent to defraud or commit a crime," the prosecutor said, according to a local report.

An Iowa woman charged with voting twice for Donald Trump last fall has pleaded guilty to election misconduct.

Court records show Terri Lynn Rote entered a plea on June 27 to the felony charge and a district court judge in Des Moines accepted the plea. Sentencing is set for Aug. 15.

Rote, who is 56 and lives in Des Moines, told police she turned in two absentee ballots before the November election because she believed Trump's unsubstantiated claims that the election was rigged and that her first ballot would be changed to a vote for Hillary Clinton.

She was arrested on Oct. 21 at a satellite voting station in Des Moines attempting to vote the second ballot.

Court documents show attorneys are recommending two years of probation and community service.

A former chairman of the Colorado Republican Party, Steve Curtis, was sentenced Friday to four years probation and 300 hours of community service stemming from a voter fraud and forgery conviction for signing his ex-wife’s ballot during the 2016 election.



Krista Henery, a spokeswoman for the Weld County District Attorney’s Office, confirmed the sentence to The Denver Post.

Curtis, 58, was charged in February after authorities said they found DNA evidence, and handwriting analysis linked him to the ballot of his ex-wife, Kelly Curtis.

Kelly Curtis moved to Charleston, S.C., in December 2015, according to what Weld County prosecutors say was introduced at trial, and when she called the county’s clerk and recorder to get her mail-in ballot, she was told she had already voted.

Prosecutors say they found that Curtis — who was the state’s GOP chairman in the late 1990s and also worked as a KLZ radio host — forged his ex-wife’s name on her ballot and mailed it in.

Prosecutors and The Greeley Tribune reported that Curtis claimed during the trial that he signed her ballot while he was suffering from a middle-of-the-night diabetic episode and then unknowingly mailed it in the next day.
He was convicted in the case in December.

Prosecutors initially said that Curtis faced up to three years in prison.

The 43-year-old former tax preparer hadn’t even planned on voting until her mother encouraged her to do it. She had only recently been released from federal prison for a 2012 tax fraud conviction, in which she pleaded guilty to inflating returns for her clients, her attorney, J. Warren St. John, told The Washington Post.

She was still on community supervision at the time of the election — but no one, including her probation officer, St. John said, ever told her that being a felon on supervision meant she couldn’t vote under Texas law.

Now, she’s going back to prison for casting a ballot illegally — for five years.

Mason was indicted on a charge of illegal voting in Tarrant County, Tex., last year and found guilty by State District Judge Ruben Gonzalez on Thursday, despite her protestations that she simply was not aware that she was barred from casting a ballot and never would have done it had she known.

As she told the Fort Worth Star-Telegram at the time she was indicted: “You think I would jeopardize my freedom? You honestly think I would ever want to leave my babies again? That was the hardest thing in my life to deal with. Who would — as a mother, as a provider — leave their kids over voting?”

The case is yet another illustration of Texas’s zealous crackdown on voter fraud, a problem that state GOP leaders have described as “rampant” in the past but for which they have yet to provide hard proof, save for isolated cases such as Mason’s.

In a 2016 ruling rejecting Texas’s stringent voter ID law, which state lawmakers had pitched as a way to stop voter fraud, the U.S. Court of Appeals for the 5th Circuit found only two convictions for in-person voter fraud out of 20 million ballots cast in the years before the 2011 passage of the law.

While in-person voter fraud is considered extremely rare, mail-in voter fraud is less so. In 2016, Dallas County had to sequester roughly 700 suspicious mail-in ballots for a city council race after receiving complaints from voters, who received mail-in ballots they didn’t request.

Still, after the 2016 general election, President Trump assembled a now-defunct “voter fraud commission” amid his baseless claims that millions of people voted illegally. Texas’s pursuit of in-person voter fraud reflected the Trump administration’s zeal.

In February 2017, another woman in Tarrant County, a Mexican national with a green card, was sentenced to eight years in prison after falsely claiming to be a U.S. citizen on her ballot. According to the Fort Worth Star-Telegram, Rosa Maria Ortega, a mother of four, testified that she had confused the difference between rights granted to legal permanent resident and to a U.S. citizen, which a jury did not buy. She had voted as a Republican in elections in 2012 and 2014.

“This case shows how serious Texas is about keeping its elections secure, and the outcome sends a message that violators of the state’s election law will be prosecuted to the fullest,” Texas Attorney General Ken Paxton said after Ortega was sentenced. ”

St. John said he believes that Mason’s five-year prison sentence, for what he said was an honest mistake, is a direct result of such rhetoric from Paxton’s office.

“She voted in good faith. She showed who she was. Everything was truthful,” St. John said. “Just like she said in court, ‘Why would I want to jeopardize all the work I did to get out of prison, go to the halfway house and get back to my family, if I knew voting was going to get me into prison?”

On the day of the presidential election, Nov 8., 2016, Mason arrived at her polling place to find that her name wasn’t on the voter roll, St. John said.

An election worker offered to help, he said, and presented her with a provisional ballot, which allows a person to cast a vote as long as they certify they are eligible by signing an affidavit. Small print at the top asks the voter to certify that if she is a felon, she has fully completed her sentence, including supervision or parole of any kind. Mason tried to explain to the judge that, since an election worker was helping her, she was not reading carefully, which, St. John said, failed to sway him.

Ultimately, her vote didn’t even count. Provisional ballots are subject to review, which ultimately led to an investigation of Mason.

St. John said he has already filed an appeal, hoping to keep his client out of prison so she can remain with her family. The Fort Worth Star-Telegram reported that a “chorus of small children” waved goodbye to her as a bailiff led her back to jail, saying, “Bye-bye, Big Mama.”

“I don’t think I’ll ever vote again,” she told the news outlet after her indictment. “That’s being honest. I’ll never vote again.”

Yea I have been trying that. Sometimes I wonder if it is something in the food. For some reason those of us that move in that direction seems to have all the bad luck. I have lost so much money trying to start a legit black business. Right now all I can do is keep hustling and every now and then gamble. Sometimes when I hustle up enough money to half way start something the money leaves so fast that it seems I was only dreaming I had it. They have some many ways of getting the money from us when ever we do get it. But the blacks with money are living life just to be living it. There seems to be no desire or will to build. That is what is around me and probably the same where you are at.
I was reading a book a long time ago about the proof they had that blacks and Chinese shared the pyramids. At one time Chinese were militant with there culture and certain practices in the martial arts they kept it secret from other races. A lot that has changed. But our true identity is almost totally hid. That is one of the reasons why we are controlled by white laws now. What is really going on is hid with illusions and tricks.
I use to support the nation of islam a lot as a devoted customer. Almost joined at one time but my activities landed me in prison at the time I was about to join. Now I try to build my own thing.

ironically they recently made it so bcuz 2 cops allegedly raped a girl but they claimed it was consensual and since @ the time it was legal for cops to have consensual sex w/ detainees it became their word against hers

I misworded it a little but since these states allow cops to have consensual sex w/ detainees...if they rape a detainee they can lie and say it was consensual...so it becomes their word against hers and we already know how that plays out when they shoot unarmed ppl...that’s probably why that holtzclaw cat felt so “empowered” to rape all those women and I believe he even tried to say it was consensual but his ass was in oklahoma tho

you are correct. i remember that case. i'm think about inmates oppose to detainees. that shit is crazy. mfs playing with honor codes. like if cops are morally honorable. they're human. humans are imperfect. scary. you get arrested and a cop sodomy you and face no charges. like why would a detainee consent while being under under pressure. sick.

I knew you couldn't do it but I didn't know the consequence was this severe. I didn't even know this was considered voter fraud. This some bullshit. I'm shocked it doesn't happen more frequent.
