“That was his dream,” heartbroken Cecilia Reyes said Friday. “All he wanted to do was go to the military, continue his career in the military, and then continue his career as an officer.”

“That’s why he went into the Army,” baby sister Amanda Reyes chimed in. “He always wanted to be a cop.”

Polanco’s loved ones lamented their loss as the Queens District Attorney opened a formal investigation and prepared to question the shooter, identified by sources as 39-year-old Det. Hassan Hamdy.

Internal affairs has already begun questioning the other officers who were with Hamdy when they stopped Polanco’s car, sources said.
“The big question is ‘what happened when the detective approached the car?’” a source said. “Why did he shoot?”

Polanco’s sister said her brother enlisted six months ago and “there wasn’t a bad bone in his body.”

“He was my oldest brother,” the 15-year-old said. “He always had time to sit with me and talk it through.”

Polanco was her rock when her father committed suicide three months ago, she said.

“It’s hard,” Amanda Reyes said. “I lost everything now. My father and now my brother ... I lost my world.”

Polanco’s mom is now consulting a lawyer and planning a benefit for her slain son Sunday at the Ice Lounge in Astoria, the Queens nightspot where he worked.

“It hurts. He was just innocent,” the grieving sister said. “We just want justice.”

Polanco’s National Guard unit up in Kingston is also planning a vigil for their “company clown.”

“I love the guy. We all did,” said Specialist Radoslaw Mosiej, “He was more than a brother.”

Polanco was also an aspiring tattoo artist.

"I guess I was one of his guinea pigs,” said Mosiej, who sports a Polanco original on his chest. “It didn't come out perfect but .. it's a heart on my chest with my wife and son's names.”

Polanco, 22, of LeFrak City, was killed early Thursday after he was pulled over by cops on the parkway near LaGuardia Airport. He had no police record and was driving co-worker Diane DeFerrari and an off-duty NYPD officer, Vanessa Rodriguez, home at the time.

Hamdy, a 14-year veteran of the force, had never before fired his Glock pistol in the line of duty.

Police contend Polanco was driving erratically and refused to stop when two unmarked Emergency Service Unit vehicles began chasing him.

They said once officers pulled Polanco over and approached his Honda Fit, they told everybody to put up their hands. They said Hamdy was on the passenger side and shot through an open window.

DeFerrari told The News that cops killed her pal in an act of “pure road rage” because he cut them off in traffic.

“Noel didn’t have a chance to put his hands up,” said DeFerrari, a mother of three. “They screamed, ‘Put your hands up!’ and shot at the same time.”

Michael Paladino of the Detectives' Endowment Association dismissed DeFerrari’s account as “absurd.”

“No cop would shoot a person whose both hands are on the steering wheel,” he said. “Who's she kidding?"

A 4-volt Ryobi power drill was found in the car, but no weapons.

Polanco’s mom said her son used the drill at the local Honda dealership where he also worked.

“What’s so bad about a drill?” Polanco’s mom asked. “What could he have done with a drill, honestly?”

Police say Polanco and Rodriguez had been drinking cognac before the 5:20 a.m. shooting.

DeFerrari, 36, insisted she was sober because she’s watching her step after two drunken-driving arrests. She said she was sitting in the passenger seat beside Polanco and had no problem identifying Hamdy as the shooter.

Rodriguez, 29, was in the back seat and police said she was awakened by the gunshots. But sources said Rodriguez was waving her police ID out the window just before the shooting.

Rodriguez has a checkered history with the NYPD, court records show. She was stripped of her gun and badge after she was busted for shoplifting a sweater from a Queens H&M store in June.

This could be a case of both road rage and 'roid rage. The officer was either extremely agitated or out of control in order to shoot and kill the driver. Killing an unarmed civilian with a sketchy claim that the civilian was "endangering the life of an officer" brings up serious questions pertaining to the cops ability to discern a situation. And I seriously doubt the officer in the back seat of the car was asleep. She was most likely told by cops on the scene to keep her mouth shut or face arrest.

We have, of course, seen this before. The Amadou Diallo shooting where cops from the "Elite Street Crimes Unit" murdered the unamed Diallo standing in the entrance to his home. Then the 'weapon' that never exited was supposedly the man holding his wallet in his hands. This is all about the mistake made in training cops to not do what we pay them to do, which is take risks so that the innocent remain unharmed. In combat troops can disciple themselves not to shoot even when fired upon if the chances are return fire will harm the innocent. In the NYPD and many other police agencies that is considered an unacceptable risk. Killing the innocent, as in this case and Mister Diallo is considered part of the job, which is protecting the armed and armoured cop, not the innocent unarmed civilian.

A Queens grand jury voted not to indict a veteran NYPD detective, rejecting a witness account that he fatally shot an unarmed man in an act of road rage on the Grand Central Parkway.

The decision on Thursday not to indict Detective Hassan Hamdy stunned the family of Noel Polanco, the 22-year-old National Guardsman killed Oct. 4.

“The family of Noel Polanco is extremely disappointed,” said attorney Sanford Rubenstein.

Polanco’s mother, Cecilia Reyes, was too distraught to speak, but remains determined in her “quest for justice,” Rubenstein said.

The Rev. Al Sharpton, who gave the eulogy at Polanco’s funeral, vowed to stand with the G.I.’s family in demanding “better policing throughout the city of New York.”

Upset loved ones gathered Thursday at Polanco’s grave at Maple Grove Cemetery in Kew Gardens, Queens, leaving fresh flowers, a Valentine’s Day card and a teddy bear on the headstone.

Through his attorney, Hamdy, a 14-year NYPD veteran assigned to the Tactical Apprehension Team, said he was “extremely relieved” and extended his condolences to the Polanco family.

Hamdy, 39, was never taken off full-duty after the shooting. He could still be brought up on departmental charges, pending an internal probe.

Polanco was driving the Honda Fit when he apparently cut off the NYPD truck carrying Hamdy.

Queens District Attorney Richard Brown said his office conducted a “thorough, complete and independent investigation.”

Brown said prosecutors met with the grand jury nine times over five weeks to lay out the evidence.

The NYPD had no comment.

Polanco, who dreamed of becoming a police officer, worked filling hookah pipes at the Ice Lounge in Astoria. He was giving co-worker Diane DeFerrari and a friend, off-duty cop Vanessa Rodriguez, a ride home to LeFrak City in Elmhurst, Queens, when he was shot.

Witnesses said Polanco had been drinking before he left work.

Cops said they pulled over Polanco’s Honda Fit about 5 a.m. after he twice cut off an unmarked NYPD Emergency Service Unit van. During the stop, Hamdy fired a single shot through an open window. The bullet missed the front seat passenger, DeFerrari, and hit Polanco. Rodriguez was sleeping in the backseat of the car at the time.

Hamdy claimed he opened fire because it appeared Polanco was reaching under his seat for a gun instead of putting up his hands as he was ordered to.

DeFerrari had said the gunfire appeared to be the result of “road rage” and that Polanco didn’t have a chance to put up his hands before he was shot.

The mother of an unarmed National Guardsman slain by an NYPD detective will file a federal lawsuit Tuesday against New York City and the man who shot her son on the Grand Central Parkway, the Daily News has learned.

Noel Polanco, 22, was shot once in the chest by Emergency Service Unit Detective Hassan Hamdy, who said the victim was reaching under the car seat after being ordered to keep his hands on the steering wheel.

Polanco’s mom, Cecilia Reyes, said: “I will continue to fight for justice to hold accountable those who were responsible for the death of my son.”

Lawyer Sanford Rubenstein says Polanco’s family believes the criminal justice system failed them after a Queens grand jury declined to indict the detective and Brooklyn U.S. Attorney Loretta Lynch did not respond to a request for a civil rights probe.

“The filing of this lawsuit is the first step in this family’s efforts to get civil justice,” Rubenstein said.

The suit, to be filed in Brooklyn federal court, seeks unspecified monetary damages.

Diane DeFerrari, a co-worker of Polanco’s at an Astoria hookah bar who was a passenger in the front seat and witnessed the shooting, is also suing for emotional damages.

Polanco was driving home at about 5:15 a.m. on Oct. 4, with DeFerrari and off-duty cop Vanessa Rodriguez sleeping in the backseat, when he was pulled over for reckless driving by Hamdy, who was operating an unmarked Emergency Service Unit van.

The detective fired one shot.

Polanco had consumed “three to four glasses of Hennessey cognac” earlier and his blood-alcohol level was nearly twice the legal limit when he was slain, according to a police report.

No weapon was found in the car — there was a power drill under Polanco’s seat.

The city Law Department said it would review the court documents. NYPD spokesman Paul Browne did not respond when asked whether the firearms discharge review panel had determined if the shooting was proper.

Detectives Endowment Association lawyer Philip Karasyk said, “It has always been our belief that Detective Hamdy acted well within the limits of the law as well as the department's guidelines.”

A former NYPD cop is finally getting his day in court against the fellow officers — including a former bodyguard for Rudy Giuliani — he says beat him so badly that they left him brain-damaged more than two decades ago.

Antonio Echevestre, 53, says cops repeatedly cracked him in the head with a nightstick during a brawl outside an upper Manhattan bar in November 1991.

The attack left Echevestre with an IQ of 79, his lawyer Bonita Zelman said in the very long-awaited opening arguments in Manhattan Supreme Court on Monday.

The incident started when a group of off-duty cops went to a bar in Washington Heights following a fund-raiser for another officer who had a sick child.

There, Echevestre’s partner, Scott Thompson, got into an argument with another cop, Kevin Tracy, and they took their differences outside, said Tracy’s lawyer, Thomas Cascione.

Thompson, a karate enthusiast, handed his gun to Echevestre and took off his shoes for the fight against the bodybuilding Tracy, Cascione said.

Tracy decked him with one punch, leading Echevestre to jump in, Cascione said. Then, Tracy’s bodybuilder partner, Pat Brosnan, grabbed Echevestre, telling him, “Two on one isn’t fair,” Cascione said.

Uniformed cops arrived and Echevestre — who was on modified duty already for a domestic incident — took a swing at them and tried to run, tossing Thompson’s gun as he did, Cascione said.

“By the time they figure out he’s on the job they’ve cracked his head with a nightstick,” he said.

Zelman said Brosnan slammed Echevestri into a cop car. She said cops hurled racial slurs at him, and whacked him in the head several times. She added he identified himself as an officer.

Echevestre and Thompson’s suit names Tracy, Brosnan, patrol cops Anthony Tetro and John Rossi and the city as defendants.

Each side blamed the other for delays getting to trial. Brosnan, who protected Giuliani during his 1993 mayoral campaign, and Echevestre had other issues afterward.

Brosnan was involved in a shooting in which two drug dealers were killed in 1995. A related suit against the city was settled for $1.15 million.

Echevestre was arrested and sued in 2008 for allegedly sexually molesting his girlfriend’s teen daughter. The charges were later dismissed and the suit was withdrawn.

Federal prosecutors have launched a preliminary investigation into possible civil rights violations in the fatal shooting of an unarmed National Guardsman by an NYPD cop, the Daily News has learned.

The probe was revealed Tuesday in Brooklyn Federal Court by lawyer Sanford Rubenstein who has filed a wrongful death lawsuit on behalf of victim Noel Polanco.

The lawyer told Magistrate Judge Roanne Mann that he was informed of the federal investigation by a top official of the Queens district attorney’s office.

Another source familiar with the federal probe confirmed Rubenstein’s information, but cautioned that the investigation by the Brooklyn U.S. attorney’s civil rights section was in the early stages and no conclusions have been reached.

Another source said the feds are seeking the minutes of the Queens grand jury that declined to indict Detective Hassan Hamdy of the Emergency Service Unit in the fatal shooting on the Grand Central Parkway.

“A criminal investigation by federal prosecutors is important in determining if the matter should be put before a federal grand jury,” Rubenstein said.

Polanco was driving home on Oct. 4, 2012, from an Astoria hookah bar with a co-worker in the front passenger seat and an off-duty cop sleeping in the back seat, when he was pulled over for reckless driving by Hamdy.

Hamdy told the grand jury that Polanco disobeyed his order to keep his hands on the steering wheel and was reaching under the front seat for a weapon when the veteran detective fired one shot through the open passenger side window. Hamdy’s lawyer has maintained the detective feared for his life and acted within the limits of the law and NYPD guidelines for using deadly force.

A spokesman for Brooklyn U.S. Attorney Loretta Lynch declined to comment.

The city is paying a $2.5 million settlement to the mother of an unarmed National Guardsman who was shot to death by an NYPD detective during a car stop on the Grand Central Parkway, the Daily News has learned.

Noel Polanco was shot once in the chest by Emergency Service Unit Detective Hassan Hamdy, who fired his service weapon through the open passenger side window because he believed the man was reaching under the seat.

Hamdy was cleared of criminal wrongdoing by a Queens grand jury. The Brooklyn U.S. attorney’s office also reviewed the incident and concluded the detective did not intentionally violate the victim’s civil rights.

“This is a fair settlement for damages for the wrongful death of this fine young soldier who should not have died the way he did,” lawyers Sanford Rubenstein and Scott Rynecki said in a statement.

But Polanco’s mother, Cecilia Reyes, said the seven-figure settlement does not heal her broken heart.

“I want the NYPD to fire this officer,” Reyes said. “He should not be on the street with a weapon.”

Polanco, 22, was driving home from a hookah bar with co-worker Diane DeFerrari on Oct. 4, 2012, when he was pulled over by Hamdy for reckless driving. It was later determined that Polanco’s blood-alcohol level was twice the legal limit.

Detectives’ Endowment Association lawyer Philip Karasyk said Hamdy has remained on full duty since the shooting, but has been assigned to the ESU base.

Because when they guess wrong, unarmed people get killed. if you don't want that risk, don't be a cop. And there was a cop in the car, off duty at the time. There was no reason for gun play here except the cowardice and poor situational judgement of this officer.

The NYPD detective who shot and killed an unarmed National Guardsman during a traffic stop on the Grand Central Parkway was slapped with a departmental charge for the man’s death, sources told the Daily News.

Emergency Service Unit Detective Hassan Hamdy was charged late Thursday with “failing to employ proper tactics causing a civilian’s death” for blasting Noel Polanco, 22, in the chest after he was stopped for reckless driving on Oct. 4, 2012, the sources said.

“He’s not happy about it,” said one source who spoke to the 15-year veteran after he was charged.

Law enforcement sources said Sgt. Thomas Glaudino, who was leading Hamdy’s unit at the time of the shooting, was expected to be charged with failing to supervise his team on Thursday morning.

Hamdy, a former U.S. Marine, was cleared of criminal wrongdoing by a Queens grand jury last year — but the city agreed to pay a $2.5 million settlement to Polanco’s family in February.

The family’s lawyer, Sanford Rubenstein, said they agreed with the charge against Hamdy, which could result to his termination if found guilty.

“Based on the facts of what happened, these charges are appropriate,” Rubenstein said. “Mr. Polanco’s mother has said from the beginning that this detective should be removed from the force.”

Police maintain that they tried to stop Polanco — who was heading home from a hookah bar with a co-worker, Diane DeFerrari, and an off-duty police officer — after they spotted him driving erratically along the Queens highway.

The team of officers managed to pull Polanco over after they boxed him in along the divider.

Hamdy approached the car from the passenger side and fired a single shot at the driver when he said he saw Polanco reaching under the seat.

A test later revealed that Polanco’s blood-alcohol level was twice the legal limit to drive.

Ed Mullins, president of the Sergeants Benevolent Association, argued that the officers should not be charged.

“This is a typical scapegoat reaction by the department, second-guessing what happened,” Mullins said. “The Queens DA’s office saw no criminality. The people writing the charges weren’t there and they have no business second-guessing what took place.”
