Texas drunk drivers must pay child support if they kill a parent

A new law in Texas requires convicted drunk drivers to pay child support if they kill a child’s parent or guardian, according to House Bill 393.

The law, which went into effect Friday, says those convicted of intoxication manslaughter must pay restitution. The offender will be expected to make those payments until the child is 18 or until the child graduates from high school, “whichever is later,” the legislation says.
 
This sounds good on paper but one of the posters made a good point how are you going to pay child support in prison? People I think this bill was a fluff bill to hide the other stupid laws that went into effect on the first.
 
in Texas, is is not uncommon to be charged with 2nd degree murder in a DUI that ends in death.
I remember a few years ago this dude was driving drunk and blew thru a stop sign.........killed some people in the other car.
He was not only charged with vehicular homicide, but 2nd degree murder as well. Judge gave him 32 - 60 years.
So if this law is going to force those convicted of that to pay child support, then it would have to be contingent upon them
not spending a lifetime in prison.
So its gonna be either you punish them and send them to prison for a long time...........or give them very few years in prison with the hopes
of them landing a job when they get out so they can pay child support.
But here in Texas they go for more stiffer sentences than the short ones. So good luck with that law.
The parents will be damn near dead and the child will have grandchildren by the time they get out......and thats if they dont die in prison first.

To what? This is a clear overreach, this could be applied for any violent act while the victim is either killed or disabled. & then, what's next after that. For example, remember when people on the sex offender list used to only focus on pedophiles and rapists? Do you remember that? Well if you pee outside in Michigan then you can be on the sex offender list now.....that's the slippery slope meaning it's another tool to control the populace under the guise of law-and-order:

Totally agree. I've told this story before, but one of my wife's ex co-workers had to register as a sex offender, because he had his daughter for the weekend, and he let her have a sleep over with her friends. After he put everyone to bed, he went to bed, but it was hot, so he slept in the buff. While he was asleep, one of his daughter's friends got nosy and decided to creep through the house. She opened his door, saw him, and when she got home, she told her mom what she saw. The mom reported him, and it was all downhill from there. He didn't get any jail time, but he did have to register. I'm sure that's not what they had in mind when they created that law.

A lot of that sex offender shit started getting weird. Like threads on BGOL where they advocate for treating 17-year-old males as fucking little kids if they were with a 22-year-old teacher. People buying into that 'power dynamics' horseshit simply because they want to see a cac bitch in prison, so they advocate for bullshit laws.

There are fucking differences between men and wome, male and female, but certain types wanted to lump everyone together and that lead to a lot of fucked up laws because of their insane obsession with power dynamics.

Also, look how drunk men are a joke if they have sex with unattractive women but when a drunk women does it she is raped because drunk people can't consent. If both parties are drunk, somehow the man is at fault. Again, the bullshit power dynamic obsession comes into play.

In reality, all laws are slippery slopes.

Like how are you going to pass this law in the state that doesn't have a mass transit system? A state where the vast majority can't safely walk home from a bar? A state filled with strip malls on roads with 4+ lanes and other things that make driving inherently more dangerous.

Since most people drink Texas is basically setting up their citizens to fail.

Because people forget that a 0.8 BAC is the point where a cop and DA have to charge you. Below that it's completely up to their discretion.

In other words, you're at home watching football drinking a single beer and your wife calls, tells you her car broke down, and needs you to pick her up. On the way to get her the sun gets in your eyes and you hit someone who happens to be a dad. Your BAC might be .04, or half the legal limit, but if that cop decides that the alcohol caused the accident you're fucked for life.

On top of that, they're acting like alcohol is the only thing responsible for these crashes. What about people who get behind the wheel after only 4 hours of sleep? How about people who text when they drive? Do they have to pay the child support too?

If not then this is just a feel-good morality law that has no real benefit and could end up hurting a lot more people than it helps.
 
For a citizenry so interested in freedom and don't tread on me Federal government they sure cede a lot of control over to the State.

that's been law in Michigan dummy, forever, If you get caught peeing outside you will be registering with sex offenders, nothing new here and I still piss outside if I have too. shit been on the books for probably 20 years plus
