Rein: Console Limitations to Stifle PC Games
By Tom Ivan

Epic vice president Mark Rein believes that DirectX 10 won’t be truly exploited until the next generation of consoles hit the market as it's less financially viable to create high-end PC games that can’t run on PS3 and Xbox 360.

Speaking to CVG, Rein said that developers were unlikely to waste their time creating “super high-end stuff” as publishers generally put their money where the greatest return is.

“Consoles will pretty much define what the next five years of games look like on the PC,” he said.
crysis_1.jpg

"To be honest, and I'm going to cast a small pall on the industry here, I don't think you're going to get much higher [than the likes of Crysis, pictured] until the next generation of consoles.

“… We're just barely coming into the sweet spot of the next-gen consoles... We're at the point where it's viable to ship games on these next-gen consoles and it's going to be a gold mine for a couple of years.

"Publishers are generally putting their money where the highest return is, and in the past that's been on consoles and I think that's still the case. So if you build the game that's a really super amazing high-end game, how do you make all the money you could make from that game, because it'll be too high-end eventually to be on PS3 or Xbox 360."

Mod restrictions holding back UT3 360

Sony's timed exclusive with Unreal Tournament 3 looks to have happened in part thanks to Microsoft. According to Epic Games' Mark Rein (via CVG), unresolved issues with downloadable user mods on the Xbox 360 led the developer to delay the shooter until "some time after the new year." Rein also confirmed this news to Joystiq in an interview to be published tomorrow.

Because of the closed nature of the Xbox Live network, setting up a system for PC users to share mods with Xbox 360 users would be challenging, especially since there is no cross-platform connectivity via Microsoft's Games for Windows Live. "And Microsoft's got a very busy Christmas schedule... We just couldn't get enough attention from them to solve that problem," he told MCV.

"Worst case scenario would be Epic bringing popular mods onto the 360 and putting them through the certification process," Rein told us. "Because that's the way it works today. Or selling them in Marketplace, or convincing Microsoft to let us give some away for free," he said.

"That's the worst case scenario. Hopefully it will be better than that, but we know nothing yet about how that's going to work and that's why we're totally concentrating on the PS3 right now, in terms of consoles," he said.

Take-Two ex-CEO sentenced to 5 years (of probation)

ryanbrantsentenced.jpg

Former Take-Two CEO Ryan Brant has avoided a four-year prison bid by "cooperating" with the investigation into the game publisher's backdating scandal. In February, Brant plead guilty to the practice of backdating stock options and has accepted a plea bargain, which guarantees the white-collar crook supervised freedom so long as he pays the remainder of his fines by mid-October. Brant's already handed over $4.7 million. He owes an additional $2.6 million.

Under the conditions of the plea bargain, Brant is barred from "control management positions" in public companies. His attorney Lawrence Iason declined to comment on the possibility of Brant aiding in the recent convictions of two fellow ex-Take-Towers -- you know what happens to dirty, stinkin' rats...

GTA IV producers clarify delay, explain hardships behind outlaw game development

The boys at Take-Two have had a rough few days. Between the recently reported delay of the latest iteration in their flagship Grand Theft Auto series, and the revelation that former chairman and CEO Ryan Brant was playing fast and loose with company stock, the stress is enough to drive a man to strangle a hooker or two.

Gamasutra brings us a bit of clarification from current Take-Two chairman Strauss "No, I was not in Die Hard" Zelnick regarding the GTAIV delay, in the hopes of explaining the company's precarious position, and why exactly the delay was necessary.

Hit the jump for delicious quotes and succulent cuts of publisher remorse.

[Muchas gracias a Justin Villaseñor]

According to Zelnick, via Gamasutra:

"As many of you know, development of a video game, is a complex and time intensive process," said Zelnick, adding that "given our commitment to set new stanrdard[sic] for 2 relatively new hardware platforms simultaneously," an October release, given the most recent build, "wasn't an acceptable path."

Zenick reiterated that Take-Two's relationship with Rockstar was "rock solid," and said that the decision was made with the developer working "very closely" with a high amount of cooperation, and that it "wasn't something that either took lightly."

He said that there would be no penalty to Rockstar, "nor should there be one. We all work together as a team, and we support our colleagues at Rockstar."

Those all seem like reasonable alibis, but shouldn't they have known about this a few months ago? I like to believe that I represent the common man, and thus have very little knowledge of the inner-workings behind video games, cellular telephones and high fructose corn syrup, but it seems a bit suspect that issues would arise two months before the release of a title with as large a budget as this one that would set it back another six months or so. Did a bug spring up causing children to bleed internally, or is there more to this story than Mr. Zelnick is telling us?

In an effort to englighten and quell fears, Mr. Zelnick seems to have inadvertently created a massive black hole of speculation, one inhabited no doubt, by many of Take-Two's own shareholders. On the upside, none of them seem like the type to throw him from a skyscraper followed by a string of dry, cool wit.

PS3 Issues Caused GTA IV Delay?

Dr. Eggman writes "According to statements made by Michael Pachter on Gamasutra, [URL='The Rockstar team had difficulty in building an exceptionally complicated game for the PS3]'The Rockstar team had difficulty in building an exceptionally complicated game for the PS3[/URL] , and failed to recognize how far away from completion the game truly was until recently.' The article goes on to describe an agreement between Rockstar and Sony not to favor the 360 by releasing their version first, necessitating the delay on the 360 as well. Pachter's comments are interesting, because all Take-Two has been willing to say is that 'technological issues' were causing the hold-up. "

Teen Charged With Murder Over Xbox Arson

After a seven week trial, 15 year-old Matthew Stringer of Wombwell England has been detained for the murder of his brother and endangering the lives of five other members of his family after being grounded from playing his Xbox sparked him to pour white spirit (organic paint solvent) throughout his home and toss a lit match through the letterbox. The Xbox had been taken away after Matthew had been caught stealing from his older brother's college fund. Adam Stringer died of smoke inhalation, while his mother, sister, two brothers and one of their girlfriends escaped with minor injuries.

The courts were presented testimony that after setting the fire, Matthew Stringer stood calmly across the street with his arms folded as the house went up in flames. As is the case with many such incidents, the only explanation for this sort of behavior is that something inside the child was broken. I just tend to get a bit miffed when the headline in the local paper calls the boy the Xbox Arsonist, though I suppose astrologists weren't too happy with the Zodiac Killer either.

The boy will be held for a minimum of ten years before the possibility of release is considered.

PS3 Unreal Tournament 3 won't ship with editor, may need PC version to make mods

In an interview with some videogame Web site we've never heard of called Joystiq (just kidding, fellas -- we love you!), Epic's Mark Rein effortlessly crushes Chad Warden's modding dreams. It appears that that while the PlayStation 3 version of Unreal Tournament 3 will fully support mods, creating them will require the full version of the PC game, which will ship with a full editor.

"The editor is one of the selling points of the PC version. PS3 owners will need to buy the PC version as well, if they want to make mods. Not if they want to play mods. But, they would anyway because that's where the content is. Are we going to release the whole game for free? You need it for the content. Well, you don't need it if you're going to make 100% new content, but no mod does that."

In the same interview, Rein addresses the PS3 versions max resolution (720p), frame rate ("..it was running at least 30fps when I last saw it.), questionable mod content, and more.

Mark Rein always has a lot to say (a lot of which we can't legally print most of the time), so this interview is definitely worth checking out.

Thinking Out Loud: Reactions to GTA IV Delay
Good news for the game's quality, but how will it affect PS3?

By 1UP Staff, 08/03/2007
Thinking Out Loud: Reacting to the GTA IV Delay

Considering Rockstar Games' declaration of an October 16, 2007 release date for Grand Theft Auto IV at E3 2006, the company seemed pretty confident they'd hit their mark. In the past, the studio has announced specific release dates and hit them. That streak ends with Grand Theft Auto IV, however, as the next-generation debut slips out of an October timeframe into "spring 2008." In the latest installment of Thinking Out Loud, we've polled the 1UP Network editors for reactions to the delay and what it means for the industry.

Jeremy Parish, 1UP Features Editor
Gosh, next-gen development is expensive and time-consuming and difficult? What a shock. Though hardly a surprise, the delay is great news for everyone who isn't Rockstar, since it means smaller franchises will have a little room to stretch. (Now they only have to compete with Halo, Mario, Metroid, etc.) In the long run, that also benefits gamers, since it means great games with less hype (Bioshock, for instance) will probably do better, which in turn encourages publishers to take more risks.

It also means, hopefully, people will pay attention to the precedent set here: it's OK to skip a fall release if your game isn't ready. I'm sure Rockstar could get away with fixing the game via patches, so it's encouraging that they're taking the high road... even to their own detriment. The delay also means Rockstar might actually have time to make sure GTAIV isn't a bug-ridden mess, which would make it a genuine leap forward for the series.

This is highly disappointing news, especially since the GTA games have always been good about hitting release dates. I never thought Rockstar would let this happen. Plus, this kills my dreams of a BioShock, Halo 3, and GTA4 trifecta over the next three months (and it's got to hurt Microsoft more, since that was such a killer lineup). But then again, this fall is so loaded that those extra 70 hours will give me plenty of time to hit all the other games I'd inevitably pass over.

What I'm most worried about is whether the game will actually come out in spring. While next March or April is bad enough, next summer seems like forever from now. From our few demos, the 360 version seemed to be getting close, with mostly framerate issues that needed fixing (though we only saw small portions of the game), so one would hope it'd be sooner than later. But then again, we have never seen the PS3 version in action, which I have a feeling is what's holding things back.

Andrew Fitch, 1UP Network Copy Editor
I don't see how this is anything but good news for gamers. As Mario and Zelda creator Shigeru Miyamoto once said: "A delayed game is eventually good; a bad game is bad forever." It's always baffled me that more high-profile companies don't follow that philosophy. Not that Grand Theft Auto IV was ever going to be "bad," but it may well have turned out subpar had Rockstar rushed to push it out the door in October. Rockstar's had a rough couple of years, but despite parent company Take-Two's financial issues and the recent Manhunt 2 AO-rating debacle, the one thing that's remained is Rockstar's reputation as one of the best developers in the industry -- and that's a reputation they can't afford to lose.

Garnett Lee, 1UP Managing Editor
GTA IV's delay only comes as surprise because of repeated confirmations that it would make this holiday season. With the amount of trouble we both hear about and see developers having with cross-platform 360/PS3 development, it shouldn't really be a shock that, at least from what we've seen, one of the most adventurous titles yet shown for this generation would hit a few roadblocks. And it results in a collective sigh of relief from every other publisher with a potentially AAA title in the pipe for this fall. Otherwise, the situation hasn't changed all that much, has it? 360 still gets exclusive downloadable content, regardless of release timing, and whatever influence that has remains unchanged.

But what we really want to know is whether it will actually make the new date or not, right? Once a title starts slipping, especially a big one, that can become a long slide indeed. Some may argue that once it's missed holiday '07 it might as well go to holiday '08, but I think there's a reasonably good chance that one delay will be all we see, and Grand Theft Auto IV arrives just in time for Valentine's Day '08.

________

Crispin Boyer, EGM Senior Editor
The GTA IV delay hurts the PS3 way more than the Xbox 360. With Metal Gear Solid 4 already delayed until next year, the PS3's fall lineup is looking a little lean on triple-A titles, while the 360 still has big -- and exclusive -- stuff like BioShock, Mass Effect, and, of course, Halo 3. And if the GTA IV delay is, as suspected, due to the difficulties of making the game for the 360's limited storage format, then that's a double F' you to Sony, eh?

___________

Sam Kennedy, 1UP Editor-in-Chief
It's a big shame that the game won't hit this fall -- GTA IV was supposed to be one of the major drivers of next-generation console adoption this year -- but on the bright side, we're going to get a much better game because of it and this will perhaps allow some other titles to really shine when they previously wouldn't have. Whether this affects the PS3 or Xbox 360 more, I can't say, but it does put a big dent in Peter Moore's E3 claim of the Xbox 360 having the greatest holiday lineup ever. And I do feel bad for the Bungie guys who -- had Microsoft known GTA IV wasn't going to hit in October -- might have had an extra month to work on Halo 3 (either way, 4-player co-op is making it in, so I'm happy).

As for what caused the delay, there were reports a few weeks ago about the lack of the Xbox 360 hard drive as a standard giving Rockstar problems and speculation today that development for the PS3 was to blame (wouldn't surprise me, given that we haven't seen that version yet). But no matter the case, it seemed like an overall resources/time issue with having to develop the game for two distinctly different hardware platforms. And I can't say I was that shocked. Having seen the game a few weeks ago, there were quite a few "that's placeholder" or "this'll be tweaked" caveats throughout our demo and I raised concerns with Rockstar as to whether everything could be finished in time. Not that I didn't believe the folks at Rockstar North weren't capable of pulling off some amazing feats in the final stretch of development, but still, we were getting awfully close to October. And it's a freaking big game. On two separate platforms.

Looking back on it now, it was probably a bit premature for Rockstar to nail down a release date for GTA IV 18 months ahead of time. For a game as ambitious as it is -- especially on brand new hardware -- that's a tough thing to have visibility on. Especially for a developer that has had some unique luxury within Take-Two in terms of dictating, and keeping flexible, its own release schedules. But oh, what I would have given

Patrick Klepek, 1UP News Editor
When Rockstar boldly announced the release date for GTA IV over a year ago, I was already suspicious whether the company could honestly meet those expectations -- and it turns out they haven't. I doubt that decision did not come lightly, as it's going to greatly impact Take-Two's bottom line, but it appears technical constraints may have been at work here. Whether that's due to the PlayStation 3 version falling behind -- the game's only been demo'ed on Xbox 360 -- or difficulties getting the game to run hard drive-less on 360, we don't know, but the game's moving back a number of months, either way.

The industry is the biggest loser in this whole debacle; Halo 3 and GTA IV were to usher in the masses to the next-generation console race. Several of my own friends were waiting for GTA IV before diving in but with that one out of the picture, is that going to be the case? Heck, the longer they wait, the cheaper the price, so why not? On the other hand, a number of new IPs have a chance to shine a little brighter this Fall, but with GTA IV's machine pushing power out of the way, will these games simply languish amidst small user bases? Let's hope not.

RAGE Will Require 2 DVDs for All Platforms Except PS3
Filed under PC, Sony, Microsoft |

RAGE is making its way to a gaming platform near you unless you own a Wii. It is shaping up to be 60% shooter and 40% driving. Digest that in any way you see fit - that much driving/shooting might turn off some people or make the game more interesting.

The big news so far with this game is its size. The Xbox 360, Mac and PC will require 2 DVDs for this game while the PS3 will get away with 1 Blu-Ray Disk. So here comes the arguments against Microsoft’s use of an HD format in their next gen console. Should Microsoft have dumped DVD and went next gen with their disk format? Will games coming out later in the console’s life require multiple disks or an increase in price?

Back to RAGE…this game looks good, really good. The single player mode is suppossed to give you 20 hours or pure awesomeness and include a co-op mode. Also you will be able to leave your vehicles during the driving portions of the game and explore different areas. Some parts of the trailer look like they could be pre-rendered but I guess we will have to wait till it releases to know for sure. Id says that it will ship “when it’s done.” Want to see what all the hype is about? Watch the trailer below.

Airports Tighten Security for Console Carry-ons

46b78ab5ad4ab_featured_without_text_security_jwairport.jpg

Console-carrying gamers traveling via air this weekend got a surprise at security checkpoints, with new regulations mandating the removal of full-size video game consoles and DVD players from carry-on luggage for separate X-ray screening.

The previously unannounced rule by the Transportation Security Administration went into effect Saturday and brings game consoles and DVD players under the same regulations as laptop computers, cassette-using video cameras, and certain breathing machines.

"This was actually a policy recommendation that came from one of our security officers," TSA spokesperson Jennifer Peppin told Shacknews. "This change brings just a little more uniformity to our policy and helps our screeners do their job better."

The TSA Web site specifically references the PlayStation, Xbox and Nintendo-made consoles on a Web page detailing the enhanced security measure. Handheld gaming devices like the Nintendo DS or PSP and portable electronics like MP3 players are unaffected by the change and do not need to be removed from carry-on luggage.

The rule alteration does not mean consoles will be subject to further scrutiny, such as swab testing for explosives, other than the separate X-ray screening, Peppin said. Two other policy changes went into effect Saturday actually relaxing current TSA regulations, allowing commmon lighters in carry-on luggage as well as greater-than-three-ounce quantities of breast milk.

Peppin said the TSA did not announce the newly implemented rules regarding full-size consoles and DVD players in advance because of the relative unimportance of these items compared to the other changes. "We don't see a lot of full-size consoles and full-size DVD players coming through," she said.

Madden NFL 08: Xbox 360 vs. PS3
Decide with your own eyes.
By 1UP Staff, 08/07/2007
Not long ago, 1UP broke word that Madden NFL 08 (and 2K Sports' All-Pro Football 2K8, as well) would run at twice the frame rate of its PlayStation 3 brother. As the Madden drop date nears -- August 14th -- 1UP has taken the two versions and spliced together a comparison video of the 360 and PS3 versions to showcase the differences.

While you can check out a streaming version both here and on GameVideos, it's highly recommended you download the HD version (preferably in Quicktime, as it's of the highest quality) to get the best look at the visual differences between the two versions.

EA Tightens Hold on Ubisoft
The company now holds 25 percent voting stake in the French game maker.
by Ryan Geddes

August 8, 2007 - Electronic Arts has raised its holding of voting shares in Ubisoft to nearly 25 percent, according to reports from French stock market regulator AMF.

First reported on Forbes.com Wednesday morning, the increase gives EA 24.86 percent of Ubisoft's voting shares.

In December 2004, EA bought a 20-percent block of the French game maker, a move considered hostile by Ubisoft at the time.

EA's previously held 18.4 % of the voting rights against 22.8 % held by Ubisoft's founders.

Calls and emails to EA and Ubisoft requesting comment about the development were not immediately returned Wednesday morning.

According to the Forbes report, EA said it reserves the right to raise its stake in Ubisoft over the next year, but it has no plans to seek to nominate board members, but could do so if the are any major changes in Ubisoft's situation.

U.S. Troops Denied Free Copies Of Left Behind Game?

left_behind_osu.jpg

Evangelical group Operation Straight Up (OSU) had planned to ship copies of the PC real-time strategy game based on the Left Behind series of books, Left Behind: Eternal Forces, to U.S. troops stationed in Iraq. It appears those plans may have been changed, however, as the organization may have pulled the controversial game from its so-called Freedom Packages.

Following a post on The Nation by Max Blumenthal in which he slammed the game's inclusion, which was due to be mailed overseas with socks, snacks and other evangelical instruments, it appears that OSU may have decided to nix the poorly received game. For those not in the know when it comes to Left Behind: Eternal Forces, it puts the player in a post-Rapture scenario, in which you command an army of holy soldiers against those left behind (get it?). Either convert your enemies, putting the love of Jesus in their hearts, or blast the bejeezus out of them by shooting them in the heart.

The game has received its share of detractors, seeing public outcry from liberal groups, Islamic groups, Christian groups and, naturally, The Daily Show.

Interplay trying to gather funds for Fallout MMO

falloutmmo.jpg

Like a deadbeat dad promising to buy you a new bicycle "as soon as he gets the scratch together," Interplay is still talking about making an MMO based on the Fallout universe. They made mention of the idea last December, but, according to a new earnings statement, are perhaps a bit closer to beginning to realize it now that their debt load has been reduced from $59 million in December 2001 to less than $3 million.

Whatever they're planning, they may want to get hoppin'. Their agreement with Bethesda states that not only must Interplay pay a 12% royalty on net sales of the MMO, but it must be in development before April of 2009, must have a minimum of 10,000 subscribers and must comply with "the quality standards of Bethesda." By the way, this week's understatement champion is Interplay Chairman Herve Caen who said, "Fallout Online will play a key role in the future of Interplay." Yeah, Herve. No kidding.

Sony claims PS3 failure rate of less than 1 percent
by GamePro Staff | 08/16/2007 | 11:29:03 AM PST

PS3 failure rates are "around .02 percent" according to Sony Computer Entertainment Europe founder, Chris Deering while speaking at the Edinburgh Interactive Festival on Tuesday.

If accurate, that puts PS3 failure rates well below the industry average of three to five percent.

By comparison, some reports pin Xbox 360 failure rates as high as one third of all consoles in existence. As a result, Microsoft extended the Xbox 360 warranty from one to three years in July citing "an unacceptable number of repairs" without disclosing specific failure rates.

Nintendo has yet to reveal any failure rates for the Wii.

Turok isn't delayed, it's been February

Turok didn't recently receive a delay. Period. It's been February all the way back since E3. Despite what some major gaming news outlets are reporting, with one outlet in particular even having the same video below their story that we've linked from GameTrailers after the break, which clearly shows a Feb. release date.

Need more proof? Download the trailer on your Xbox 360 or PS3. They've all got the same date from months ago. As for Europe getting it Feb. 8, that's pretty much consistent with the way things work. Turok's already got a tough enough time being marketed by Disney, which is a shame because we definitely found our time with the game enjoyable. As much as August is a painful month for gamers in terms of delays, Turok just isn't one of them -- yet.

Silicon Knights Suing Epic Games

Details are somewhat scarce at the moment, but GameDaily BIZ has learned that Too Human developer Silicon Knights is suing Epic Games, creators of the blockbuster Gears of War and licensors of Unreal Engine. Epic's Mark Rein is not pleased... [Update: Denis Dyack says Unreal Engine "inadequate" and causing "serious damage" to industry]

The gears of war are turning indeed. GameDaily BIZ has just been notified by Epic Games' Vice President Mark Rein, that independent developer Silicon Knights is suing the company over unspecified allegations.

"This morning we were served with a lawsuit by Silicon Knights. We believe the claims against us are unfounded and without merit and we intend to fully defend against them," said Rein.

He continued, "We'd love to tell you more about it but unfortunately our lawyers want us to save our comments for the courthouse so we're going to do our best to comply with their wishes. In that vein we'd appreciate if our friends in the industry and media would refrain from asking us about the suit because we're only going to say 'no comment.' We just wanted to share the news directly before the rumor mill starts churning."

So with that in mind, we've refrained, but we did put in an inquiry with Silicon Knights to see what this is all about. Silicon Knights has licensed Unreal Engine for its upcoming Xbox 360 exclusive Too Human.

We'll bring you more information when it becomes available.

[UPDATE] GameDaily BIZ has now heard from Silicon Knights president Denis Dyack.

"We stand behind everything in our complaint and believe it is highly unfortunate that Epic forced us into this situation. We would rather spend our time focusing on making great games, but as stated in our complaint, Epic simply refuses to acknowledge the inadequacies of the Unreal Engine 3 code it provides to its licensees," he said, "and refuses to accept the fact that its code has caused serious damage not only to Silicon Knights, but a number of other developers in the industry. We look forward to successful resolution of our claims in this court proceeding."

[UPDATE 2] Gamasutra has managed to obtain the full 52-page lawsuit filed by Silicon Knights, which demands a jury trial for alleged breach of contract regarding Unreal Engine 3 licensing.

The gist of the suit is that Silicon Knights (SK) was provided with the Unreal Engine far too late. Epic's licensing document apparently stated that a functional version of the engine would be available within 6 months of 360 development kits being available. Ultimately, however, the company got the engine in November 2006, "far too late for time and cost-sensitive projects like SK's videogames." It's the late delivery of the engine that SK blames for the horrible state of the game at E3 2006, a showing that did damage to their reputation.

"Epic apparently was able to achieve a very useable version of the Engine for the Xbox 360 – the version that it kept to itself, for use only on its Gears of War game (as discussed below), to the detriment of Silicon Knights and Epic's other licensees... Epic's plan to avoid its obligations and hoard all of the necessary functionalities not only harmed Silicon Knights and all of Epic's other licensees in the industry, but also gave Epic a clearly unfair advantage in the industry," the lawsuit said.

"That advantage was nowhere more evident than at E3 2006, where Gears of War was awarded 'Best Game in Show' and garnered nothing but laudatory press. By contrast, Silicon Knights – one of the only other [Unreal Engine 3] developers to publicly display a playable demonstration of its game – saw Too Human roundly criticized in the videogame press for its technical problems and generally unpolished appearance. The damage to Silicon Knights caused by Epic's misconduct was manifest, because E3 attendees were able to compare Too Human with another game running ostensibly the same game engine, Gears of War, with vastly superior results."

Furthermore, according to a press release just sent to GameDaily BIZ, SK "has lost revenue as a result of the considerable delay in developing its video game for the Xbox 360, Too Human, because Unreal Engine 3, a game engine licensed from Epic, did not work as Epic represented it would and, moreover, Epic has been unable or unwilling to fix it."

"Our strong preference is to focus on making games, not be in court. Unfortunately though, as explained in our lawsuit, we have had extensive problems with the Unreal Engine 3 that Epic has been unwilling or unable to rectify," Dyack commented. "For more than a year, we have been trying to reach an agreement with Epic to resolve these issues without resorting to litigation, but were unable to come to reasonable terms with Epic. Regrettably, we are now forced to go to court in order to achieve satisfaction. We remain hopeful, however, that we can reach a reasonable business resolution with Epic at some point."

"No doubt Gears is a fun and phenomenally successful game, but as we alleged in our complaint against them, we strongly believe that from the perspective of someone waiting for a game engine that Epic promised it would deliver almost two years ago, it seems pretty clear that Gears was built on the backs of the Unreal Engine licensees," he added. "We certainly stand by our allegations in the lawsuit that instead of using our licensing fees to develop and support the Unreal Engine 3, Epic used that money to build Gears."

Now, in the meantime, it would seem that Silicon Knights is looking to remove elements of Unreal Engine from Too Human in favor of making its own engine or pursuing some alternative engine. It's undoubtedly a huge setback for the game, and it makes us seriously wonder when exactly the game will be able to ship.

The transformer of office chairs: a review of the Trey Chair

Once upon a LAN party

Trey Chair
Manufacturer: Sauder Manufacturing (web site)
Price: $239-299

My first experience with the Trey Chair was a rather unglamorous affair. When I'm sent something to review, I generally get the experience of unboxing, being able to really take in the whole of the product. With the Trey Chair, I was at a local LAN party organizing a game of poker, and we had run out of places to sit. A gentleman at the gathering told me he had an extra chair out in his car. Soon he had taken a nice-looking seat out of the packaging and put it near the table.

"Comfy!" I said, sitting down. "Thanks." I gave it a bounce, and didn't give it a second thought. I ended up winning about $20 at the table without thinking about where I was sitting. It turned out that the gentleman who so thoughtfully let me use one of his chairs had actually invented the product I was sitting on. His name is Jeff Jameson, and he wants your office chair to be your gaming chair.

I caught up with Jeff later on in the evening when I found out he had designed the product, and he was able to give me a demo of the Trey Chair. It looks like your regular office chair: it reclines, you can adjust the height, and it's pretty cushy. The secret is that with the press of a hidden tab underneath the chair's body, you can separate the chair portion from the base, creating a rocker to sit on as well as a sort of tray to hold anything from your laptop to a nice cold beer. The first time I saw it do its thing, I was rather taken aback. It's an intriguing idea to turn a normal piece of office furniture into something that lets me play games in the living room comfortably, while giving me a place to rest my appletini.

2.jpg

Mr. Jameson was nice enough to answer a few questions for us and allow Ars Technica the use of one of his chairs for a more in-depth review after the LAN party. He's an interesting guy; many of us spend so much time doing things in the virtual world that it's easy to appreciate how great it must feel to help design and market a physical item you can touch and hold. Jeff shared his thoughts on the design, as well as some of the early sketches of the Trey Chair.

After the interview, I'll share my own thoughts on the Trey.

all this suing, lobbying, stock fraud and favoritism is really starting to take the fun out of video games

Soul Calibur IV keeps laying on the sexuality

soulcaliburivboobs.jpg

Soul Calibur IV's bountiful breasts bounce along as Namco Bandai recently released more images of characters in the game. The first outing for the Soul Calibur crew on current-gen consoles is becoming better known for its breasts than anything else following a first-look at Ivy and her string-top battle bra in early June.
soulboob.jpg

Now we have Sophitia (above) in her almost see-through Jennifer Lopez-inspired double-sided-tape-required battle gear. Her sister Cassandra can be found in the gallery below with her breasts packed in nicely with a hole to breath through and show cleavage. Seriously, these women are fighting with blades in these outfits. How is this sane?

Also, after the break, we have a borderline NSFW image of Voldo. Now, granted, Voldo has always been overtly sub-pornographic with a BDSM vibe; however, the place where he has a spike coming out of now may be a bit over-the-top. If you don't instantly imagine it, just try to conceptualize how Voldo would sit down in that outfit.

Hoor-EA! Mac games hit Apple store today

cider-electronic-arts_wide.jpg

That's what they say. Publishing monolith EA has announced that four of its Cider-powered Mac OS X titles are now available to purchase on Apple's online store today. The initial burst looks to satisfy a variety of Mac gamers, including those who are partial to waging futuristic war (Battlefield 2142!), owning totally sick rides (Need for Speed Carbon!), casting ex-crucio-ting spells (Harry Potter and the Order of the Phoenix!) and, uh, waging even more futuristic war (Command & Conquer 3: Tiberium Wars!).

The games will also materialize on minimalistic shelves within Apple retail stores, with Potter and Need For Speed arriving on Tuesday, 21 August. Battlefield 2142 and Tiberium Wars should arrive the following week on 28 August. Though the tardy titles, namely Tiger Woods PGA Tour 08 and Madden NFL 08, were promised to arrive on the same day as other systems at WWDC, you can now expect their respective balls to come crashing through the "September/October window."

SIDEBAR: The GameSpot News Blog
EA prioritizing 360 over PS3

Earlier this week, New York Times writer Matt Richtel blogged about the reasons behind differences in the Xbox 360 and PlayStation 3 editions of some games.

In talking about the issue, Richtel cited analysts as saying that development for the PS3 is more challenging than for the Xbox 360 because game makers have had less time with the hardware. He also linked it to delays of the PS3 versions of games like Electronic Arts' Medal of Honor: Airborne and Skate.

Richtel revisited the topic after hearing back from EA about the issue. A representative with the publisher told the writer that as a release date nears, the company sometimes readjusts the manpower on the projects to complete the Xbox 360 version first.

With a larger installed base for Microsoft's console, the rep said it makes financial sense to get that version of a game out first and maximize potential sales. The representative also noted that in the last generation, it made more sense for the publisher to focus on PlayStation 2 versions of games over those on the Xbox because of the platform's massive installed user base.

Woo Hoo! Another John Woo game, this time a Chinese MMO

Gamers should already know about Midway's upcoming John Woo collaboration called Stranglehold, but now there's a new Woo game on the horizion.

Chinese developer Beijing Perfect World is creating an MMO based on the upcoming Woo film The Battle of Red Cliff (pictured above), which is set around the Three Kingdoms period of China's history. The developer is using its own Angelica engine to create the title, which will recount the battles that would come to unite the country.

The The War of Red Cliff MMO is slated to release later this year, though the film is still currently in production. Expect that to hit theaters next year.

You Cannot Kill It
2008 Brings More Dreamcast Games

DreamcastMainSystem.p.jpg

Just because SEGA has abandoned the Dreamcast, doesn't mean gamers have. Better yet, it doesn't mean developers have! Next year will see two new DC games: Dalforce and Wind and Water Puzzle Battles. The games are being published first quarter 2008 by RedSpotGames, who recently released Last Hope for the Dreamcast and the NEO GEO. Dalforce is a vertical shooter with 11 levels, 4 player mode and lots and lots of bullets. The other game is a port of puzzle game Wind and Water Puzzle Battles. It will have 4 player mode and exclusive DC characters. No word on pricing or distribution sources, but both games will be on display in Leipzig, where hopefully Team K will get us hot hot hands-on impressions.

Blizzard Says
Another Warcraft RTS "On The Table"

wc2.jpg

The announcement of Starcraft 2 got one monkey off Blizzard's back. The other three (Diablo 3, Warcraft 4 and, for me, Lost Vikings 3D), they're working on, one at a time. First up is another Warcraft RTS, which Blizzard's Rob Pardo says is definitely "on the table".

The way that we develop things, each time a development team becomes available, because they're done with creating the games that they've been doing, they have a lot of say over what their next game is. So what it would take is for one of our teams to decide that they want to make Warcraft RTS and of course, there'll be some talk about doing that and I'm sure after StarCraft 2 ships, it will be one the ideas on the table for that team to do, but that's pretty far off in the future and it would really be determined by a combination of the dev team and the company leadership.

This "Warcraft" name, it's pretty big these days. Think an RTS might be a no-brainer move for them, since you could release a Warcraft Activity Centre on the V.Smile and it'd still shift 20 million units. Blizzard's Pardo Hints at Warcraft RTS; Not Interested in Consoles [GameDaily]

Madden 08 Moonwalking Glitch: Patch Intercepted
Might want to avoid the "PA Smash Shake" play for a while.

media

Nothing brings down a great game of football faster than an AI-breaking bug -- especially one that causes your quarterback to flip out and scramble off the field. Some unlucky Madden NFL 08 players have been prey to just such a frustrating and embarrassing mishap in the first week since the game's release.

The "moonwalking glitch," as it's come to be known on forums, isn't extremely common, but it's also not the kind of thing gamers expect to slip by a massive publisher like Electronic Arts. To witness it, players must pick the Green Bay Packers Offensive Playbook, "GB - M. MCARTHY," and then choose the Shotgun - 2RB 3RW formation and "PA Smash Shake" for a play. The result: the quarterback being used will begin moonwalking and sometimes run right off the field while both the friendly and opposing computer-controlled players runs in circles.

It's important to remember that this bug does not require playing as the Green Bay Packers, just using their playbook. If you don't have a copy of Madden handy or don't want to try it yourself, check out the glitch reproduced below courtesy of 1UP user Shadow Hado:

We were also able to recreate this effect in the 1UP offices with no problems. It would be a shame to have such a small issue tarnishing an otherwise great game, but thankfully it seems that EA will be tackling the problem head-on. They gave us the following message in regards to the glitch:

"We have isolated this issue to one play in the Packers Playbook called 'PA Smash Shake.' We have identified a solution for this bug and will be fixing the problem through a patch. In the meantime, there are 337 other plays in the Packers playbook that you can run instead to avoid seeing this problem. If you absolutely need to run this play, if you flip the play, it will run correctly."

Potential mishap more or less avoided. Our favorite waiting-for-the-patch time-waster? Making vids of your favorite QBs pulling off their best Michael Jackson moves while they still can.

PS3 BioShock trace uncovered in PC demo?

Source: A config file inside the PC BioShock demo.

What we heard: Though BioShock is currently only available for the Xbox 360 and PC, many Sony fans fervently believe it will eventually arrive on the PlayStation 3. The articles of their faith? First, the fact that Irrational Games originally announced BioShock as coming to "PCs and next-generation consoles." There's also the example set by publisher 2K Games when it promoted the popular role-playing game Elder Scrolls IV: Oblivion as being PC/360 only...until it announced it was PS3-bound too.

This week, a new indicator of a possible PS3 version of BioShock surfaced. Among the myriad files accompanying the just-released PC demo of the game is a configuration document (Program Files/2k Game/Bioshock demo/Content/config.ini) outlining the game-engine settings. A subheading of the document references specific console settings for "(XBox360 [and] PS3)."

The mere mention of the console has been taken by many to mean that, at the very least, a PS3 version of BioShock was considered at one point. It's a perfectly valid hypothesis. In 2005, several files referencing the "Xbox" were found inside the code for Sierra's then-PC only shooter F.E.A.R. The following year, the game was ported to the Xbox 360. (It also arrived on the PS3 in 2007.) However, there's another completely reasonable explanation for the PS3 mention in the BioShock demo config file. The game uses the Unreal Engine 3, Epic Games' cross-platform game development toolset which is used for making numerous games for the PC, 360, and PS3.

The official story: Reps for 2K Games had not returned requests for comment as of press time.

Bogus or not bogus?: Bogus that the mention of the PS3 in the BioShock PC demo code is hard evidence the game is headed to Sony's console. However, the fact Bioshock is poised to be a hit after receiving one of the highest aggregate review scores in memory means that 2K would be foolish not to bring the game to the PS3...eventually.

Bioshock Facing Problems

The much anticipated PC and Xbox 360 FPS has only recently shipped, and it’s already facing a couple of big problems. First, it would appear that there are problems with the game’s widescreen mode, where the 4:3 ratio screen is simply chopped off at the top and bottom, and being called widescreen.

More concerning, though, is that thanks to the way anti-piracy software is set up on the PC version of the game, those who have snapped up a copy of this version of the game are quickly discovering that they will only be able to install the game twice, ever.

As you might expect, the 2K Games message boards are on fire with angry gamers, and the company has some explaining to do (and rightly so!).

More on BioShock Activation [August 22, 2007, 2:19 pm ET] - Viewing Comments
A post to the 2K Forums by 2K Elizabeth goes a little further into how the SecuROM online activation required to play BioShock (story) works when attempting multiple installs:

first, let me say this. you DO NOT NEED TO USE THE INTERNET EVERY TIME YOU PLAY THIS GAME. it is only the first time.

second, you can uninstall and reinstall this game, and if, by chance, you have 2 computers you want to simultaneously play this game on, you also can do that.

if by some chance you are reinstalling this game without uninstalling it first, a lot, there is a chance you may have to call securom and get a key, or deactivate some older installations.

but if you upgrade your hardware next week, you'll still be able to play the game. if you revamp your system and need to reinstall bioshock, just uninstall it before you go through the overhaul, and then do your reinstall.

calling it "hardware fingerprinting" is a bit alarmist. we do not transmit any of your data to any companies.

really, the only people who will be concerned about any of these security measures are those who are rapidly putting bioshock on many pcs... if you use the game as you normally do, you won't notice this at all.

BioShock patch servers go down
2K servers go down, preventing PC players from completing BioShock install process.
By Randolph Ramsay, GameSpot AU
Posted Aug 23, 2007 1:04 am PT

PC owners trying to install their brand-new copy of BioShock have had a rough time of late, with several users reporting that 2K Game's patch servers were down for some hours today.

Installing BioShock on a PC requires a user's computer to connect to 2K's auto patch servers before the game can be played, something made impossible for some time today when the 2K servers crashed. 2K's own forums were alight with disgruntled BioShock buyers who were prevented from playing the game due to the required connection. As of publication time, 2K's official Web site at http://www.2kgames.com/ was timing out, as was the BioShock http://www.cultofrapture.com/ site.

A 2K Games Australia spokesperson said 2K technicians were working on the issue, and had already added additional servers to help cope with the influx of traffic.
